The invocation was offered by Pastor Cole Crownover from the Centennial Baptist Church. The Mayor led the audience in the Pledge of Allegiance to the Flag. The City Clerk called the roll of the City Council with the following members present: Callsen, Pollard, Stadick, Ozuna,and Hopper.Absent: Allgood. CONFLICT OF INTEREST DECLARATION None. SPECIAL PRESENTATIONS 1) Proclamation: Community Volunteerism and Service Mayor Nancolas read the proclamation into the record: Whereas, Caldwell, ID, is a community which acknowledges that a special vibrancy exists within the entire community when its individual citizens collectively go the extra mile" in personal effort, volunteerism, and service;and Whereas, Caldwell, ID is a community which encourages its citizens to maximize their personal contribution to the community by giving of themselves wholeheartedly and with total effort, commitment, and conviction to their individual ambitions,family,friends, and community;and Whereas, Caldwell, ID is a community which chooses to shine a light on and celebrate individuals and organizations within its community who go the extra mile" in order to make a difference and lift up fellow members of their community;and Whereas, Caldwell, ID, acknowledges the mission of Extra Mile America to create 575 Extra Mile cities in America and is proud to support "Extra Mile Day"on November 1, 2017. NOW THEREFORE, I, Garret L. Nancolas, Mayor of the City of Caldwell, ID, do hereby proclaim November 1, 2017, to be Extra Mile Day in the City of Caldwell and urge each individual in the community to take time on this day to not only go the extra mile" in his or her own life, but to also acknowledge all those who are inspirational in their efforts and commitment to make their organizations,families, community, country, or world a better place. 2) Proclamation: Breast Cancer Awareness Month Councilwoman Ozuna addressed those in attendance regarding the importance of participating in regular breast cancer screenings. She noted that she was diagnosed this year for breast cancer and has undergone surgery. Mayor Nancolas read the proclamation into the record: Whereas, every year, too many Americans are touched by the pain and hardship caused by breast cancer- a disease that, among women, is not only one of the most common cancers, but also one of the leading causes of cancer-related death; and Whereas, during National Breast Cancer Awareness Month, we honor all those who lost their lives to breast cancer, and we recognize the courageous survivors who are still fighting it; and Whereas,for these individuals, and for their loved ones who give their unwavering support during the most trying times, we recommit ourselves to the essential and necessary work of forging a future free from cancer in all its forms; and Whereas, hundreds of thousands ofAmericans will be diagnosed with breast cancer this year, and tens of thousands will lose their battle with this disease; and Whereas, critical research efforts over time have yielded great progress in how we diagnose and treat breast cancer, which has produced a steady increase in survival rates for those suffering from this disease and it is crucial that we keep building on these successes; and Whereas, this month, with pink ribbons displayed proudly across America, we stand in solidarity with breast cancer survivors and rearm our commitment to raising awareness of this disease and to advancing research efforts. NOW, THEREFORE, I, Mayor Garret L. Nancolas, Mayor of the City of Caldwell, Idaho, do hereby proclaim October 2017 as National Breast Cancer Awareness Month and encourage citizens, BOOK 58 PAGE 141 government agencies, private businesses, nonprofit organizations and other interested groups to increase awareness of how Americans can fight breast cancer. 3) Update Report: Mayor's Youth Advisory Council Breanne Boutte, Chair, provided information about the upcoming `Dinner Above the Lights" fundraiser event to be held in association with Winter Wonderland on November 17,2017. She noted that the event is being planned by Treasure Valley Community College but the Mayor's Youth Advisory Council has been selected as one of the recipients along with the Caldwell High School Youth Court. Tickets are available at TVCC. Genaro Huitron, Treasurer, provided copies of the Mayor's Youth Advisory Council budget for FY- 2017-18 and outlined the contents. Madison Smith, Secretary, reported on the annual fundraiser dinner, which will be held in February. This event is planned entirely by the MYAC members and all proceeds from the event are used to send students to the National League of City Conference in Washington, D.C. Tickets will be available through the MYAC members. Table sponsorships are encouraged. Alisha Castro, Historian, reported on the upcoming DARE Halloween Party held at O'Connor Event Center on October 31". The MVAC members plan and operate the "Spooky Spot" at the DARE Halloween Party. Volunteers are needed at the DARE Halloween Party. Ms. Boutte concluded by stating that MYAC members have been selected to fill sub-committees for the various events and activities and liaison positions on City-appointed boards and committees. Ideas for additional activities are being considered including a letter writing campaign for veterans and senior citizens. The Mayor expressed his appreciation for the MYAC Executive Committee for providing the update report. ADDITIONS OR DELETIONS TO THE AGENDA MOVED by Callsen, SECONDED by Stadick to amend the agenda by adding the following items: Consent Calendar Add Item#25 to read: "Resolution authorizing the trustees of the Caldwell Employee Benefit Plan Trust to execute the Financial Contract between the Caldwell Employee Benefit Trust Plan and Eide Bailly LLP for the financial audit of October], 2016 through September 30, 2017." Reason: This item was not available until after the agenda was posted. Consent Calendar Remove Item#18: Requested by the City Engineer that this item removed from the agenda. Executive Session Add under New Business to read: "Executive Session pursuant to Idaho Code, Section 74-206, Section (j)for the purpose of considering labor contract matters authorized under section 67-2345A[74-206A](a) and(b) ." MOTION CARRIED AUDIENCE PARTICIPATION Gladys Chase, 2708 Golden Rod Lane, reported that she recently noted that she recently attended a bid opening conducted at the Engineering Department regarding L.B.LD. 17-2 Building Facade Improvements. She provided a report on the process which she observed at the bid opening. She noted the following concerns: 1) One contractor in attendance did not submit a bid due to his limited computer access. He stated in opposition to paying$10 to see the bid documentation. 2) The legal notice indicated that T.J. Frans was the Project Manager; however, when confronted, Mr. Frans indicated that he did not serve in that capacity. 3) Information about the budget for the project was reportedly disclosed to the bidding contractor prior to the opening. 4) Loopholes within the contract allow the contractor to increase the price as necessary. As requested by Mayor Nancolas,Public Works Director Brent Orton provided information concerning the process of the referenced bid opening. All of the City of Caldwell bid proposals are posted on a service called Quest CDN and thereby give contractors access to the plans at their convenience. Mr. Orton stated that Mr. Dice came to his office requesting assistance and a Quest CDN account was set up for him. The documents were downloaded and emailed to his son,Dion Dice,the day the account was established. Two days before the bid opening,Dion called the Public Works Department and was concerned if he was able to retrieve all of the addendums. The Engineering Department administrative secretary downloaded all of the addendums and emailed them to him that day. Darrell Dice chose not to bid on the project;however,he is now registered with Quest CDN and is able to acquire the plans for future projects. BOOK 58 PAGE 142 Mayor Nancolas asked if there is any possibility that those bidding on a project would have knowledge of the bid estimate prior to the bid opening. Mr. Orton confirmed that the bid estimate is not disclosed prior to the bid. The only estimate that existed for this project was calculated by McAlvain Construction for a number of the buildings. Some of the buildings that are now interested in participating in the L.B.LD. were not originally included within the estimates as formulated by McAlvain Construction. Mr. Orton stated that to his knowledge, that information was not shared and it was not part of the bid package. The Mayor emphasized that bid estimates are drafted for budgetary purposes at the beginning of each year; however, the bidding process is still a closed procedure. Contractors do not know what others are bidding since all bids are submitted in sealed envelopes. Ms. Chase noted that the newspaper notice included wording that the project would be funded entirely with City dollars. Mr. Orton explained that local business improvement districts are addressed within Idaho State Code, which allows work to be done outside of the public right-of-way on building facades. He explained that the project would initially be funded by the City but business owners who sign the petition have signed in awareness that they are responsible to pay the amount back over a period of ten years to the City of Caldwell. Ms. Chase expressed her concern that the newspaper legal notice indicated that the project would be funded solely from City dollars. Mr. Orton emphasized that the work will be financed by the City of Caldwell. There are no other funding sources associated with this project. He explained that the Community Development Block Grant funding is available for signage for business owners under a separate program and therefore is not part of the L.B.LD.program. Ms. Chase recommended that the City Attorney provide appropriate wording for future legal notices that accurately explain the funding source and the appropriate staff member as the project manager. Comments: Ted Brumet: Ted Brumet, 622 Linden Street,reported that in February 2017 an article indicated that a third fire station would be constructed once the property was identified. He inquired as to the status of the property and the anticipated date for construction of Fire Station 43. Mayor Nancolas reported that City Council has been involved with the Fire Station 43 Project. The location has been identified and staff is working with the property owner regarding infrastructure matters for the site. The new station would be funded within the current budget year and is expected to be constructed within this year's budget cycle. Robb MacDonald reported that negotiations are underway with the property owners where the proposed subdivision and fire station would be developed. Infrastructure needs to be extended to the parcel including a sewer trunk line. The Mayor reported that the site is part of a proposed subdivision development in which the developer has graciously offered to donate a portion of the property to the City of Caldwell for Fire Station No. 3. It is anticipated that construction would transpire in the spring of 2018. In response to questions from Councilman Stadick, Mr. Orton indicated Maximum Price Amendment 44 was the final budgetary portion for the Indian Creek Plaza Project and was approved by resolution. The contractor is bound to the final approved budget provision under the "Construction Manager-At-Risk Contract," noting that the construction manager is "at risk" to deliver the project within the guaranteed maximum price. The Mayor clarified that the Indian Creek Plaza contracts were approved by City Council and all contracts are reviewed and approved by the City Attorney prior to their consideration by City Council. There are no loopholes in the process. All reviews are conducted to meet compliance standards as outlined within Idaho State Code. Councilman Callsen asked about the outcome of the City Council vote regarding the Indian Creek Plaza Project. Mayor Nancolas reported that it was a unanimous decision with a vote of six(6)to zero(0). CONSENT CALENDAR: 1. Approve acceptance of the minutes of the Regularly Scheduled City Council Meeting held on October 2, 2017; the Caldwell Senior Center Board Meeting held on October 11, 2017; and the Caldwell Industrial Airport Meeting held on October 5,2017; 2. Approve Resolution No. 230-17 authorizing the purchase of a 2018 Chevrolet 2500 HD 4WD Silverado/Double Cab Pickup from Kendall Chevrolet for the O'Connor Field House and Event Center pursuant to the approved FY-2018 budget in the amount of$32,217.80; 15. NEW BUSINESS BOOK 58 PAGE 144 (CONSIDER RESOLUTION NO. 220-17 AUTHORIZING THAT CERTAIN REAL PROPERTY KNOWN AS 120 NORTH 21ST AVENUE BE DECLARED AS SURPLUS PROPERTY AND SET THE PUBLIC AUCTION DATE FOR MONDAY, NOVEMBER 6, 2017 AT THE REGULARLY SCHEDULED CITY COUNCIL MEETING TO BE HELD AT 7:00 P.M.) Aaron Seable, 1303 1211 Avenue Road, Nampa, stated that he had prepared the resolution for City Council's consideration. The Mayor noted that the property owner who originally purchased the declared surplus parcel along 215` Avenue had recently asked for an opportunity to purchase additional land to accommodate his business. The process includes a public auction where all bids will be considered by City Council. The set price is $3.00 per square foot as outlined within the resolution. ZON-17-06: A REQUEST BY THE CITY OF CALDWELL AND DANA VANCE TO REZONE TWO PARCELS TOTALING 9.1 ACRES, MORE OR LESS,FROM M-1(LIGHT INDUSTRIAL) TO C-3(SERVICE COMMERCIAL). THE SUBJECT PROPERTIES ARE LOCATED AT 120 AND 124 N. 21ST AVENUE IN CALDWELL, IDAHO) The Mayor provided an explanation of the public hearing quasi-judicial process and asked the City Clerk to swear in those who would be providing public testimony. He declared the public hearing open. Jarom Wagoner, 621Cleveland Blvd., acknowledged being sworn in. He provided the staff report and outlined the facts as written. He noted that the properties in proximity to the subject parcel are designated as commercial on the Comprehensive Plan Map. The sole access to the site is along 2111 Avenue,which is a principle arterial roadway. The subject property is currently zoned as M-1 (Light Industrial) with surrounding properties zoned C-3 (Service Commercial), C-2 (Community Commercial), and M-1 (Light Industrial). The parcel is vacant along with a newly constructed sign shop located at the site. Mr. Wagoner addressed questions concerning the comparison of this request with a recent case brought forward by a local church for a zone change on 10"Avenue. He noted that the church property is zoned R-1 (Low Density Residential) and the Comprehensive Plan Map indicated the site as R-1. He emphasized that each property is reviewed on its own merits for compliance with the Comprehensive Plan Map. This public hearing was not planned in coordination with the declaration of surplus property. He concluded by stating that 2111 Avenue is a gateway entrance into the City of Caldwell. A multi-use development north of the site has been rezoned as commercial. A proposed future restaurant at the site and recreational vehicle facility would require the zone classification as commercial. Staff has been looking at the property for several months wanting the parcel to be rezoned to commercial in conjunction with it being a major transportation corridor. Mayor Nancolas explained that during budget workshop sessions this year, discussion was held about the City developing some RV spaces along the back of the property for use by the Caldwell Night Rodeo and Canyon County Fair. Councilman Stadick complimented Gary Vance, owner of the Superior Signs, on the construction and appearance of his new business along 21st Avenue. Mr.Wagoner noted that Mr.Vance and the City of Caldwell jointly filed the rezone request. Keri Sigman, 411 Blaine, Caldwell Economic Development Specialist, acknowledged being sworn in and spoke in favor of the request. She reported that it was City staff's desire for the site to be rezoned to commercial for economic development purposes. In consultation with Buxton Company, the 21"Avenue corridor is essential as a future retail trade area. She also noted that she has been contacted by a restaurant owner who is interested in locating his business along 21"Avenue at the subject parcel. MOVED by Pollard, SECONDED by Ozuna to close the public testimony portion of the hearing. MOTION CARRIED (FINANCE AND HUMAN RESOURCE REPORTS) Councilman Pollard reported that the Finance Committee has reviewed current accounts payable in the amount of $2,002,860.08 for the period ending October 10, 2017 and net payroll in the amount of $408,046.48 for pay period ending on September 30,2017. MOVED by Pollard, SECONDED by Callsen that accounts payable in the amount of $2,002,860.08 represented by check numbers 126036 through 126338 and payroll for the amount of $408,046.48 represented by check numbers 31651 through 31748 and payroll direct deposits, be accepted, payment approved,and vouchers filed in the office of the City Clerk. MOTION CARRIED (COUNCIL COMMENTS) BOOK 58 PAGE 146 Councilman Ozuna complimented the Parks& Recreation Department for the excellent programs that they offer to the public. (MAYOR'S COMMENTS) The Mayor expressed appreciation to the Engineering Department staff for moving forward with the Main Street Project. Paving has begun downtown this week and should be completed within the next couple of days. The Veterans Garden entrance will also be completed at this time. He acknowledged the endurance of the downtown business owners throughout the Main Street project this year to include infrastructure upgrades and repaving. He noted that infrastructure improvements would be beneficial to the property owners for future building improvements and development. October is the designated time for the statewide Mayor's Walking Challenge. The Mayor noted that he has participated in the challenge at the Caldwell schools. Whichever school reports the most miles walked by the students receives a monetary award,which may be used on physical fitness equipment. If the Mayor's average is at least 10,000 steps per day, $1,000 may be awarded through the program to a school to encourage ongoing physical fitness. The Mayor reported on the win by the College of Idaho Coyotes at their recent football game on Saturday. The Mayor attended the ribbon cutting ceremony for Woodhouse Reality in downtown Caldwell. The Mayor provided an update report on the I-84 expansion project by Idaho Transportation Department. The Mayor attended a ceremony on Arbor Day at Lions Park along with memberships of the Caldwell Lions Clubs to plant trees. He noted that the City of Caldwell was recognized as a Tree City USA participant for 39 years. Appreciation was expressed to Vinton Howell and the Parks Department crew along with members of the Lions Club for their participation in the Arbor Day activities. The Mayor provided an update report on the offer to purchase property in association with the Purple Sage Golf Course. He noted that the subject property was declared as surplus property approximately two (2)years ago. The purchase offer was sent to the City Council Members for their review prior to tonight's meeting and have been reviewed by the City Finance Director and the City Attorney. The Mayor requested that any questions about the proposed transaction be addressed to him or the City Attorney. Appreciation was expressed to Alan Mills for his efforts in marketing the property and negotiating with the developers. A contract will be provided to City Council for their consideration at an upcoming Regularly Scheduled City Council meeting.
