HomeMy WebLinkAboutORD 3170BILL NO. 40 ORDINANCE NO. 3170 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE M-1 (Light Industrial) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ZON-18-06 (Idaho Power Rezone) at a public hearing held October 1 st, 2018. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to M-1 (Light Industrial) zone: A parcel of land being a portion of the W 'h NW '/ of Section 25, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho, more particularly described as follows: COMMENCING at the NW corner of said Section 25, from which the W '/ Corner of said Section 25 bears South 00026'52" West, 2650.64 feet; thence South 00°26'52" West, 1263.44 feet coincident with the West line of said NW '/ of Section 25; thence South 89033'08" East, 30.00 feet perpendicular to said West line to the East right-of-way line of Aviation Way as described in Quitclaim Deed Instrument No. 9623848, records of Canyon County, and the POINT OF BEGINNING; thence North 89049'45" East, 300.05 feet to the NW corner of Lot 1 Block 2 of Sky Ranch Business Center No. 2, Phase 2 Subdivision, Book 44 of Plats at Page 1, records of Canyon County; thence South 00027'08" West, 231.50 feet coincident with the West line of said Lot 1 Block 2 to the SW corner of said Lot 1 Block 2 and the northerly right-of-way line of Skyway Drive as described in Warranty Deed Instrument No. 2013038637, records of Canyon County, and the beginning of a non -tangent curve to the left; thence northwesterly along said curve to the left, coincident with said northerly right-of- way line, an arc distance of 3.39 feet, said curve having a radius of 460.00 feet, a central angle of 0025'20", and a chord bearing of North 89045'29" West, 3.39 feet; thence North 8958'09" West, 296.64 feet coincident with said northerly right-of-way line to said East right-of-way line of Aviation Way; thence North 00°26'52" East, 230.43 feet parallel and offset 30.00 feet easterly of said NW '/ of Section 25, coincident with said East right-of-way line to the POINT OF BEGINNING. Contains 1.59 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as M-1 (Light Industrial). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. The Ordinance includes a provision to amend the official maps of the City by designating the above- described property as M-1 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 9th day of October 2018. Ordinance No. 3170 was passed by the Council and approved by the Mayor on the 1St day of October 2018.
