HomeMy WebLinkAboutORD 3136 2018-005344 RECORDED 02/08/2018 10:32 AM IIIIII 111111 III 035057420 BILL NO.6 CHRIS YAMAMOTO CANYON COUNTY RECORDER ORDINANCE NO.3136 P9s'2 HCRETAL NO FEE ORDINANCE CALDWELL CITY OF AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL CHANGING THE SUFFIX OF THAT RIGHT-OF-WAY PLATTED AS "BULLFINCH" FROM "STREET" TO "COURT" AND CHANGING THE SUFFIX OF THAT RIGHT-OF-WAY PLATTED AS SHOREBIRD FROM "COURT" TO "PLACE"; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, Canyon County, State of Idaho: Section 1: That pursuant to the authority set forth in Idaho Code § 50-318 and in the Caldwell City Code at § 05-07-08(2), and upon the request of the Caldwell Mapping Department, the certain right-of-way platted as"Bullfinch Street"shall be changed to"Bullfinch Court"AND the certain right-of-way platted as"Shorebird Court"shall be changed to"Shorebird Place". Both rights-of-way are located in Peregrine Estates Subdivision No. 1, recorded in Canyon County, Idaho as Instrument No. 2018000777 in Book 46 of Plats at Page 38, and are being changed in order to comply with the preferences set forth in Caldwell City Code §05-07-04(3). Section 2: Since the platted lots that would utilize"Bullfinch"or"Shorebird"as their address are not yet developed,the effective date of this change shall be immediate upon publication of this ordinance. Section 3: This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction,the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4: All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed, rescinded and annulled. However, a further review of the preliminary plat indicates that this will actually become a cul-de-sac in a later phase. As such, Section 05-07-04(3) of the Caldwell City Code indicates that a "Court" is a street suffix designated for an "east-west cul-de-sac connecting to an avenue or way at one end only...". It is therefore proposed that the right-of- way hereinafter known as `Bullfinch"have its suffix changed to "Court". Also, the right-of-way labeled as "Shorebird" on the official plat for Peregrine Estates Subdivision No. 1 has the suffix of"Court". However, as indicated in Section 05-07-04(3) of the Caldwell City Code, a "Place" is a street suffix designated for an "north-south cul-de-sac connecting to an drive or street at one end only...". It is therefore proposed that the right-of-way hereinafter known as "Shorebird"have its suffix changed to"Place". Since all affected lots are currently vacant or under construction, the effective date of this change shall be upon publication of the attached ordinance.
