A RESOLUTION BY THE CALDWELL EAST URBAN RENEWAL AGENCY
GRANTING AN EASEMENT TO THE ELISON FINANCIAL GROUP LLC FOR THE
PURPOSE OF CONSTRUCTING, OPERATING AND MAINTAINING DOMESTIC
WATER SERVICE LINES.
Be it Resolved that the Caldwell East Urban Renewal Agency hereby accepts and approves an
"Easement" for the purpose of constructing, operating and maintaining domestic water service
lines to the Elison Financial Group LLC and authorizes the Chairman to sign said easement. This
easement provides a pathway for domestic water service lines across a portion of Caldwell East
Urban Renewal Agency's property to provide water service to 4603 Skyway Street and allow for
the operation and maintenance of said water service lines.
The Clerk of the Caldwell East Urban Renewal Agency is hereby directed to gain the appropriate
signature(s), record said easement and return the "Easement" to the City of Caldwell Engineering
Department.

Re: Authorize the URA Chairman to sign the attached easement granting the Elison Financial
Group LLC the right to operate and maintain domestic water service lines.
Caldwell East Urban Renewal Agency has agreed to provide an easement for domestic water
service lines across a portion of their property to provide water service for 4603 Skyway Street
(Parcel No. R3528710300).This easement is necessary for the operation and maintenance of said
water service lines.
The original easement is attached:

It is recommended that the Caldwell East Urban Renewal Agency chairman and board approves the
easement as submitted.

THIS INDENTURE, Made this 13th day of August, 2018, between URBAN RENEWAL
AGENCY OF THE CITY OF CALDWELL, IDAHO party of the first part; and ELISON
FINANCIAL GROUP LLC,party of the second part; WITNESSETH:
That the party of the first part, for good and valuable considerations, the receipt and
sufficiency of which is hereby acknowledged, does by these presents grant forever unto the party of
the second part, its successors and assigns, for the purpose of operating and maintaining water
service lines, with the necessary appurtenances thereto, and for accessing Grantees property, full
and free right to enter upon the real property of the party of the first part, said real property being
described as follows:
See Exhibit"A", comprised of 2 pages
Attached hereto and made a part hereof
This easement is made subject to the following conditions:
1. The easement described above is hereby perpetually reserved for the utility purpose herein
set forth and no structures other than those for such utility purposes are to be erected within
the limits of said easement.
2. The Elison Financial Group LLC shall have the right at any time to cut, trim, and clear all
trees, brush, and other obstructions that may injure, endanger, or interfere with the
construction, operation, or maintenance of said utility.
3. In exercising the rights granted herein, Elison Financial Group LLC will not unreasonably
interfere with the normal use of the premises and will, at its sole cost and expense and with
due diligence, restore the premises to its original or better condition following any use of the
easement either for construction, repair, maintenance, and/or replacement of said facilities
and appurtenances thereto.

Being a portion of Lot 7 of Block 1 of East Caldwell Urban Renewal Phase 1
Subdivision, as shown on the official plat hereof on file in the office of the Canyon
County, Idaho, Recorder, and being more particularly described as follows:
Commencing at the southeast corner of Lot 4, Block 1 of said East Caldwell
Urban Renewal Phase 1 Subdivision; thence 136.41 feet along a non-tangent curve
deflecting to the left with a radius of 534.90 feet, a central angle of 14°36'41" and a
long chord of 136.04 feet bearing N59°29'26"W along the northeasterly boundary of
said Lot 7 to the Point of Beginning:
Thence continuing 15.00 feet along a tangent curve with a radius of
534.90 feet, a central angle of 1°36'24" and a long chord of 15.00 feet
