CITY COUNCIL WORKSHOP TO DISCUSS AMENDMENTS TO CALDWELL CITY CODE SECTION 02-17-10: CALDWELL HISTORIC PRESERVATION COMMISSION APPLICATION REQUIREMENTS FOR CERTIFICATE OF APPROPRIATENESS. The Mayor called the workshop to order at 6:30 p.m. Present: Callsen,Pollard, Stadick,Allgood,Ozuna,and Hopper. Brian Billingsley, 621 Cleveland Blvd.,reported the purpose of the Certificate of Appropriateness issued by the Caldwell Historic Preservation Commission for residences located within the Steunenberg Historic District. He outlined proposed changes to the City Code regarding the notification process and issuance of Certificates of Appropriateness. In response to questions from Councilman Hopper,Mr.Billingsley reported that all administrative decisions are reported at the next publicly noticed Caldwell Historic Preservation Commission meeting. Discussion followed concerning the current notification and permitting process. The workshop adjourned at 6:43 p.m. REGULAR MEETING MINUTES December 4,2017 7:00 P.M. Mayor Nancolas opened the meeting at 7:00 p.m. and welcomed those in attendance. He reported that there was a workshop held at 6:30 p.m. regarding proposed amendments to the City Code about the Certificate of Appropriateness issued by the Caldwell Historic Preservation Commission. No decisions were made or action taken. Pastor Jim Porter of the Caldwell Free Methodist Church offered the invocation. The Mayor led the audience in the Pledge of Allegiance to the Flag. The City Clerk called the roll of the City Council with the following members present: Callsen, Pollard, Stadick,Allgood,Ozuna,and Hopper. CONFLICT OF INTEREST DECLARATION None. SPECIAL PRESENTATIONS A. Update report from the Caldwell Historic Preservation Commission. Steve Maughn, Chairman, of the Caldwell Historic Preservation Commission provided a report concerning the history of the Historic Preservation Commission since its inception in the 1970's. He outlined the accomplishments of the commission including professional historical surveys conducted on commercial and residential structures. Such surveys are available for public review at the Caldwell Public Library and the Planning & Zoning Department. He outlined the process followed to formulate the Steunenberg Historic District and the guidelines currently followed to maintain that historic district. Current projects: Tours of the historical district (brochures and phone app created), issuance of Certificates of Appropriateness for residents within the historic district, and training of commission members regarding local historical structures. B. Update report from LoveCaldwell Regarding the Compassion Caldwell Event Pastor Jim Porter reported on the 4'Annual Compassion Caldwell event which was held on September 23,2017. He reported that there were approximately 300 volunteers along with the participation of 31 churches. The Idaho Food Bank distributed over 150 boxes of food at the event. He expressed appreciation to the many agencies and organizations involved with the outreach, especially West Valley Medical Center. C. High School Government Students The Mayor acknowledged Cheryl Adams,Caldwell High School American Government teacher. She asked the 30 students in attendance to stand and introduce themselves. The Mayor also recognized two students in attendance from Meridian High School. BOOK 58 PAGE 159 D. Amy Perry, Owner ofRuhaiyat Book Store at 720 Arthur Street: Ms. Perry addressed the Council about her concern with the lack of support by the community for downtown small businesses. She encouraged the citizens of Caldwell to shop local. ADDITIONS OR DELETIONS TO THE AGENDA None. AUDIENCE PARTICIPATION None. CONSENT CALENDAR: 1. Approve acceptance of the minutes of the Regularly Scheduled City Council Meeting held on November 20,2017 and the Caldwell Youth Forum Sub-Committee Meetings held on July 18,2017 and September 26,2017; 2. Approve request for the transfer of the Alcohol Beverage License (beer and wine) to Grocery Outlet of Caldwell(Muniz Family Grocers,Inc.)located at 4907 Cleveland Boulevard; 3. Approve Resolution No. 274-17 authorizing the execution of a Professional Services Agreement with TAG Historical Research and Consulting, d/b/a/ of The Arrowrock Group, Inc. for historical mitigation of the Sundowner Motel Demolition site located at 1002 Arthur Street in the amount of $6,650; 4. Approve Resolution No. 275-17 ratifying the purchase of Monroe full fold hitches for snow plow mounting in the amount of$13,750.00 to be used by the Street Department; 5. Approve Resolution No. 276-17 authorizing the execution of the Grant Application for Federal Assistance for AIP Project 3-16-0045-303-2018 with the Federal Aviation Administration to rehabilitate Runway 12-30 at the Caldwell Industrial Airport; 6. Approve Resolution No. 277-17 authorizing the execution of a Funding Agreement with the Canyon County Sheriff's Department, Nampa Police Department, Nampa Family Justice Center, St. Alphonsus Medical Center, St. Luke's Medical Center, and West Valley Medical Center for the purpose of ending family violence and sexual assault; 7. Approve Resolution No. 278-17 accepting an Easement from East Chicago, LLC for public ingress/egress and utilities across a portion of their property to provide water and sewer service for the East Chicago Street Business Park; 8. Approve Resolution No. 279-17 authorizing the execution of a Work Order and Agreement with Hughes Engineering for bridge and culvert inspection services in the amount of$12,250; 9. Approve Resolution No. 280-17 accepting an Easement from Bennett Forest Industries, Inc. for sanitary sewer lines outside the platted area for Cumberland Subdivision No.4; 10. Approve Resolution No. 281-17 accepting dedication of water main lines from James Connelly and Robert Cooper as part of the Cooper's American Service Project. THE SUBJECT PROPERTY IS LOCATED AT 3504 COLLEGE AVENUE [PARCEL#R3573700000]IN CALDWELL,IDAHO) The Mayor outlined the quasi-judicial process and asked the City Clerk to swear in those who would be providing public testimony at the first two public hearings listed under New Business. BOOK 58 PAGE 160 Jarom Wagoner, 621 Cleveland Blvd., acknowledged being sworn in and outlined the contents of the written staff report. He noted that no construction plans were submitted with the request. He reported that staff recommends approval of the request. In response to questions from Councilman Allgood, Mr. Wagoner stated that there is a residence and out- buildings on the site. The parcel could be subdivided in the future to allow additional residences. Brad Dugan,603 W. Criterion,Meridian, acknowledged being sworn in and spoke in favor of the request. THE SUBJECT PROPERTY IS LOCATED AT 4402 E.HOMEDALE ROAD [PARCEL#R3279301000]IN CALDWELL,IDAHO) Jarom Wagoner, 621 Cleveland, acknowledged being sworn in and outlined the contents of the staff report. He reported that there currently is a residence on the site and single-family residential parcels are in the surrounding area. The request is in agreement with the comprehensive plan. He reported that staff recommends approval with the conditions as outlined in the staff report to include the dedication of right- of-way along Homedale Road. Mr. Wagoner continued by stating there was an understanding that the developer of the subdivision surrounding the property (Windsor Creek East) inasmuch as they are to complete the frontage improvements for this out parcel. The City Engineer has discussed this matter with the developer. The Dodson are not responsible for those improvements. In response to questions from Mayor Nancolas,Mr.Wagoner stated that this is a voluntary annexation. Merrilee Dodson, 4402 E. Homedale Road, acknowledged being sworn in and spoke in favor of the request. She noted that the applicant,Josh Dodson, is interested in connecting with City water and sewer. BOOK 58 PAGE 161 She asked if the rod-iron fence would be relocated or replaced in connection with the frontage dedication requirement. Robb MacDonald, 621 Cleveland,reported that the responsibilities of the Windsor View East Subdivision includes improving the frontage along the site to include relocating the fence,if needed. In response to questions from Councilman Stadick,Mr. MacDonald clarified that the fencing matter would be at the expense of developers. In response to questions from Mrs. Dodson, Mr. MacDonald clarified that frontage improvements include street widening, curb, gutter, sidewalk, streetlights and anything associated with those improvements. It would also include the fence if it needs to be pushed back or moved. These items would be the developer's responsibility. Councilman Hopper recommended that the developer's contact information be provided to Mr. & Mrs. Dodson by the City Engineer. ANN-17-04 & SUB-17P-04: A REQUEST BY TIM MOKWA AND HAYDEN HOMES TO ANNEX 39.8 ACRES, MORE OR LESS, WITH AN R-3 [HIGH DENSITY RESIDENTIAL] ZONING DESIGNATION, A COMPREHENSIVE PLAN MAP CHANGE FROM MEDIUM DENSITY RESIDENTIAL TO HIGH DENSITY RESIDENTIAL, A DEVELOPMENT AGREEMENT, AND FOR PRELIMINARY PLAT APPROVAL OF VOYAGE NORTH SUBDIVISION CONSISTING OF 39.8 ACRES, MORE OR LESS, TO BE SUBDIVIDED INTO 160 RESIDENTIAL LOTS AND 22 COMMON LOTS. THE SUBJECT PROPERTY IS LOCATED AT THE SOUTHEAST CORNER OF AVIATION WAY AND MARBLE FRONT ROAD IN CALDWELL,IDAHO) The City Clerk swore in those providing public testimony Jarom Wagoner, 621 Cleveland Blvd, acknowledged being sworn in and outlined the contents of the staff report. He noted that the Comprehensive Plan Map designated the parcel as Medium Density Residential. The parcel to the north is designated as low density residential and parcels located to the south, east, and west of the site are designated as medium density residential. Staff is recommending that if approval is given for high density residential, a condition would be included within the development agreement allowing only R-1 (Low Density Residential)uses on the site. The R-3 designation allows for smaller lot sizes. Mr.Wagoner noted that the application also includes lots larger than 7,000 sq.ft. Questions were asked by Mayor Nancolas concerning planning aspects concerning the allowance of an R-3 zone when the surrounding parcels are designated as low and medium density. Mr. Wagoner stated that the Planning&Zoning Director has the authority in accordance with the Caldwell City Code to declare administrative variations regarding lot sizes and setbacks. An administrative determination up to a twenty(20%)reduction is allowed by the Planning&Zoning Director. Mr. Wagoner addressed concerns from Councilman Allgood and Councilman Callsen regarding the R-3 zoning designation. Tim Mokwa of Hayden Homes Idaho at 1406 N, Main Street, Suite 109, Meridian, acknowledged being sworn in and spoke in favor of the request. He provided a PowerPoint of the proposed development. He stated that the developer concurs with the staff report. He reported that an e-mail had been received from April Long expressing concern with the development. Mr. Mokwa addressed Ms. Long's concerns about the high density designation, traffic issues, water rights for irrigation on her property, and access to her property. The Mayor labeled the PowerPoint as CC-1001. Councilman Stadick inquired as to the price range of the homes, the type of agricultural crops within the surrounding area,and if any multi-family homes are planned within the development. Mr. Mokwa reported that the price range would be approximately $170,000 to $220,000. No multi-family units would be constructed. It was noted that onions,beats and beans are being grown on surrounding farm land. Councilman Stadick expressed concern regarding restrictions placed on crop dusting for the farmers. . In response to comments from Councilman Hopper, Mr. Mokwa reported that the R-3 designation has economic value for the development relating to land acquisition and design. Councilman Hopper expressed concern about the type of future development of surrounding properties if the R-3 designation is approved. Mr. Wagoner provided information on the lot sizes within the Montecito Subdivision located near the proposed development. The Mayor called a short recess to allow students to exit the meeting at 8:42 p.m. The meeting reconvened at 8:47 p.m. BOOK 58 PAGE 163 John Carpenter of T-O Engineer at 332 N. Broadmore, Nampa, acknowledged being sworn and spoke in favor of the request. He noted that the lots in the proposed development are larger than those within the Montecito Park Subdivision. Each corner lot will have a common lot designation to allow attractive landscaping within the development. He noted that no aerial spraying is being conducted in conjunction with surrounding farmlands. The Mayor labeled the e-mail from Curtis and April Long as CC-1002. April Long,4112 Marble Front Road, acknowledged being sworn in and spoke in opposition to the request. She expressed concern regarding the infrastructure, the request for R-3 designation, traffic issues with additional residents in the area, and the possibility of multi-family units being developed with the surrounding area in the future. Curtis Long,4112 Marble Front Road,signed in opposition to the request but did not provide testimony. Jack Erdmann, 322 Voyage Avenue, acknowledged being sworn in and spoke in opposition to the request. He expressed his concern with current drainage issues on his parcel and additional problems with the expansion of residences. He also reported that continuous vehicle speeding transpires in the area. There is a need for traffic control. Harold Robertson, 404 Voyage Avenue, acknowledged being sworn in and spoke in opposition to the request. He expressed concern regarding drainage issues on existing residential parcels and traffic control. The Mayor stated that the traffic concerns would be made known to the Caldwell Police Department. Donna Goff, 5022 Lasher Lane, acknowledged being sworn in and spoke in opposition to the request. She expressed concern about the incapability of the development with the surrounding area and traffic issues due to the growth. She asked about the results of the traffic study. She noted that Hwy, 20-26 is being used as an alternate mode to Boise when the freeway has been shut down. She reported on the safety concerns with the roadway configuration of Marble Front Road at the curve traveling up Marble Front to Canyon Hill. Dverse crops are raised on their farmland and there is a need to conduct aerial spraying. Ms. Goff concluded that she would like to see larger lot developments within the City Limits. Councilman Hopper provided information regarding the traffic study. Ryan Goff, 3423 Marble Front, acknowledged being sworn in and spoke in opposition to the request. He expressed concern regarding traffic issues and how the change of zoning will impact the area in the future. Roger Goff, 5022 Lasher Lane, acknowledged being sworn in and spoke in opposition to the request. He expressed concern with the immense amount of affordable housing within Caldwell. He would like to see larger lots and higher quality homes. He spoke about traffic issues within the area and reported that Hwy. 20/26 is not easily accessible. The Caldwell Schools are becoming overcrowded due to the growth and continue to issue bonds. In response to questions from Councilman Stadick, Mr. Goff reported that there is sidewalk in the area located along the frontage at Van Buren School and the subdivision cross the street from the school. In rebuttal,Mr.Mokwa addressed the following items: • Speeding issues on Marble Front Road&Aviation Way is a Caldwell Police Department enforcement matter. • Aviation Road is a minor arterial and therefore designated to carry traffic. • He will speak with development staff regarding Mr.Erdmann's irrigation drainage issues. • The extension of Aviation Way will relieve traffic issues along KCID Road. Mr. Mokwa concluded that he would prefer the R-3 zoning designation, but would rather see the R-2 zoning designation move forward rather than the total application denied. He noted that the R-2 and R-3 layouts were provided in the PowerPoint presentation for the purpose of layout comparison. In rebuttal,John Carpenter of T-O Engineers reviewed the contents of the traffic study. • The expansion of Aviation Way will relieve traffic issues on Hwy 20-26. He noted that improvements made to Hwy.20-26 over the years have benefited the City of Caldwell. • The traffic study was conducted in 2017. The City of Caldwell contracted with the consultant so it is not a biased study. Hayden Homes reimbursed the City of Caldwell for the expense of the traffic study. The consultant took current traffic counts of various locations and completed the study. • Corridors included within the study are Aviation Way, Marble Front, and KCID Road. Mr. Carpenter outlined the contents of the Traffic Study Executive Summary. Mr. Carpenter concluded that grading plans would be submitted by T-O Engineers on all improvement projects for Hayden Homes to assist with drainage issues. Council Callsen addressed comments made about subdivision development applications brought before City Council for approval. In response to questions from Councilman Allgood regarding the possibility of setting a precedence with the approval of the R-3 zone, Mr. Seable stated that City Council has the authority to grant the request, zone the property as R-3 and effectively apply limitations that usually pertain to an R-2 zone through the BOOK 58 PAGE 164 use of the development agreement,. He noted that in the future, other developers could see the map designation without researching county records for a development agreement outlining the limitations. In response to questions from Councilman Hopper, Mr. Seable reported that pursuant to Idaho Code Section 67-6509(B) and the Caldwell City Code Section 10-03-03(5), there is provision that a published notice must be available to the citizens prior to City Council's consideration of a material change from the recommendation made by the Planning & Zoning Commission. The matter does not need to return to the Planning & Zoning Commission. The hearing may be continued to a date and time certain to allow for such notification. Discussion followed. MOVED by Callsen, SECONDED by Pollard to continue the hearing to the Regularly Scheduled City Council Meeting to be held on Tuesday, January 16, 2018 at 7:00 p.m. to allow City staff to re-notice the public hearing for an R-2 zoning designation. MOTION CARRIED (COUNCIL COMMENTS) Council Members Pollard&Allgood reported on the success of the Night Light Parade. Council Member Ozuna expressed appreciation to the organizers of the Compassion Caldwell event regarding their caring approach for members of the community. Council Member Stadick remarked on the media coverage of the Winter Wonderland tunnel exhibit viewed on ESPN in conjunction with the recent Boise State University game. Council Member Pollard expressed appreciation to Angie Point for the many posts on social media regarding City of Caldwell news and events. (MAYOR'S COMMENTS) The Mayor reported on the large number of spectators viewing the lights. He expressed appreciation to the Street Department crew for their creativity in building the incredible lighting displays each year. The Mayor thanked Theresa Hardin and volunteers from the Caldwell Chamber of Commerce for the outstanding Night Light Parade. The Mayor reported that Fiberguide Industries is celebrating 40 years of doing business in Caldwell. They have expanded their facility three times over the years and they are now ready to expand again. The Mayor stated that he recently met with Greg Hill of Boise State University— School of Public Service has completed their Second Annual Treasure Valley Survey. BSU is ready to assist municipalities with data and information research. He expressed appreciation for the partnership with BSU. The Mayor reported on the recent City of Caldwell Press Release regarding Caldwell ranking #13 as Idaho's Safest City. A press release was sent to the media regarding this recognition. Calendar Events: • December 18,2017: Next City Council Workshop and Regularly Scheduled Meeting.
