ORDINANCE NO. 3174
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD
BE REZONED TO THE M-1 (LIGHT INDUSTRIAL) ZONE; DETERMINING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID
PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures as required in Section 10-03-03,
Caldwell Municipal Code, approved Case No. ZON-18-08 (Global Tractor) at a public hearing held the 5th
day of November 2018.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to M-1 (Light Industrial) zone:
A parcel of land situation in the SW'/ of Section 31, Township 4 North, Range 2 West, Boise Meridian,
Canyon County, Idaho, being a portion of Lots 1 and 2 of LONGVIEW PLACE SUBDIVISION according
to the official plat thereof recorded in Book 1 of Plats, Page 26, Canyon County Records, more
particularly described as follows:
COMMENCING at the SW corner of said Section 31; thence North 89°30'46" East, 784.75 feet along the
South boundary of said SW '/ to a point on the centerline of the Caldwell Drain; thence North 23°07'02"
West, 47.40 feet along said centerline to a point on the right -a -way line of Interstate 80 North (84); thence
along the Southerly line of the Parcel of land as described in Instrument No. 9702484, Canyon County
Records the following courses: North 87°24'13" West, 61.97 feet to the Southwesterly line of that certain
35.00 foot wide Permanent Easement as shown on improvement plans of FAP No. 1 -80N -I-(42)28, Sheet
31 of 49, on file in the office of the Idaho Transportation Department, Boise, Idaho, lying adjacent to and
Northeasterly of FRONTAGE ROAD NO. 2 (Aviation Way); thence continuing along said Southerly line
and the above-described Southwesterly easement line through the following courses: North 00°29'14"
West, 16.92 feet to the beginning of a tangent curve; thence Northwesterly along said curve to the left
having a radius of 102.00 feet, an arc length of 160.22 feet, a central angle of 90°00'00", a chord bearing
and distance of North 45029'14" West, 144.25 feet; thence tangent from said curves, South 89030'46"
West, 85.58 feet; thence leaving said Southerly line and easement line, North 44013'35" West, 48.44 feet
to the Northeasterly line of the above described 35.00 foot wide Permanent Easement and the POINT OF
BEGINNING; thence along said Northeasterly line through the following courses: South 89030'46" West,
119.89 feet to a point on the non -tangent curve; thence Northwesterly along said curve to the right having
a radius of 235.00 feet, and arc length of 88.11 feet, a central angle of 21028'57", and a chord bearing
and distance of North 62°58'13" West, 87.60 feet; thence tangent from said curve, North 52013'44" West,
165.28 feet to the beginning of a tangent curve; thence Northwesterly along said curve to the right having
a radius of 235.00 feet, an arc length of 214.92 feet a central angle of 520 23' 56", and a chord bearing
and distance of North 26° 01' 48" West, 207.50 feet; thence, leaving said Northeasterly line, North
45°46'25" East, 72.98 feet; thence South 44013'35" East, 526.63 feet to the POINT OF BEGINNING.
Containing 1.31 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as M-1 (Light Industrial).

CITY OF CALDWELL
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

ORDINANCE NO. 3174
REGARDING ZONE DESIGNATION

Containing 1.31 acres, more or less.
The Ordinance includes a provision to amend the official maps of the City by designating the above-
described property as M-1 and providing an effective date, which shall be when published in the Idaho
Press Tribune on the 13th day of November 2018. Ordinance No. 3174 was passed by the Council and
approved by the Mayor on the 51h day of November 2018. The full text of the Ordinance is available at
Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and City Council approved the
foregoing summary for publication pursuant to Idaho Code 50-901A on the 5th day of November 2018.
