HomeMy WebLinkAboutORD 3131 BILL NO. 1 ORDINANCE NO. 3131 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE R-2 (MEDIUM DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON-18-01(Dover Place Subdivision Rezone) at a public hearing held, April 16th, 2018. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to R-2 (Medium Density Residential)zone: A parcel of land situated in the SE '/ NW 'A of Section 30, Township 4 North, Range 2 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, and being more particularly described as follows: BEGINNING at the Center'A Corner of Section 30, which bears S89°46'40"E, 2605.87 feet from the West '/ Corner; thence N89°46'40"W, 593.13 feet along the south line of the SE '/ NW 'A of said Section 30: thence N00°11'49"E, 1325.96 feet along the east boundary of Delaware Park Subdivision No.2 Unit No.1 at the Colonies (Book 37 of Plats at Page 13, records of Canyon County, Idaho), and the southerly extension thereof, to the north line of said SE 'A NW 'A; thence S89°4829"E, 597.22 feet along said north line of the SE 'A NW 'A to the CN 1/16 section corner; thence S00°22'26"W, 1326.29 feet along the east line of said SE 'A NW Y to the POINT OF BEGINNING. This parcel contains 18.12 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-2 (Medium Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. A parcel of land situated in the SE % NW % of Section 30, Township 4 North, Range 2 West, Boise Meridian,City of Caldwell, Canyon County, Idaho, and being more particularly described as follows: BEGINNING at the Center 1/4 Corner of Section 30, which bears S89°46'40"E,2605.87 feet from the West 1/4 Corner; thence N89°46'40"W, 593.13 feet along the south line of the SE 1/4 NW Y.of said Section 30: thence N00°11'49"E, 1325.96 feet along the east boundary of Delaware Park Subdivision No.2 Unit No.1 at the Colonies (Book 37 of Plats at Page 13, records of Canyon County, Idaho), and the southerly extension thereof, to the north line of said SE % NW 1/4; thence S89°48'29"E, 597.22 feet along said north line of the SE '/. The Ordinance includes a provision to amend the official maps of the City by designating the above- described property as R-2 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 24th day of April 2018. Ordinance No. 3131 was passed by the Council and approved by the Mayor on the 16th day of April 2018.
