The utilities, including PIRR, are not associated with this easement but are provided for in easements specific for their use. The VP8 PIRR easement overlaps the public utility easement by 5 feet from the north, and approximately 2 feet from the east. In Summary, the easement we are looking to vacate is not associated with and should not affect functionality of the utilities in the area. However it does encroach into the building pad of the Virginia Park Phase 9 plat. Please see attached exhibits. Public utilities were notified and have no objections to the easement vacation. The proposed vacation does not create any landlocked parcels. Attached for consideration of City Council is a proposed ordinance which, if approved, would vacate the easement listed above in accordance with the applicant's request. The applicant would like this request to be passed on the first reading. The following exhibit is provided with this memo: 1. Exhibit"A"Legal Description of Vacation and site map It is the recommendation of the Public Works Director that Council consider the proposed vacation.
