THE RELINQUISHMENT OF IRRIGATION EASEMENT BETWEEN PIONEER
IRRIGATION DISTRICT, THE CITY OF CALDWELL, URBAN RENEWAL AGENCY
OF THE CITY OF CALDWELL, COREY BARTON, RANDALL L. HICKMAN,
INDIVIDUALLY, AND RANDALL L. AND PATRICIA A. HICKMAN, HUSBAND AND
WIFE, FOR THE 400 LATERAL (A/K/A/ HORTON LATERAL) MADE A PART
HEREOF AND SET FORTH IN FULL.

RELINQUISHMENT OF IRRIGATION EASEMENT
TIIIS RELINQUISHMENT OF IRRIGA'I"ION EASEMEN'r is given in connection with
aM pursuant to that certain License Agreement ("Agreement") dated the 7 1h day of February,
20 8, between Pioneer Irrigation District ("Pioneer" or"District"), the City of Caldwell, Idaho,
the Urban Renewal Agency ofthe City of Caldwel I, Corey Barton, Randall L. Hickman,
individually, and Randall L. and Patricia A Hickman, husband and wife, said Agreement being,
retorded as Canyon County Instrument No. 2018-005609 on February 9, 2018.
WHEREAS, Pioneer owns, operates and maintains the irrigation facility known as the
400 Lateral (a/k/a Horton Lateral),together with a corresponding irrigation easement/right-of-
way for the same as part of its irrigation system, and
WHEREAS, the parties entered into the Agreement referenced above involving in part
the relocation/realignment/piping of the 400 Lateral, which Agreement also conveyed to the
District an easement for the relocated/realigned/piped section of the 400 Lateral;
NOW, THEREFORE, Pioneer Irrigation District hereby relinquishes, abandons, and
releases all right, title, estate and interest in and to that former section of the 400 Lateral depicted
and described in Exhibits A and B attached hereto and made a part hereof. Pioneer's
relinquishment, abandonment, and release extends and is limited solely to that former section, of
the 400 Lateral depicted and described in Exhibits A and B attached hereto.
IN WITNESS WHEREOF, the District has executed this RELINQUISHMENT OF
IRRIGATION EASEMENT this day of r , 20)

Legal description of the centerline of an abandoned portion of the 400 Lateral Canal located in the NE i/
SE 1/ of Section 25, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho, the
centerline of said abandoned canal being more particularly described as follows;
COMMENCING at the East '/a Corner of Section 25;
South 00°36'43" West a distance of 803,86 feet along the East boundary of said NE 1/SE 1/ of Section 25;
thence North 89'23'17"West a distance of 65.00 feet to a point on the centerline of the 400 Lateral Canal,
said point also being on the westerly edge of an easement referenced in the License Agreement For 400
Lateral Realignment — City of Caldwell (Pioneer Project No. 24-2017, said point being the POINT OF
BEGINNING; thence along the centerline of said abandoned canal as follows:
North 60°48'42"West a distance of 1215.12 feet to a point of curvature; thence
Northwesterly 107.69 feet along the are of a curve to the right having a central angle of f 2°42'58",a radius
of 485.23 feet, and a long chord bearing North 54°53'05" West a distance of 107.47 feet; thence
Northwesterly 97.87 feet along the arc of a curve to the right having a central angle of 50°58'36", a radius
of 110.00 feet, and a long chord bearing North 23°02'17" West a distance of 94.67 feet to a point of
