HomeMy WebLinkAboutORD 3088 BILL NO. 7 ORDINANCE NO. 3088 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE R-3 (HIGH DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON-17-01 (Laster Lane Apartments Rezone) at a public hearing held, May 15, 2017. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to R-3 (High Density Residential)zone: A parcel of land located in the NE '/ SE '/ of Section 1, Township 3 North, Range 3 West, Boise Meridian, Canyon County, Idaho, and more particularly described as follows: COMMENCING at the NE corner of said NE '/ SE IA, from which the NW corner of said NE '/ SE '/ bears S 89°38'49" W, 1326.22 feet; thence S 89°38'49" W, 1009.94 feet along the northerly boundary of said NEA SE '/a to a point on the centerline of the Moses Drain and the POINT OF BEGINNING; thence S 38°49'03" E, 878.17 feet along said centerline of the Moses Drain; thence S 73°42'15" W, 636.51 feet to a point on the easterly boundary of the Owyhee Village Subdivision as shown on Page 1 Book 12, records of Canyon County, Idaho; thence along said easterly boundary the following described courses and distances; N 0°40'07" W, 237.96 feet; thence N 29°09'56" W, 264.28 feet; thence N 42°44'47" W, 32.17 feet; thence leaving said easterly boundary N 41°32'51" E, 24.78 feet; thence N 6°52'38"W, 353.00 feet to a point on the northerly boundary of said NE '/ SE 'A; thence N 89°38'49" E, 239.71 feet along said northerly boundary to the POINT OF BEGINNING. This parcel contains 8.30 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-3 (High Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. The Ordinance includes a provision to amend the official maps of the City by designating the above- described property as R-3 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 23rd day of May 2017. Ordinance No.3088 was passed by the Council and approved by the Mayor on the 15th day of May 2017.
