ORDINANCE NO. 3196
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL CHANGING THE
SUFFIX OF A PORTION OF "THE FIGHT-OF-WAY KNOWN AS "LASTER' FROM
"LANE" TO "STREET"; PROVIDING FOR AN EFFECTIVE DATE; :PROVIDING FOR
SEVERABILITY, AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS
AND PARTS THEREOF" IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, Canyon County,
State of Idaho:
Section 1: pursuant to the authority set forth in Idaho Code § 50-318 and ill the Caldwell City Code
at § 05-07-0'8(2), and upon the request of the Caldwell Mapping Department, that the suffix of that certain
right-of-ivy Known as"LASTER LANE", from Cleveland Boulevard westward to the Notus Canal, shall
be changed to"LASTER STREET" ill order to comply with the preferences set forth in Caldwell City Code
05-07-04(3)and as specified in Ordinance No. 2962.
Section2: Notice to all affected developed property owners will be sent out upon passage of'this
ordinance with an effective date 90 days thereafter. This change will be effective immediately upon
publication of this ordinance for all remaining properties fronting; this street that are undeveloped or .are
currently under construction.
Section 3. This ordinance is hereby, declared to be severable. If any portion of this ordinance is
declared invalid by a court of competent jurisdiction,the remaining provisions 'shall continue in full force
and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial
invalidity.
Section 4: All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed,
rescinded and annulled.

2019..

SUMMARY STATEMENT:
The right-of-way known as"LASTER LADE"from Cleveland Boulevard westward to the Notus Canal has been in
existence for many years. As with other rights-of-way designated with a suffix of"LANE,",when subdivision or
commercial development occurs along these portions of roadway,the process has been to change the suffix to one
that matches City Code.
According to Section 0 -07- 1-3 of the Caldwell City Code,a'LANE' is a street suffix designated for a private
street not dedicated to or maintained by the City,while a"STREET" is an east-west street generally running in a
straight line.
While this portion of right-of-way has had previous subdivision development,the change is now being requested.
This change would affect four(4)property owners,one of which is a proposed commercial development. 3 of the 4
property owners have been contacted with no apposition to the proposed change. The 4"owner has not responded.
Staff recommends approval of the attached ordinance.
