HomeMy WebLinkAboutORD 3164 ORDINANCE NO. 3164 BILL No. 34 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL APPOINTING TWO NEW MEMBERS TO THE BOARD OF COMMISSIONERS OF THE URBAN RENEWAL AGENCY OF THE CITY OF CALDWELL, PURSUANT TO IDAHO CODE § 50-2006(b); PROVIDING FOR THE APPOINTMENT OF COMMISSIONERS TO FILL FUTURE VACANCIES AMONG THE BOARD OF COMMISSIONERS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. WHEREAS, on July 1, 2018, the terms of Caldwell City Council member Chris Allgood and of non-Caldwell City Council member Joe Ramirez,members of the Board of Commissioners of the Urban Renewal Agency of the City of Caldwell, expired,as set forth in Ordinance No. 3 10 1, approved and adopted on June 19, 2017, and made effective on July 1, 2017; and WHEREAS, with the advice and consent of council, the Mayor desires to re-appoint said former Commissioners as members of the Board of Commissioners of the Urban Renewal Agency of the City of Caldwell, for new three (3) year terms, each set to expire on July 1, 2021, or, in the case of City Council member Chris Allgood, upon such sooner date as he might cease to serve as a member of the Caldwell City Council. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. The following persons are hereby appointed as members of the six(6)member Board of Commissioners of the Urban Renewal Agency of the City of Caldwell, each of whom shall have full voting rights in all matters coming before the agency, and whose terms shall expire as indicated below: Name of Commissioner Expiration of Term (a) CHRIS ALLGOOD July 1, 2021 (Caldwell City Council member) or, upon the date he/she ceases to serve as a member of the Caldwell City Council, if sooner (b) JOE RAMIREZ July 1, 2021 The terms and service of the other currently serving members of the Board of Commissioners, to wit, Chairman Rob Hopper, Vice Chairman Jim Porter, Commissioner Chuck Stadick, and PAGE—I Commissioner Julie Warwick.,whose terrns have not yet expired, shall continue,unaffected by this ordinance. Section 2: Future vacancies among the six (6) member Board of Commissioners of the Urban Renewal Agency of the City of Caldwell may be filled by resolution of the City Council, said vacancies being filled by a candidate appointed by the mayor, with the advice and consent of council, as set forth in Idaho Code § 50-2006(b)(1). Section 3: This ordinance is enacted pursuant to the provisions of Idaho Code 50- 2006(b), Section 4. This ordinance shall be in 1'611 force and effect from and after its passage, approval, and publication, according to law. Section S. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 6. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OFCALDWELL, IDAHO, this 10"' day of July, 2018.
