BILL NO. 11 CITY OF CALDWELL
ORDINANCE NO. 3141
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-2 (MEDIUM-
DENSITY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF
IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-
215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No.
1451, approved Case No. ANN-18-01 (Wagon Wheel Sub Annexation) at a public hearing held June 4,
2018.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-2 (Medium Density
Residential):
Parcel K, according to that Record of Survey for Jane Flahiff recorded under Instrument No. 2014032917,
Canyon County Records, located in the SE 1/4 NE '/< and the NE 1/4 NE 'A of Section 30, Township 4
North, Range 2 West, Boise Meridian, Canyon County, Idaho, more particularly described as follows:
BEGINNING at the East 'A Corner of said Section 30, from which the Center '/ Corner of said Section 30
bears North 89°47'07" West, 2637.80 feet; thence North 89°47'07" West (formerly North 89°46'56" West),
1318.90 feet along the south line of said SE 'A NE 'A to the SW corner of said SE '/< NE 'A, said SW
corner being the SE corner of Delaware Park Subdivision No. 1 Unit No. 8 at the Colonies, recorded
under Instrument No. 2006100556, Canyon County Records; thence North 00°22'46" East, 1327.04
(formerly 1326.96)feet along the west line of said SE A NE '/, also being the east lines of said Delaware
Park Subdivision No. 1 Unit No. 8 and Delaware Park Subdivision No. 1 Unit No. 6 at the Colonies
recorded under Instrument No. 2004062537, Canyon County Records, to the NW corner of said SE 1/4 NE
'/; thence South 89°48'43" East, 102.01 feet along the north line of said SE '/ NE Ya to the SW corner of
that Quitclaim Deed recorded under Instrument No. 2009012621, Canyon County Records; thence North
00°11'23" East, 9.93 feet along the west line of said Quitclaim Deed; thence South 89°58'59" East, 557.76
feet along the north line of said Quitclaim Deed, to the NW corner of that Quitclaim Deed recorded under
Instrument No. 2009023470, Canyon County Records; thence South 89°57'24" East, 95.81 feet along the
north line of last said Quitclaim Deed; thence South 89°19'25" East, 45.70 feet continuing along last said
north line to the centerline of the Noble Drain; thence, departing from last said north line and along said
centerline of the Noble Drain as follows: South 42°53'13" East, 512.00 feet; thence South 40°37'30" East,
193.00 feet; thence South 83°23'50" East, 40.69 feet to the east line of said SE '/ NE 'A; thence leaving
said centerline of the Noble Drain South 00°24'12" West, 814.48 feet along said east line to the POINT
OF BEGINNING. Containing 37.22 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as R-2 (Medium Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of
this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner
plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed,
with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor,
Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax
Commission of the State of Idaho, all in compliance with Idaho Code 63-215.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3141
REGARDING ANNEXATION AND ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for annexation of a parcel of land to be annexed into the City of Caldwell
as R-2(Medium Density Residential) zoning.
Parcel K, according to that Record of Survey for Jane Flahiff recorded under Instrument No.
2014032917, Canyon County Records, located in the SE '/ NE '/ and the NE '4 NE '/ of Section
30, Township 4 North, Range 2 West, Boise Meridian, Canyon County, Idaho, more particularly
described as follows:
BEGINNING at the East '/4 Corner of said Section 30, from which the Center '/4 Corner of said
Section 30 bears North 89°47'07" West, 2637.80 feet; thence North 89°47'07" West (formerly
North 89°46'56"West), 1318.90 feet along the south line of said SE Y4 NE '/4 to the SW corner of
said SE '4 NE '/, said SW corner being the SE corner of Delaware Park Subdivision No. 1 Unit
No. 8 at the Colonies, recorded under Instrument No. 2006100556, Canyon County Records;

The Ordinance includes a provision to amend the official maps of the City by designating the
above-described property as R-2 and providing an effective date, which shall be when published
in the Idaho Press Tribune on the 12th day of June 2018. Ordinance No. 3141 was passed by the
Council and approved by the City Council President on the 4th day of June 2018. The full text of
the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The City
Council President and City Council approved the foregoing summary for publication pursuant to
Idaho Code 50-901A on the 4th day of June 2018.
