HomeMy WebLinkAboutORD 3142 BILL NO. 12 ORDINANCE NO.3142 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING CHAPTER 4, ARTICLE 7, SECTION 4-7-7(10)(C.), OF THE CALDWELL CITY CODE, PERTAINING TO PRETREATMENT MEASURES THE PUBLIC WORKS DIRECTOR MAY REQUIRE OF A USER OF THE PUBLICLY OWNED TREATMENT WORKS ("POTW"); PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF,IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell,County of Canyon, State of Idaho: Section 1. That Chapter 4,Article 7, Section 4-7-7,at Subsection 4-7-7(10)(C.),of the Caldwell City Code, pertaining to pretreatment measures the Public Works Director may require of a user of the POTW,be amended as follows: (10) Additional Pretreatment Measures: The public works director may: C. Require that grease, oil, and sand interceptors be provided when it is necessary for the proper handling of wastewater containing excessive amounts of grease and oil, or sand; provided, however: - - . . . - - - - . • - . . - , the, ' er; 0 t 0 0; 1. Such interceptors shall not be required for a residential user; 2. Such interception units shall be of a type and capacity approved by the public works director and shall be so located to be easily accessible for cleaning and inspection; 3. Such interceptors shall be inspected, cleaned, and repaired regularly,for their reasonable operational efficiency by the user at the user's expense; PAGE—1 4. Such interceptors shall not be located within the public right- of-way, except within the City Center Zoning District (See Chapter 10, Article 12), in which such interceptors may be considered for location within the public right-of-way, on a case-by-case basis, if approved by the City Engineer. However, in such cases it shall remain the responsibility of the user to maintain and bear all costs associated with such interceptors. Section 2. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 1: Amends Chapter 4, Article 7, Section 4-7-7(10)(C.) of the Caldwell City Code, pertaining to pretreatment measures the Public Works Director may require of a user of the POTW,by clarifying existing requirements and by specifying that grease, oil and sand interceptors may not be located within the public right-of-way,except within the City Center Zoning District, in which such interceptors may be considered for location within the public right-of-way,on a case-by-case basis, if approved by the City Engineer. The amendment further underscores that the costs associated with such interceptors and their maintenance remain the responsibility of the user. Sections 2 through 4:Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3142 provides an effective date, which shall be on the 10th day of April, 2018. Ordinance No. 3142 was passed by the Council and approved by the Mayor on the 2nd day of April, 2018.
