ORDINANCE NO. 3115
AN ORDINANCE RECITING PETITION FOR VACATION OF EASEMENTS
AND RECITING APPROPRIATE NOTICE WAS GIVEN TO PUBLIC
UTILITIES; DETERMINING THAT VACATION OF SAID EASEMENT IN
THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, DESCRIBED
BELOW, SHALL BE MADE; AND DETERMINING THAT VACATION OF
SAID EASEMENTS ARE IN THE BEST PUBLIC INTEREST FOR THE CITY
OF CALDWELL, CANYON COUNTY, IDAHO.
DESCRIBED HEREIN, This ordinance is to vacate a portion of a 10-foot wide utility easement
across a part of Lot 12,Block 1, Re-Plat Sky Ranch Business Center Phase 1,recorded in Canyon
County, Idaho in Book 44 of Plats at Page 17,being located in the SW 1/4 of Section 25, Township 4
North,Range 3 West,Boise Meridian,City of Caldwell, Canyon County,Idaho,
more particularly described in the attached exhibits.
Section 1. That an application has been presented to the Mayor and Council of the City
of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above
described easements located in Caldwell, Canyon County, Idaho.
Section 2. That Council finds the owners of all properties abutting easements vacated by
this action, have access to his,her, or their property from some other public street,public right-
of-way or private road;
Section 3. That said easement(s)do not contain public or private utility lines that cannot
feasibly be relocated or retained through the establishment of appropriate easements,which are to
be created and recorded by separate instruments.
a. PETITIONER shall incur all cost related to said vacation.
b. Intermountain Gas requires stub at west edge of property
c. Idaho Power requires relocation
Section 4. That it is hereby determined it is in the best interest of the public that the
above-described easement in the City of Caldwell, Canyon County, Idaho be vacated.
Section 5. This ordinance shall be in full force and effect from and after its passage and
publication according to law and compliance with all conditions prescribed herein.
Section 6. Be it ordained and established that the above-described premises in the City of
Caldwell, Canyon, County, Idaho, upon vacation shall pass and revert to the private property
owner.

Ranch Business Center Phase 1, recorded in Canyon County, Idaho in Book 44 of Plats at Page 17,
being located in the SW 'A of Section 25, Township 4 North, Range 3 West, Boise Meridian, City of
Caldwell,Canyon County,Idaho, more particularly described as follows;
COMMENCING at the Center 'A Corner of Section 25; thence South 89°36'25" West a distance of
1323.35 feet along the north boundary of Re-Plat Sky Ranch Business Center Phase 1 to the CW 1/16
corner of said Section 25; thence continuing along said north boundary of the Re-Plat Sky Ranch
Business Center Phase 1 and the north line of Lot 12, Block 1 of said plat South 89°36'17" West a
distance of 300.18 feet;thence leaving said north boundary South 00034'00"West a distance of 10.00
feet to the POINT OF BEGINNING;thence continuing
South 00°34'00"West a distance of 21.48 feet to a point of curvature;thence
Southeasterly 287.45 feet along a curve to the left having a central angle of 78°25'37", a radius of
210.00 feet, and a long chord bearing South 38°38'49"East a distance of 265.53 feet;thence
South 89°36'25"West a distance of 34.28 feet parallel with and 15.00 feet northerly of the south line
of said Lot 12 to a point of curvature;thence
Northwesterly 267.54 feet along a curve to the right having a central angle of 69°40'37", a radius of

Request: Vacation of Public Utility Easement-4009 Challenger Way
Waive three- reading requirement
Natasha Tattersall, on behalf of Syringa Networks, LLC requests Vacation of a portion of a 10-
foot wide utility easement across a part of Lot 12, Block 1, Re-Plat Sky Ranch Business Center
Phase 1,recorded in Canyon County, Idaho in Book 44 of Plats at Page 17, being located in the
SW '/4 of Section 25, Township 4 North, Range 3 West, Boise Meridian, City of Caldwell,
Canyon County, Idaho, more particularly described in exhibit"A"and is delineated on the
attached map.
Public utilities were notified and have no objections to the easement vacation. Idaho Power and
Intermountain Gas will require relocation at the Petitioners expense. The proposed vacation does
not create any landlocked parcels.
Attached for consideration of City Council is a proposed ordinance which, if approved, would
vacate the easement listed above in accordance with the applicant's request. The applicant would
like this request to be passed on the first reading.
The following exhibit is provided with this memo:

It is the recommendation of the Public Works Director that Council consider the proposed
vacation.
