ORDINANCE NO.3127
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING
CHAPTER 12, ARTICLE 1, SECTION 12-1-1, OF THE CALDWELL CITY CODE,
PERTAINING TO THE CITY'S ADOPTION OF AND AMENDMENTS TO THE
INTERNATIONAL BUILDING, RESIDENTIAL, AND ENERGY CONSERVATION
CODES, IMPLEMENTING THOSE CHANGES REQUIRED BY STATE LAW;
PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF,
IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell,County of Canyon,
State of Idaho:
Section 1. That Chapter 12, Article 01, Sections 12-01-01 and 12-01-21, of the
Caldwell City Code, pertaining to the City's adoption of and amendments to the International
Building, Residential, and Energy Conservation Codes,be amended as follows:
12-01-01: CODE ADOPTION:
All the rules, regulations and ordinances of a general and permanent character
relating and applying to and regulating the erection, construction, enlargement,
alteration,repair,moving,removal,conversion,demolition,occupancy,equipment,
use,height, area of buildings or structures as said rules,regulations and ordinances
are printed and contained in code book form designated and entitled "20122015
international building code" with amendments (IBC) as published by the
International Code Council, as adopted by the state of Idaho or the Idaho building
code board,together with any amendments or revisions made by the Idaho building
code board through the negotiated rulemaking process; the "2012 international
residential code" parts I through VI and IX, including appendix G, with
amendments(IRC) as published by the International Code Council, as adopted by
the state of Idaho or the Idaho building code board,together with any amendments
or revisions made by the Idaho building code board through the negotiated
rulemaking process; and the "20122015 international energy conservation code"
with amendments (IECC) as published by the International Code Council, as
adopted by the state of Idaho or the Idaho building code board, together with any
amendments or revisions made by the Idaho building code board through the
negotiated rulemaking process; be and the same hereby ratified and adopted as the
building code and energy code of Caldwell city and as ratified and adopted shall be
the rules and regulations and ordinances governing the erection, construction,
enlargement, alteration, repair, moving, removal, conversion, demolition,

occupancy,equipment,height,and area of buildings or structures within the city of
Caldwell.
12-01-21: AMENDMENTS TO THE INTERNATIONAL BUILDING CODE,
INTERNATIONAL RESIDENTIAL CODE, AND INTERNATIONAL
ENERGY CONSERVATION CODE:

IBC section 1 0101.4.3, "Plumbing" is deleted and repealed in its entirety.
IBC section 101.4.5101.4.4, "Property Maintenance" is deleted and repealed
along with all references to the international property maintenance code throughout
the IBC and IRC.
Section 2. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 3. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.

Section 4. All ordinances,resolutions, orders and parts thereof in conflict herewith
are repealed.

ORDINANCE NO.3127
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL,AMENDING CHAPTER
12,ARTICLE 1, SECTION 12-1-1, OF THE CALDWELL CITY CODE, PERTAINING TO THE
CITY'S ADOPTION OF AND AMENDMENTS TO THE INTERNATIONAL BUILDING,
RESIDENTIAL, AND ENERGY CONSERVATION CODES, IMPLEMENTING THOSE
CHANGES REQUIRED BY STATE LAW; PROVIDING AN EFFECTIVE DATE; PROVIDING
FOR SEVERABILITY;AND REPEALING ALL ORDINANCES,RESOLUTIONS,ORDERS AND
PARTS THEREOF,IN CONFLICT HEREWITH.
Section 1: Amends Chapter 12, Article 01, Sections 12-01-01 and 12-01-21, by adoption of the 2015
editions of the International Building Code and International Energy Conservation Code, as required by
Idaho state law, by correcting certain code references affected by the adoption of new editions of these
codes,and by removing reference to a city-adopted amendment to a prior edition that is no longer necessary.
Sections 2 through 4:Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law; provides for severability; repeals conflicting ordinances,
resolutions, and orders.
Ordinance No. 3127 provides an effective date, which shall be on the 26th day of December, 2017.
Ordinance No. 3127 was passed by the Council and approved by the Mayor on the 18th day of December,
2017. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street,Caldwell, Idaho
83605.The Mayor and City Council approved the foregoing summary on the 18th day of December,2017,
for publication on the 26th day of December,2017,pursuant to Idaho Code § 50-901 A.
