HomeMy WebLinkAboutORD 3188BILL NO. 58 ORDINANCE NO. 3188 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING CHAPTER 2, ARTICLE 9, SECTIONS 02-09-01, 02-09-03, AND 02-09-05, OF THE CALDWELL CITY CODE, PERTAINING TO THE CALDWELL GOLF COURSE BOARD; REPEALING CHAPTER 2, ARTICLE 9, SECTIONS 02-09-07, ENTITLED "FINANCIAL REGULATIONS," IN ITS ENTIRETY; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 2, Article 9, Sections 02-09-01, 02-09-03, and 02-09-05, of the Caldwell City Code, pertaining to the Caldwell Golf Course Board, be amended as follows: 02-09-01: BOARD CREATED; PURPOSE: (1)—There is hereby created a Golf Course Board which shall consist of the President of the Caldwell Men's Golf Association, the President of the Caldwell Women's Golf Association, the President of the Caldwell Junior Golf League, and between seven (7) and ten (10) additional individuals who shall be appointed by the Mayor, with the consent of the Council. One hof the members so appointed shall be a member of the Council, and the other six (6` all remaining members shall be active golf players. Appointment of one or more youth participants in the Caldwell Junior Golf League as members of the Golf Course Board is welcome and encouraged. All shall serve without salary. (2) The purpose of the Caldwell Golf Course Board shall be to advise and make recommendations to the Mayor and Council of the City of Caldwell on matters pertaining to the operation and maintenance of the City's two municipal golf courses: Fairview Golf Course and Purple Sage Golf Course. 02-09-03: TERMS OF OFFICE: (1) The term of the respective members of the Golf Course Board shall be as follows: the President of the Caldwell Men's Golf Association,—and the President of the Caldwell Women's Golf Association, and the President of the Caldwell Junior Golf Association shall serve for their respective terms in said offices. The member appointed from the Council shall serve for a period of two (2) years, or until the end of his term as a Council member, and the other- six «` remaining members shall be appointed for terms of four (4) years, excepting that PAGE -1 there shall not be more than two (2) members whose terms shall expire in any one (1) year. Accordingly, appointments may be made for terms less than four (4) years in order that not more than two (2) members' terms expire in any one year. A member may be reappointed to serve consecutive terms. (2) All vacancies, except the President of the Caldwell Men's Golf Association,. -ate the President of the Caldwell Women's Golf Association, and the President of the Caldwell Junior Golf Association, shall be filled by appointment in the same manner as appointments were originally made, for the unexpired term of the vacancy. In the event of a vacancy, Board members may recommend to the Chairperson names of possible Board members, and, upon a vote of the Board the name of the candidate receiving the greatest number of votes shall be recommended to the Mayor and Council for appointment to fill said vacancy. 02-09-05: ORGANIZATION AND BYLAWS: The Golf retffse LVUr shall, immediately following thei- appointment, f^+ f organization f r.+,r, « the alaof one of the b me !�1-, rl for- +L, Vl �LL11S seleaion md appeintmepA of sueh other offieers a -Rd employees as they may deem neeesIn lieu of an�previousl�ado tp ed Bylaws, and to the extent not addressed through other provisions within this Article, the following rules and regulations shall govern the basic business of the Caldwell Golf Course Board: (a) Officers: At its regular meeting to be held in June of each year, the Board shall elect its own Chairperson, Vice -Chairperson and Secretary, to serve in said offices for one (1) year terms, commencing July 1 through June 30 of the followingyear, and may create and fill such other offices as it may determine to be necessary (b) Meetings; Quorum: The Board shall meet at least five (5) times per year, with regular meetings to be held beginning at 8:00 a.m. at Caldwell City Hall 411 Blaine Street, Caldwell, Idaho), on the third (P) Wednesday of February, April, June, August, and October. Additional meetings may be called by the Chairperson or at the request of the Mayor upon at least seven (7) dqys written notice to the members ' of the Board. The Chairperson will prepare the agenda for each meeting. Complete Minutes shall be kept by the Secretary. Following each meeting, copies of the minutes shall be distributed by the Secretary to each member of the Board. A Quorum shall consist of one-half (1/2) or more of the appointed members of the Board. Section 2. That Chapter 2, Article pertaining to the Caldwell Golf Course Board, and repealed in its entirety. PAGE — 2 9, Section 02-09-07, of the Caldwell City Code, and entitled "Financial Regulations," be deleted Section 1 This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 4. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 5. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 4th day of March, 2019. Sections I and 2: Amends Chapter 2, Article 9, Sections 02-09-01, 02-09-03, and 02-09-05, and repeals Section 02-09-07, of the Caldwell City Code, pertaining to the Caldwell Golf Course Board, so as to provide greater flexibility as to the number of members on the Caldwell Golf Course Board, to create a position on the Board for the President of the Caldwell Junior Golf League, to encourage the appointment of youth participants in the Caldwell Junior Golf League to the Board, to clarify the purposes of the Board, to eliminate unnecessary provisions, and to provide additional detail related to the Board's membership, terms, officers, meetings, records, and related matters. Sections 3 through 5: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances; resolutions, and orders. Ordinance No. 3188 provides an effective date, which shall be on the 12th day of March, 2019. Ordinance No. 3188 was passed by the Council and approved by the Council President on the 41h day of March, 2019.
