ORDINANCE NO. 3217
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, REAPPOINTING
TWO COMMISSIONERS OF THE URBAN RENEWAL AGENCY OF THE CITY OF
CALDWELL AND PROVIDING CLARIFICATION AS TO HOW FUTURE MEMBERS
OF THE BOARD OF COMMISSIONERS WILL BE APPOINTED TO FILL VACANCIES
ON THE BOARD, IN ACCORDANCE WITH IDAHO CODE § 50-2006; PROVIDING AN
EFFECTIVE DATE; PROVIDING. FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT
HEREWITH.
WHEREAS, on June 19, 2017, the Caldwell City Council passed, and the Mayor approved
Ordinance No. 3 10 1, which ordinance, in accordance with the then newly amended provisions of
Idaho Code § 50-2006(b)(3), terminated the previously existing Board of Commissioners of the
Caldwell Urban Renewal Agency (the "Agency"), being the Caldwell City Council, and appointed
a new Board of Commissioners made up of six commissioners; only three of which were members
of the Caldwell City Council;
WHEREAS, The Caldwell City Council desires to reappoint two members of the Board of
Commissioners whose terms will expire on July 1, 2019, and, further, to provide a clear and
preferred method for the filling of all future vacancies on the Agency's Board of Commissioners.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of
Caldwell, County of Canyon, State of Idaho:
Section 1. Commissioner JULIE WARWICK, whose term on the Agency's Board of
Commissioners is set to expire on July 1, 2019, is hereby reappointed, effective July 1, 2019, to
serve a three-year term commencing July 1, 2019, and continuing until July 1, 2022.
Section 2. Commissioner CHUCK STADICK, whose term on the Agency's Board of
Commissioners is set to expire on July 1, 2019, is hereby reappointed, effective July 1, 2019, to
serve a three-year term commencing July 1, 2019, and continuing until July 1, 2022, or until the
date that he ceases to serve as a member of the Caldwell City Council, if sooner.
Section 3. In the event of a vacancy in the Agency's Board of Commissioners resulting
from the death, resignation or removal of a member from said Board, or in the event of a vacancy
resulting from the expiration of a member's term, said vacancy shall be filled by nomination of
the Mayor, with the advice and consent of the Caldwell City Council. Any vacancy for a seat on
the Board of Commissioners previously held by a member of the Caldwell City Council shall be
filled by a member of the Council. Any vacancy for a seat on the Board of Commissioners
previously held by a person who is not a member of the Council, shall be filled by a person who
is not a member of the Council.

Section 4. This ordinance shall be in full force and effect from and after July 1, 2019.
Section 5. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.
Section 6. All ordinances, resolutions, orders and parts thereof in conflict herewith are
repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3127
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, REAPPOINTING TWO
COMMISSIONERS OF THE URBAN RENEWAL AGENCY OF THE CITY OF CALDWELL
AND PROVIDING CLARIFICATION AS TO HOW FUTURE. MEMBERS OF THE BOARD OF
COMMISSIONERS WILL BE APPOINTED TO FILL VACANCIES ON THE BOARD, IN
ACCORDANCE WITH IDAHO CODE § 50-2006; PROVIDING AN EFFECTIVE DATE;
PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH.
Sections 1 through 3: Reappoints Chuck Stadick and Julie Warwick as members of the Board of
Commissioners of the Urban Renewal Agency of the City of Caldwell; clarifies that all future vacancies on
the board may be filled by nomination of the Mayor with the advice and consent of the Caldwell City
Council; and, instructs that vacancies for seats held by members of the Caldwell City Council should be
filled by a member of the Council, while vacancies for seats held by a person who is not a member of the
Council should be filled by a person who is not a member of the Council.
Sections 4 through 6: Provides that this ordinance shall be in full force and effect from and after July 1,
2019; provides for severability; repeals conflicting ordinances, resolutions, and orders.
Ordinance No. 3127 provides an effective date, which shall be July 1, 2019. Ordinance No. 3127 was passed
by the Council and approved by the Mayor on the 17th day of June, 2019. The full text of the Ordinance is
available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho 83605. The Mayor and City Council
approved the foregoing summary on the 17th day of June, 2019, for publication on the 25th day of June,
2019, pursuant to Idaho Code § 50-901 A.
