HomeMy WebLinkAboutORD 3148BILL NO. 18 ORDINANCE NO. 3148 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CALDWELL CITY CHAPTER 9, ARTICLE 7, SECTIONS 09-07-07, 09-07-099 09-07-119 AND 09-07-13, OF THE CALDWELL CITY CODE, CONCERNING PARKING REGULATIONS, MUNICIPAL PARKING LOTS, AND PARKING RESTRICTIONS IN DOWNTOWN CALDWELL; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT HEREWITH. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 9, Article 7, Sections 09-07-07, 09-07-09, 09-07-11, and 09-07- 13, of the Caldwell City Code, dealing with municipal parking lots and certain parking restrictions in downtown Caldwell, shall be amended as follows: 09-07-07: MUNICIPAL PARKING LOTS: All municipal parking lots financed and operated by the city within the city limits shall be under the control of the Caldwell tfaffie conhmissioncity council. (3) pr-ivilege and upon payment of the applieable eharge, the &Y shall furnish a penuit iiidieafing the Y Ya o numben Said permit shall be displayed persenne The city may enter into a cross access easement with businesses or issue Parking permits on an as -needed basis. 09-07-09: ALL NIGHT PARKING PROHIBITED: It shall be unlawful for any person to park a vehicle or trailer within the business downtown district for a period of time longer than thirty (30) minutes between the hours of two o'clock (2:00) A.M. and five o'clock (5:00) A.M. of any day, except physicians on emergency calls. 09-07-11: RESTRICTED PARKING OF TRUCKS: No "truck" (defined by Idaho Code) shall be parked on any residential street or alley within the limits of the municipality, other than for the purpose of loading or unloading cargo, with the -- -'rt' n of rm able eamper- its .,ttaehea ., piekup BILL No. 18, ORDINANCE No. 3148 r"n"mw-.9an"awww rayl-w."w ............ .a!seltfn t sssen, s><s c t DOWNTOWN- (1) Limited: On -street Pparking in the downtown district will be limited to twe (2) three (3) hours between the hours of nine eight o'clock (98:00) A.M. and five o'clock (5:00) P.M., Monday through Saturday Friday. Vehicles must be moved at least one city block from the original parking space to avoid violation of this section. For purposes of this Article, Tthe "downtown areadistrict" will be defined as the area bordered on the north by the railroad tracks, on the south by Cleveland Boulevard, on the west by Fifth Street and on the east by T -en 12i11 Avenue, excepting municipal parking lots. (23) Fine Schedule: The fine schedule for the following parking violations in the city shall be charged in accordance with the rate schedule adopted by resolution of the city council: overtime parking; parking in a designated handicapped space; and other violations, i.e., parking without a permit. Section 2. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 3. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 4. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. IDAN BILL No. 18, ORDINANCE No.3148 ATTEST: Debbie Geyer, City ClerIQ ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3148 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CALDWELL CITY CHAPTER 9, ARTICLE 7, SECTIONS 09-07-07,09-07-09,09-07-11, AND 09-07-13, OF THE CALDWELL CITY CODE, CONCERNING PARKING REGULATIONS, MUNICIPAL PARKING LOTS, AND PARKING RESTRICTIONS IN DOWNTOWN CALDWELL; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT HEREWITH. Section 1: Includes amendments to the Caldwell Parking Regulations, located in Chapter 9, Article 7 of the Caldwell City Code, in Sections 09-07-07, 09-07-09, 09-07-11, and 09-07-13 by replacing the traffic commission with the city council as having control over municipal parking lots; removing a requirement to paint specific space numbers on municipal parking spaces; giving the city the authority to enter into a cross access easement or issue parking permits to businesses on an as -needed basis; removing language regulating truck campers; changing downtown on -street parking limits from two hours to three hours; establishing on - street weekday parking restrictions between 8:00 am and 5:00 pm; eliminating parking restrictions on Saturdays; extending the scope of area governed by these regulations to include the area between the railroad and Cleveland Boulevard and between 10" Avenue to 1211 Avenue (referred to as the "downtown district' for purposes of Article 11); and, eliminating low usage parking spaces from the city code. Sections 2 through 4: Providing that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; providing for severability; and, repealing conflicting ordinances, resolutions, and orders. Ordinance No. 3148 provides an effective date, which shall be when published in the Idaho Press Tribune on the 101 day of July, 2018. Ordinance No. 3148 was passed by the Council and approved by the Mayor on the 2nd day of July, 2018.
