ORDINANCE NO. 3172
AN ORDINANCE ENTITLED APPROPRIATION ORDINANCE FOR THE FISCAL YEAR
BEGINNING OCTOBER 1, 2018 APPROPRIATING THE SUM OF $84,281,591 TO DEFRAY THE
EXPENSE AND LIABILITIES OF THE CITY OF CALDWELL, IDAHO, FOR SAID FISCAL YEAR,
AUTHORIZING A LEVY OF SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND
SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATION IS MADE.
BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of Canyon, State of
Idaho:
Section 1. That the sum of $84,281,591 be and the same is appropriated to defray the necessary expenses
and liabilities of the City of Caldwell, Canyon County, Idaho, for the fiscal year beginning October 1,
2018.
Section 2. The objects and purposes for which such appropriation is made and the amount of each object
and purpose is as follows:

Section 3. That a general tax levy on all taxable property within the City of Caldwell be levied in an
amount allowed by law for the general purposes for said City for the fiscal year beginning October 1, 2018.
Section 4. All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed.
Section 5. This ordinance shall take effect and be in full force upon its passage, approval and publication in
one issue of the Idaho Press Tribune, the official newspaper of said City.

AN ORDINANCE RECITING PETITION FOR VACATION OF EASEMENTS AND
RECITING APPROPRIATE NOTICE WAS GIVEN TO PUBLIC UTILITIES; DETERMINING
THAT VACATION OF SAID EASEMENT IN THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO, DESCRIBED BELOW, SHALL BE MADE; AND DETERMINING THAT
VACATION OF SAID EASEMENTS ARE IN THE BEST PUBLIC INTEREST FOR THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO.
DESCRIBED HEREIN, This ordinance is vacation of a portion of the utility easement along the
west boundary line of Lot 14, Block 1, Kingsview Estates Subdivision No. 1, recorded in Canyon
County, Idaho in Book 37 of Plats at Page 16, located in the SE 1/4 of Section 10, Township 3
North, Range 3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, more
particularly described in attachments;
Section 1. That an application has been presented to the Mayor and Council of the City
of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above
described easements located in Caldwell, Canyon County, Idaho.
Section 2. That Council finds the public utility easements vacated by this instrument
have not been opened or used by the public for a period of five (5) years;
Section 3. That Council finds the owners of all properties abutting easements vacated by
this action, have access to his, her, or their property from some other public street, public right-
of-way or private road;
Section 4. That said easement(s) do not contain public or private utility lines.
Section 5. That it is hereby determined it is in the best interest of the public that the
above-described easement in the City of Caldwell, Canyon County, Idaho be vacated.
Section 6. This ordinance shall be in full force and effect from and after its passage and
publication according to law and compliance with all conditions prescribed herein.
Section 7. Be it ordained and established that the above-described premises in the City of
Caldwell, Canyon, County, Idaho,upon vacation shall pass and revert to the private property
owner.

16, located in the SE '/a of Section 10, Township 3 North, Range 3 West, Boise Meridian, City of
Caldwell, Canyon County,Idaho, more particularly described as follows;
COMMENCING at the East '/a Corner of Section 10, also being the NE corner of said Kingsview
Estates Subdivision No. 1; thence South 89°50'25"West, 538.72 feet along the north line of the SE I/4

RE: Vacation of Public Utility Easement— 14096 Pearl Pointe Drive
Request by Bob Brady

Request: Vacation of Public Utility Easement- 14096 Pearl Pointe Drive
Waive three- reading requirement
Bob Brady requests to vacate a utility easement along the west side of the subject property from
the rear easement line extending to the south 26 feet and from the west property line extending to
the east 5 feet, more particularly described in attachments;
Public utilities were notified and have no objections to the easement vacation. The proposed
vacation does not create any landlocked parcels.
Attached for consideration of City Council is a proposed ordinance which, if approved, would
vacate the easement listed above in accordance with the applicant's request. The applicant would
like this request to be passed on the first reading.
The following exhibits are provided with this memo:

It is the recommendation of the Public Works Director that Council consider the proposed
vacation.
