Mayor Nancolas opened the meeting at 6:00 p.m. and welcomed those in attendance. The Roll of the City Council was called by the City Clerk with the following members present: Callsen,Pollard, Allgood,Ozuna,and Hopper.Absent: Stadick. (PROPOSED CHANGES TO THE "ADDRESS ORDINANCE" LOCATED WITHIN THE CALDWELL CITY CODE [SECTION 05-07-09 AND 12-01-09]) Brent Orton, 621 Cleveland Blvd., provided the staff report and outlined the contents of the proposed ordinance. He noted that the potential changes have been reviewed by the Fire Marshal who also has been corresponding with the Canyon County Mapping Department. (PROPOSED YEARLY UPDATES TO THE CALDWELL ZONING ORDINANCE) Jarom Wagoner, 621 Cleveland Blvd., provided the staff report and outlined the contents of the proposed ordinance regarding changes to the Caldwell Zoning Ordinance. The workshop was dismissed at 6:50 p.m. REGULAR MEETING MINUTES July 17,2017 7:00 P.M. Mayor Nancolas opened the meeting at 7:00 p.m. and welcomed those in attendance. He reported that there was a workshop held at 6:00 p.m. concerning proposed changes to the City Code by the Mapping Department and the Planning&Zoning Department. Pastor Jim Porter of the United Free Methodist Church provided the invocation. The Mayor led the audience in the Pledge of Allegiance to the Flag. The Roll of the City Council was called by the City Clerk with the following members present: Callsen,Pollard, Allgood,Ozuna,and Hopper.Absent: Stadick. CONFLICT OF INTEREST DECLARATION Councilman Hopper reported that as Chairman of the Urban Renewal Agency, he would be not participating in Items 1-4 under Old Business. SPECIAL PRESENTATIONS None. ADDITIONS OR DELETIONS TO THE AGENDA None. AUDIENCE PARTICIPATION Beverly Delaney, 103 South Homedale Road, manager of the Pet Haven Thrift Store located at 619 Main Streets,asked about the anticipated completion date for the infrastructure improvements along Main Street. She expressed her concern about the ongoing construction this summer affecting the lack of traffic being able to access the businesses and/or sufficient parking along Main Street. She asked if additional signage could be posted directing patrons to the parking areas located behind the businesses abutting the railroad. Robb MacDonald, City Engineer at 621 Cleveland Blvd., reported that City Engineering Staff members will be going this week to meet with each of the business owners to discuss their concerns and provide updates concerning the Main Street Infrastructure Project. CONSENT CALENDAR: 1. Approve acceptance of the minutes of the Regularly Scheduled City Council Meeting held on July 3, 2017 and the Caldwell Senior Center Board Meeting held on June 12,2017; 2. Approve Resolution No. 124-17 authorizing the adoption of the Citizen Participation Plan and Anti- Displacement Policy for HUD Community Development Block Grant programs; 3. Approve Resolution No. 125-17 authorizing the execution of a Sub-Recipient Agreement with New Beginnings Housing, LLC to provide CDBG funding for a new low-moderate income senior rental housing project in the amount of$5,000.00 known as the Vineyard at Sycamore Project located at 817 Fillmore Street; 4. Approve Resolution No. 126-17 authorizing the execution of The School Resource Officer Program Agreement with the Caldwell School District No. 132 effective July 1,2017 through June 30,2018; BOOK 58 PAGE 93 5. Approve Resolution No. 127-17 authorizing the purchase of a utility bed from Canyon Truck Upfitters in the amount of$10,747.60 for use by the Street Department pursuant to Idaho Code 67-2803(2); 6. Approve Resolution No. 128-17 authorizing the execution of a Purchase and Sale Agreement with Badger Creek Investments for purchase of a small right-of-way for the cul de sac at the end of Slipstream; 7. Approve Resolution No.129-17 authorizing the execution of an Agreement for Professional Operations Services with Idaho Environmental Services,LLC for the Caldwell Wastewater Treatment Plant; 8. Approve Resolution No. 130-17 accepting an Easement from Challenger Development, Inc. for utility lines across a portion of their property to provide services for Pennsylvania Park Subdivision No. 1. Absent and/or not voting: Stadick. MOTION CARRIED OLD BUSINESS (PUBLIC HEARING [QUASI-JUDICIAL]: CASE NO. ANN-17-03: A REQUEST BY THE URBAN RENEWAL AGENCY OF THE CITY OF CALDWELL TO ANNEX 22.09 ACRES, MORE OR LESS,WITH AN M-1 (LIGHT INDUSTRIAL) ZONING DESIGNATION AND A DEVELOPMENT AGREEMENT FOR THE PROPERTY LOCATED AT 5221 E. LINDEN STREET (PARCEL R3529400000) IN CALDWELL, IDAHO. (IT HAS BEEN REQUESTED BY THE APPLICANT THAT THIS ITEM BE CONTINUED TO THE NEXT CITY COUNCIL MEETING TO BE HELD ON JULY 17,2017) The Mayor outlined the quasi-judicial process, noting that the testimony for ANN-17-03 and ZON-17-02 would be heard simultaneously but action by City Council would be handled separately. He declared the public hearing open and asked for those who would be providing public testimony to stand and be sworn in by the City Clerk. Jarom Wagoner, 621 Cleveland Blvd., acknowledged being sworn in and outlined the facts within the staff report. He noted that the surrounding properties are zoned R-2/R-3 (Medium Density Residential), M-1 (Airport/Industrial/Farm Land), and County (Farm Land/Industrial/Residential). The subject property has frontage along Linden Street (arterial roadway) and KCID Road (collector roadway). Truck traffic is to enter the site from Skyway Street which will be constructed initially. The employees may access the site from KCID roadway. Right-of-way improvements would be required. No access to the site would be allowed from Linden Street. A 30-foot landscape buffer would be required along KCID Road and a 20-foot landscape buffer along Linden Street. It has been recommended that the improvements be completed as the appropriate portion of property is developed. He provided a review with the APO-1 &APO-2 zones in correlation to the subject property. In response to questions from Councilman Allgood, Mr. Waggoner confirmed that the request for annexation was filed by the Caldwell Urban Renewal agency. Tremayne Arnold, Capitol Distributors at 3500 E. Commercial Court, Meridian, acknowledged being sworn in and spoke in support of the request. Richard Hachtel, 11969 Sandpiper Court, acknowledged being sworn in and spoke in favor of the request. Elizabeth Hachtel, 11969 Sandpiper Court, signed in support of the request but did not provide testimony. Kelly Garcia, 2105 South KCID Road, acknowledged being sworn in and spoke in opposition to the request. She expressed concerned regarding the parking for employees as well as noise and light pollution. She recommended that a large berm be placed between the commercial development and the residential subdivision. Susan Rush, 11687 Annette Court, acknowledged being sworn in and spoke in opposition to the request. She expressed concern that there was a plan in place to defer the traffic from Linden Street toward Hwy. 20/26. She noted that children travel to school along Ward/Linden/KCID Road and additional commercial traffic could be a safety hazard. The Mayor clarified that City staff has indicated that the truck traffic would travel up Skyway to Hwy. 20/26 for entrance to the freeway. Jarom Wagoner confirmed that the business is a distribution center for Jackson's. They would pick up the goods at the site and then distribute the items to Jackson's stores throughout the valley. David Rush, 11687 Annette Court,signed in opposition to the request but did not provide public testimony. Shanna Brumley, 19251 Warbler Way, signed in support of the request but did not provide public testimony. Wendy Dickison, 19262 Warbler Way, acknowledged being sworn in and spoke in opposition to the request. She provided a PowerPoint presentation including a map overlay of the proposed design within the subject property. She expressed her concern regarding traffic within the area and the effect the BOOK 58 PAGE 94 additional traffic will have on school buses for Vision Charter School and other Vallivue District schools transporting children from the area subdivisions. She questioned if the commissary associated with the distribution center would be allowing the public to purchase items on site. She recommended that semi- trucks not be allowed along KCID Road. She stated that the physical address for the complex is currently planned to be on KCID Road; therefore, truck deliveries will be using that address in the GPS navigator. She recommended that the shipping address be listed for Skyway to assist the delivery trucks in keeping off of KCID Road. Ms. Dickison continued to express her concern about safety issues with children traveling to school along KCID Road. There currently is a bus stop located on KCID Road. She recommended that sidewalks be included along the KCID right-of-way and possibly install a bridge across the drainage canal for pedestrian use. She asked for the City's assistance in making the roadway a safe route for schools. She provided a picture of cars parked along KCID at the southern entrance of the Pheasant Run Subdivision. She noted that due to the current policies in place by the home owners association, home owners are prohibited from parking along the roadway within the subdivision and therefore residents routinely park along KCID Road. The Mayor labeled the PowerPoint presentation at CC-1000. In response to questions from Councilman Callsen, Mr. Dickison report that some of the busses pick up children within the subdivision and other stop along KCID Road. Discussion followed concerning the time that the various school busses pick up students along KCID Road. Councilman Callsen stated his support of having the distribution's shipping address different from the physical address of the site. Ms.Dickison requested that"no truck parking" signs be posted along KCID Road. Councilman Pollard expressed appreciation to Ms. Dickison for her professional and informational presentation. Dennis Dickison, 19262 Warbler Way, signed in opposition to the request for did not provide public testimony. Barbara Rowen, 11707 Annette Court, acknowledged being sworn in and spoke in opposition to the request. She addressed her concern about the design of the proposed berm and lack of landscaping within the"future expansion"area. She requested that the berm and sidewalk area be completed at the time of the initial construction for the entire complex in order to protect the values of the neighboring homes. She recommended that the buffer be expanded to 40-feet with a 10-foot berm which would greatly assist with the noise and light pollution for the neighboring residences. Mike Rowen, 11707 Annette Court,signed in opposition but did not provide public testimony. Sharron Nagle, 11984 Pheasant Run, signed in opposition but did not provide public testimony. J.R. Smith, 2107 KCID Road, acknowledged being sworn in and spoke in opposition to the request. He expressed his concern regarding the lack of sufficient transition between the residential and the light- industrial development. He asked for clarification in regards to a possible power sub-station being built within the area. He reported that the rezone opens the opportunity for many industrial uses which could vastly affect the residential neighborhood. He recommended that Jackson's not be allowed to use KCID Road for business purposes. Jared Shuey, 19192 acknowledged being sworn in and spoke in opposition to the request. He expressed concern regarding the encroachment of light industrial in close proximity to the R-1 residential area and the neighborhing schools. He stated his concern with a possible new sub-station within the area. He recommended that the existing sub-station on Linden with space available for expansion. He noted that he works in a light industrial park and the buildings have not been maintained. He does not want to see that happen at the proposed site. Tana Morton, 19090 Harley Way signed in opposition but did not provide public testimony. Steven Morton, 19090 Harley Way,signed in opposition but did not provide public testimony. Josie Landon, 19072 Harley Way, acknowledged being sworn in and spoke in opposition to the request. She expressed concern with the potential noise pollution and additional traffic to the area. She recommended additional berm height by use of six foot fence on the top of the berm which would provide privacy and defer noise pollution. Tyson Landon, 19072 Harley Way signed in opposition but did not provide public testimony. In rebuttal, Tremayne Arnold, addressed statements regarding noise pollution by clarifying that the operations of the business would be contained within the building. The trucks will be parked on the interior of the building which will assist with noise pollution. In reference to light pollution,the employee parking area will have lighting. He noted that he was not aware of additional lights along KCID Road. BOOK 58 PAGE 95 In response to questions from Mayor Nancolas,Mr. Wagoner stated that the City Code requires all parking lot lights must face downward to avoid light pollution. Mr. Arnold continued by stating that their intent is to keep the truck traffic away from KCID Road. Currently Capitol Distributing has 42 routes with trucks servicing those areas. Smeed and Skyway roadways will be used for truck traffic. Eighty-five percent of the trucks will be servicing areas such as Seattle,Portland,Phoenix,Reno,and Salt Lake.The secondary access point site will not be used. Mr. Arnold pointed out the location of the proposed commissary and bakery on the site plan. The function of the commissary would be to assemble sandwiches to be sold in the Jackson's convenience stores. The food products will arrive frozen and then assembled on site within the commissary section. The bakery will be producing items such as muffins and doughnuts. These services will be phased in after a few years. He expressed appreciation to Ms. Dickison concerning the recommendation for the shipping address to be listed on Skyway for the purpose of inbound freight directed to the proper location. Early inbound traffic will be arriving at approximately 5:00 a.m. In response to questions from Councilman Callsen,Mr. Arnold provided an estimate of operational times at the site. Discussion followed concerning the recommendation of providing fencing along the top of the berm. Mr. Wagoner clarified that fencing would not be allowed within the portion of the canal relocation due to an easement. In response to questions from Councilman Allgood, Mr. Arnold confirmed that none of the operations within the distribution center would be open to the public. Ms. Dickison was called to the podium to stand for questions. In response to questions from Councilman Allgood, Ms. Dickison confirmed that there are pre-existing conditions regarding parking within the subdivision as enforced by the home owners association. She noted that it appears that such stipulations would remain at this time since a majority vote by the HOA members is required to change the process. MOVED by Callsen, SECONDED by Ozuna to close the public testimony portion of the hearing. MOTION CARRIED EVIDENCE LIST FOR CASE NO.ANN-17-03 and ZON-17-02: The Mayor presented the Evidence List: staff report, sign-up sheets, aerial map of ANN-17-03 and ZON- 17-02, site plan, APO-1 and APO-2 Zones (map), and CC-1000 (pictures of the site presented by Wendy Dickison through a PowerPoint slide show which was referenced by Ms. Dickson and others in opposition to the request.) MOVED by Callsen, SECONDED by Allgood to accept the Evidence List as presented. MOTION CARRIED Councilman Callsen clarified that future development plans must comply with the conditions as set forth within the Development Agreement. COMPREHENSIVE PLAN ANALYSIS FOR CASE NO. ANN-17-03: MOVED by Callsen, SECONDED by Allgood to accept the Comprehensive Plan Analysis as presented in the staff report under roman number V. MOTION CARRIED FINDINGS OF FACT ON CASE NO.ANN-17-03: MOVED by Allgood, SECONDED by Callsen to accept the general facts as outlined in the staff report,the public testimony that was given in this matter and the evidence list that was presented. MOTION CARRIED CONCLUSIONS OF LAW ON CASE NO. ANN-17-03: MOVED by Ozuna, SECONDED by Callsen that the Caldwell City Council has the authority to hear this case and to make the decision to approve or deny; and the public hearing was noticed and heard within the guidelines of applicable state codes and local ordinances. MOTION CARRIED ORDER OF DECISION ON CASE NO. ANN-17-03: MOVED by Pollard, SECONDED by Callsen based on the Findings of Fact and Conclusions of Law, the Caldwell City Council hereby orders that Case No. ANN-17-03 a request by the Urban Renewal Agency of the City of Caldwell to annex 22.09 acres,more or less,with an M-1 (Light Industrial) zoning designation and Development Agreement for the property located at 5221 E. Absent and/or not voting: Stadick and Hopper MOTION CARRIED Mayor Nancolas requested clarification be provided regarding the fencing matter between the developer and City staff. He asked that the fencing matter be considered by the developer thereby possibly assisting with the mitigation of sound and aesthetics of the development. Mark Hilty reported that he and City staff members will follow-up with the developer about the fencing recommendation as supported within public testimony,noting that there will be limitations on fencing within the irrigation easement area. THE SUBJECT PROPERTIES ARE LOCATED WEST OF KCID ROAD AND SOUTH OF THE SKYWAY STREET ALIGNMENT (PARCELS R3529200000 AND R3529001400) IN CALDWELL, IDAHO. MOVED by Pollard, SECONDED by Callsen to accept a friendly amendment to the motion as recommended by Mayor Nancolas to include within the development agreement the assignment of a delivery address along the Skyway Drive location and proper signage directing truck traffic to the same location. MOTION CARRIED Mayor Nancolas explained the 28-day appeal period procedure effective the date of the signed written Order of Decision which will be considered by City Council at the next Regularly Scheduled City Council Meeting to be held on August 7, 2017. He emphasized that no communication be made with members of the City Council. All questions concerning the hearing and/or appeal process must be directed to City staff members. MOTION CARRIED NEW BUSINESS (PUBLIC HEARING TO RECEIVE PUBLIC TESTIMONY REGARDING THE CREATION OF NEW FEES ASSOCIATED WITH ADDITIONAL SERVICE OFFERINGS IN THE SANITATION DEPARTMENT WITH THE CONTRACTED PROVIDER,REPUBLIC SERVICES) Brent Orton, 621 Cleveland Blvd., provided the facts concerning the request from Republic Services for new fees pertaining to sanitation services. He noted that there was a previously held City Council workshop concerning this matter prior to the public hearing. BOOK 58 PAGE 98 Rachelle Klein of Republic Service, 2130 W. Franklin Road, Boise, spoke in favor of the request. She outlined the changes pertaining to commercial rates. MOVED by Allgood, SECONDED by Ozuna to close the public hearing. MOVED by Pollard, SECONDED by Hopper that accounts payable in the amount of $1,010,879.14 represented by check numbers 124450 through 124731 and payroll for the total amount of$321,065.04 represented by check numbers 31338 through 31376 and payroll direct deposits, be accepted, payment approved,and vouchers filed in the office of the City Clerk. MOTION CARRIED (COUNCIL COMMENTS) Councilman Pollard commented on the retirement ceremony for Mark Davis as supervisor for the Caldwell Event Center to be held on Friday,June 21,2017. Councilman Allgood complimented staff on the thorough preparation for the public hearing concerning ANN- 17-03 and ANN-17-02. BOOK 58 PAGE 99 (MAYOR'S COMMENTS) The Mayor provided an update concerning the upcoming Canyon County Fair and the success of planning sessions which have been held at City Hall with representation from the various agencies and departments. The Mayor reported on the success of the July 41h parade and fireworks display. The Mayor reported on the necessary measures being taken by Idaho State agencies and municipalities in preparation of the upcoming solar eclipse on August 21, 2017. He will be discussing this matter with the Appointed Officials.
