BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON-18-07 (0 Amber Street Rezone) at a public hearing held, October 15tH 2018. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to C-1 (Neighborhood Commercial) zone: A parcel of land being a portion of the N 1/2 S 1/2 SW 1/4 NW 1/4 SW 1/4 of Section 34, Township 4 North, Range 3 West, Boise Meridian, Caldwell City, Canyon County, Idaho, being more particularly described as follows: COMMENCING at the SW corner of the NW '/4 SW 1/4 of said Section 34; thence N00°0112"E, 165.12 feet along the westerly boundary of said NW 1/4 SW 1/4 of Section 34 to the SW corner of the N 1/2 S 1/2 SW %4 NW 1/4 SW 1/4 of said Section 34; thence N89°38'37"E, 201.00 feet along the southerly boundary of said N 1/2 S '/2 SW 1/4 NW 1/4 SW 1/4 of Section 34 to the POINT OF BEGINNING; thence N00°01'12"E, 164.78 feet along a line parallel with said westerly boundary of the NW 1/4 SW 1/4 of Section 34 to the northerly boundary of said N % S 1/2 SW 1/4 NW 1/4 SW %of Section 34; thence N89°39'04"E, 461.10 feet along said northerly boundary of the N % S 1/2 SW 1/4 NW %4 SW %4 of Section 34 to the northeast corner of said N '/2 S 1/2 SW 1/4 NW 1/4 SW 1/4 of Section 34; thence S00°01'29"E, 164.72 feet along the easterly boundary of said N % S 1/2 SW 1/4 NW 1/4 SW 1/4 of Section 34 to the SE corner of said N 1/2 S % SW % NW %SW 1/4 of Section 34; thence 589°38'37"W, 461.23 feet along the southerly boundary of said N '/ S 1/2 SW 1/4 NW 1/4 SW %of Section 34 to the POINT OF BEGINNING. Comprising 1.74 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as C-1 (Neighborhood Commercial). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Z: / r ••• ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3168 REGARDING ZONE DESIGNATION OF CERTAIN PROPERTY This ordinance provides for the rezone of a parcel of land in the City of Caldwell as C-1 (Neighborhood Commercial). A parcel of land being a portion of the N '/2 S '/2 SW %4 NW 1/4 SW %4 of Section 34, Township 4 North, Range 3 West, Boise Meridian, Caldwell City, Canyon County, Idaho, being more particularly described as follows: COMMENCING at the SW corner of the NW % SW %of said Section 34; thence N00°01'12"E, 165.12 feet along the westerly boundary of said NW 1/4 SW 1/4 of Section 34 to the SW corner of the N '/2 S 'A SW 1/4 NW 1/4 SW Y4 of said Section 34; thence N89°38'37"E, 201.00 feet along the southerly boundary of said N '/2 S '/2 SW'/4 NW 1/4 SW 1/4 of Section 34 to the POINT OF BEGINNING; thence N00°01'12"E, 164.78 feet along a line parallel with said westerly boundary of the NW 1/4 SW Y4 of Section 34 to the northerly boundary of said N '/ S '/2 SW 1/4 NW 1/4 SW %4 of Section 34; thence N89°39'04"E, 461.10 feet along said northerly boundary of the N 1/2 S '/2 SW 1/4 NW 1/4 SW 1/4 of Section 34 to the northeast corner of said N 1/2 S 1/2 SW 1/4 NW 1/4 SW 1/4 of Section 34; thence 500°01'29"E, 164.72 feet along the easterly boundary of said N 1/2 S 1/2 SW 1/4 NW 1/4 SW 1/4 of Section 34 to the SE corner of said NIA S '/2 SW 1/4 NW 1/4 SW 1/4 of Section 34; thence S89°38'37"W, 461.23 feet along the southerly boundary of said N '/2 S '/2 SW 1/4 NW'/4 SW 1/4 of Section 34 to the POINT OF BEGINNING. Comprising 1.74 acres, more or less. The Ordinance includes a provision to amend the official maps of the City by designating the above- described property as C-1 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 23rd day of October 2018. Ordinance No. 3168 was passed by the Council and approved by the Mayor on the 15th day of October 2018.
