HomeMy WebLinkAboutORD 32292019-041476 RECORDED 09/05/2019 08:48 AM 111111111111111111111111111111111111111111111111 00463337201900414760040047 CHRIS YAMAMOTO CANYON COUNTY RECORDER BILL NO. 37 Pgs=4 SDUPUIS NO FEE ORDINANCE ORDINANCE N0.3229 CITY OF CALDWELL AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CALDWELL, IDAHO, RECITING PETITION FOR VACATION OF PUBLIC ALLEY BETWEEN 11TH AND 12TH AVENUE AND BETWEEN CHICAGO AND BELMONT STREET; RECITING THAT APPROPRIATE NOTICE WAS GIVEN OF PUBLIC HEARING; DETERMINING THAT VACATION OF SAID PUBLIC ALLEY BE IN THE BEST INTEREST OF THE CITY OF CALDWELL AND THAT SAID PUBLIC ALLEY SHALL BE VACATED; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, AND STATE OF IDAHO: Section 1. That by a motion passed by the Council and approved by the Mayor of the City of Caldwell, Idaho, and proper notice having been given of these proceedings to adjoining property owners and published in the official newspaper of the City, and a public hearing having been held by the Council, all in accordance with the requirements of Idaho Code §§ 50-1325 and 50- 311 and other law, requesting passage and approval of an ordinance vacating the public alley described below located in Caldwell, Canyon County, Idaho: Legal description for the vacation of public alley in Block 31, Revised Map of Caldwell according to the plat thereof filed in Book 1 of Plats at Page 20, records of Canyon County, and also located within the SE quarter of Section 22, Township 4 North, Range 3 West of the Boise Meridian, Canyon County, Idaho, more particularly described in Exhibit "A". Section 2. That the Council finds the public alley vacated by this ordinance is not needed nor will again be needed by the public; Section 3. That the Council finds the owners of all properties abutting the public alley vacated by this ordinance have been properly notified of this action and have consented thereto or failed to object; Section 4. That Council finds the owners of all properties abutting public alley vacated by this action, have access to his, her, or their property from some other public street, public alley or private road; Section 5. PETITIONER shall incur all cost related to said vacation. Section 6. That said public alley vacated does not contain public or private utility lines. That no rights of any third parties, or the City of Caldwell, will be affected by the public alley vacation; Section 7. That the Council finds it to be in the best interest of the public that the portion of the above-described public alley in the City of Caldwell, Canyon County, Idaho, be vacated; Section 8. This ordinance shall be in full force and effect from and after its passage and publication according to law and compliance with all conditions prescribed herein. ATTEST: EXHIBIT A Legal Description for Block 31 Alley Vacation (Caldwell Original) A portion of the public alley to be vacated in Block 31, Revised Map of Caldwell, according to the plat thereof filed in Book 1 of Plats at Page 20, records of Canyon County, and also located within the Southeast Quarter of Section 22, Township 4 North, Range 3 West of the Boise Meridian, Canyon County, Idaho, more particularly described as follows: Beginning at the Northernmost corner of Lot 7, Block 31 according to the plat thereof filed in Book 1 of Plats at Page 20, records of Canyon County, thence Southeasterly 150 feet, more or less, along the southwesterly line of the public alley within Block 31 according to the plat thereof filed in Book 1 of Plats at Page 20, records of Canyon County, to the Easternmost corner of Lot 12 of said Block 31, thence Northeasterly 16 feet, more or less, to the Southernmost corner of Lot 13 of said Block 31, thence, Northwesterly 150 feet,more or less, along the northeasterly line of the public alley within Block 31 to the Westernmost corner of Lot 18 of said Block 31, thence Southwesterly 16 feet, more or less, to the Northernmost corner of Lot 7 and the Point of Beginning.
