ORDINANCE NO. 3183
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING
CHAPTER 2, ARTICLE 29, SECTIONS 2-29-1 AND 2-29-3, OF THE CALDWELL CITY
CODE, PERTAINING TO THE SENIOR CITIZEN'S CENTER COMMISSION;
PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF,
IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon,
State of Idaho:
Section 1. That Chapter 2, Article 29, Sections 2-29-1 and 2-29-3, of the Caldwell City
Code, pertaining to the Senior Citizen's Center Commission, be amended as follows:
02-29-01: PURPOSE:
The purpose of the Caldwell Senior Citizen's eCommission shall be the care,
custody and control of the building and grounds upon which the Caldwell Senior
Center, also known as the Caldwell sSenior eCitizen's Center, isrep sently located
(i.e., 1009 Everett Street, Caldwell, Idaho 83605) building andgrounds
In the carrying out
of that purpose, the Commission shall make recommendations and suggestions to
the Council pertaining to the general use of said building and grounds the
expenditure of funds related thereto and with respect to capital improvements or
repairs which may be necessary or advisable.
02-29-03: GENERAL PROVISIONSBYLAMS:
a) Membership and Terms: The Senior Citizen's Center Commission shall
be comprised of not less than three (3) members nor more than nine (9) members
appointed by the Mayor, with the advice and consent of the Council. Commission
members shall be appointed for terms of two (2) years, commencing January I and
ending on December 31. Any vacancy shall be filled by appointment in the same
manner and members so appointed shall serve onlv for the remainder of the term
which is vacant.

a) Membership and Terms: The Senior Citizen's Center Commission shall

(bQualifications: Persons interested in receiving an appointment shall be
residents of the City of Caldwell, or its impact area, and shall demonstrate an
interest in supporting the purposes of the Center.
(c) Officers: The Commission shall elect its own Chairman and Secretary,
and may create and fill such other offices as it may determine necessM.
(d) Meetings: The Commission shall hold at least four (4) regular meetings
each year, held on a quarterly basis. A majority of the appointed members of the
Commission shall be necessary to constitute a quorum at any meeting. All meetings
of the Commission shall be held in compliance with Idaho Code Title 74, Chapter 2
(Idaho Open Meetings Law), and written minutes of all such meetings shall be keit
in accordance with said law. All records created by the Commission or its members
in the conduct of the Commission's business shall be considered "public records,"
and shall be subject to the requirements of Idaho Code Title 74, Chapter 1 (Idaho
Public Records Act).
(e) Liaison: The Mayor and Council may appoint a Liaison to serve as a
member of the Commission from the Council or from among city staff.
Section 2. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 3. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.
Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith
are repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3183
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING CHAPTER
2, ARTICLE 29, SECTIONS 2-29-01 AND 2-29-03, OF THE CALDWELL CITY CODE,
PERTAINING TO THE SENIOR CITIZEN'S CENTER COMMISSION; PROVIDING AN
EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT
HEREWITH.
Section 1: Amends Chapter 2, Article 29, Sections 2-29-01 and 2-29-03, of the Caldwell City Code,
pertaining to the Senior Citizen's Center Commission, by adding additional details relating to the
Commission's membership, membership terms and qualifications, officers, meetings, records, and adding
a provision under which a liaison may be appointed from the council or from among city staff.
Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law; provides for severability; repeals conflicting ordinances,
resolutions, and orders.
Ordinance No. 3183 provides an effective date, which shall be on the 13th day of November, 2018.
Ordinance No. 3183 was passed by the Council and approved by the Mayor on the 5th day of November,
2018. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho
83605. The Mayor and City Council approved the foregoing summary on the 5th day of November, 2018,
for publication on the 13th day of November, 2018, pursuant to Idaho Code § 50-901 A.
