ORDINANCE NO. 3094
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING
CHAPTER 4, ARTICLE 19, SECTION 4-19-15, OF THE CALDWELL CITY CODE,
PERTAINING TO THE ENFORCEMENT OF EROSION AND SEDIMENT CONTROL
REGULATIONS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR
SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS
AND PARTS THEREOF,IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell,County of Canyon,
State of Idaho:
Section 1. That Chapter 4, Article 19, Section 4-19-15, of the Caldwell City Code,
pertaining to the enforcement of erosion and sediment control regulations,be amended as follows:
04-19-15: ENFORCEMENT:
(1) Stop Work Orders; Revocation Of Permit: In the event that any person
undertakes activity regulated by this article without first procuring a valid, current
permit, or any person holding a site development permit pursuant to this article
violates the terms of the permit, constructs upon or improves a site in any manner
which fails to comply with local, state or federal standard stormwater management
and erosion and sediment control laws or regulations, or implements site
development in such a manner as to materially adversely affect the health,welfare,
or safety of persons residing or working in the neighborhood or development site
so as to be materially detrimental to the public welfare or injurious to property or
improvements in the neighborhood, the Caldwell public works department may
issue a stop work order and/or suspend or revoke the site development permit.
Section 2. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 3. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.

Section 4. All ordinances,resolutions,orders and parts thereof in conflict herewith are
repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO.3094
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING CHAPTER
4,ARTICLE 19,SECTION 4-19-15,OF THE CALDWELL CITY CODE,PERTAINING TO THE
ENFORCEMENT OF EROSION AND SEDIMENT CONTROL REGULATIONS; PROVIDING
AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT
HEREWITH.
Section 1: Amends Chapter 4, Article 19, Section 4-19-15 of the Caldwell City Code, relating to the
enforcement of erosion and sediment control regulations,so as to clarify that the Public Works Department
may issue a stop work order and/or suspend or revoke a site development permit for violations of local,
state or federal stormwater management and erosion and sediment control laws or regulations.
Sections 2 through 4:Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law; provides for severability; repeals conflicting ordinances,
resolutions,and orders.
Ordinance No. 3094 provides an effective date, which shall be April 10, 2018. Ordinance No. 3094 was
passed by the Council and approved by the Mayor on April 2, 2018. The full text of the Ordinance is
available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho 83605. The Mayor and City Council
approved the foregoing summary on the April 2,2018,for publication on April 10,2018,pursuant to Idaho
Code § 50-901A.
