MINUTES
CALDWELL CITY COUNCIL
June 28,2017
12:00 p.m.
Mayor Nancolas called the meeting to order at 12:00 pm.
Roll was called by the City Clerk. Present: Hopper (via phone), Callsen, Pollard, Stadick, and Allgood.
Absent: Ozuna.
Staff present: Brandon Fonnesbeck and Mike Keeley of McAlvain Construction, Carol Mitchell,Brent Orton,
T.J.Frans,E1Jay Waite,Keri Sigman, and Debbie Geyer.
(CONSIDER RESOLUTION NO. 117-17 AUTHORIZING THE EXECUTION OF AMENDMENT NO.
3 - PHASE I [PRECONSTRUCTION SERVICES] CMGC CONTRACT WITH MCALVAIN
CONSTRUCTION FOR PRECONSTRUCTION SERVICES THROUGH DESIGN COMPLETION
AND BIDDING OF THE INDIAN CREEK PLAZA PROJECT)
Brent Orton, 621 Cleveland, provided the staff report and outlined the contents of the proposed contract with
McAlvain Construction. Items addressed were 1) Amendment 43 Contract and 2) cost outlook and project
strategy.
It was noted that approval of Amendment 3 allows McAlvain Construction to move forward with completing
underground and time critical project elements within the scope of work. The current Guaranteed Maximum
Price (GMP)for all project elements approved to date is $5,034,115. Other construction elements to complete
the scope of the project will be presented for addition once the best value possible is believed to have been
achieved. Remaining scope items have not been included to date because bids came in higher than anticipated
and additional negotiation and modification may allow those costs to come down before acceptance.
Discussion followed concerning areas of the design and the construction plan which is being reviewed by
McAlvain Construction for possible cost savings. It was emphasized that approval of today's request would
allow the project to stay on track within the estimated completion date. Value engineering is currently
underway for elements such as the fountain and lighting circuitry within the plaza in an attempt to defray costs.
The Mayor expressed his opposition to approving major simplifications to the project or deferral options since
the public is anticipating a completed design with amenities as addressed in prior presentations.
Brandon Fonnesbeck of McAlvain Construction, Inc. of 5559 W. Gowen Road, Boise, addressed questions
about Amendment No.3 and provided an outline of the various components of the project. He reported on their
strategy regarding simplification of design elements. He asked for support of deferring the design elements to
possibly obtain alternate bids with the flexibility of working with local companies for possible cost reductions
and/or in-kind donations. He explained the potential use of contingency funds associated with the project
noting that approximately$400,000 has been set aside under contingency funds.
Mike Keeley,McAlvain Construction, Inc. of 5559 W. Gowen Road,Boise, explained some of the options that
have been reviewed to assist with cost savings for the project. He reported that McAlvain constructed the
fountain located at the Boise Grove Center,which is a highly utilized and functional feature for public use.
Keri Sigman reported that Destination Caldwell is planning on approximately 250 events per year at the Indian
Creek Plaza for the community to come together including outdoor movies, entertainment, splash pad, and ice
skating.
Discussion followed concerning expectations of the project and associated cost factors.
E1Jay Waite, 411 Blaine Street, stated that he has reviewed the contract in association with Urban Renewal
Agency funding and reported that the proposed costs could be covered through URA funding.
The Mayor read the resolution by title only:
BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL TO
APPROVE THAT CERTAIN "AMENDMENT NO. 3 TO CONSENSUS DOCS 500 STANDARD
AGREEMENT AND GENERAL CONDITIONS BETWEEN OWNER AND CONSTRUCTION MANAGER"
FOR CONSTRUCTION MANAGER/GENERAL CONTRACTORS (CMGCS) SERVICES (GENERAL
CONDITIONS)RELATING TO THE CONSTRUCTION OF THE INDIAN CREEK PLAZA IN BRINGING
THE APPROVED GUARANTEED MAXIMUM PRICE FROM $2,170,028 AS APPROVED PREVIOUSLY
BY AN INCREASE OF $2,864,087 TO $5,034,115 (ACCOUNTING FOR GENERAL CONDITIONS
SERVICES THROUGHOUT THE DURATION OF THE PROJECT, THE ICE RIBBON PACKAGE,
UNDERGROUND WORK, THE STAGE BASEMENT, ETC.) AND TO AUTHORIZE THE MAYOR AND
CITY CLERK OF SAID CITY TO EXECUTE THE SAME A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF AS IF SET FORTH IN FULL.
MOVED by Callsen, SECONDED by Pollard to approve Resolution No. 117-17 as presented and authorize
McAlvain Construction the latitude to continue with value engineering methods to find cost savings for the
project.

(UPDATE REPORT: MAIN STREET INFRASTRUCTURE IMPROVEMENT PROJECT)
Brent Orton, 621 Cleveland Blvd, reported on the progress of the Main Street Infrastructure Project and
addressed items of concern regarding dust mitigation and availability of public right-of-way to businesses
during the construction phase. He noted that Street and Water Department crews have been working on site
four(4)days per week- 10 hours per day.
T.J. Frans, 621 Cleveland Blvd., reported on the time frame for completion of the project. Water trucks have
been in operation by both the Street and Water Departments to control dust. Ongoing dust mitigation measures
will also be addressed as needed at the proposed hotel site(71h&Main)to assist with dust control separate from
the current infrastructure project. The final phase of the project will be paving the roadway which is anticipated
to take place near the end of August.
Councilman Stadick reported that he has received phone calls from local business owners about dust mitigation
measures for the area.
Mr. Frans reported that he and Robb MacDonald had personally visited each downtown business site before the
project's commencement and answered questions from the business owners about components of the project.
