The Engineering Department provides the following comments on a request by Mr. Bail Inc./Kevin
Elliott for a special-use permit to operate a Bail Bonds Use within a C-C Zoning District. The
subject property is located at 921 Cleveland Blvd in Caldwell, Idaho.
Rights-of-Way
1. The existing right-of-way on Cleveland Blvd. is sufficient and the existing right-of-way on 10th
Ave. is sufficient. No additional right-of-way will be required on this street.
2. Alley right-of-way must be cleared of any structures and/or debris and must be maintained
open for public/service vehicles.
Street
1. The applicant does not propose additional access at this time but if any additional access is
desired, the engineering department must approve these access points prior to
implementation.
2. Street frontages on Cleveland and 10th shall both be improved including all the decorative
improvements consistent with the Caldwell Downtown Framework Master Plan (i.e. decorative
street lights, curb, gutter, sidewalk w/pavers, irrigation, landscaping, and other features). All
existing curb and gutter that is in poor condition, heaved, or otherwise sloped improperly, shall
be removed and replaced with new curb and gutter to prevent ponding and to maintain
consistent slopes. Shrubs and trees in conflict with the sidewalk location shall be removed. All
sidewalks shall be placed within the public right-of-way. Intersection corners adjacent to the site
shall have pedestrian ramps installed per City specifications and details. All driveway entrances
into the site shall be constructed per City of Caldwell standards and details.
3. Any other frontage improvements shall be in compliance with City of Caldwell standards and
specifications.
4. Developer has the option to have the frontage improvements constructed, and can sign up,
through the City of Caldwell Decorative Concrete Local Improvement District(LID)as an
alternative to constructing frontage improvements out right(if an open LID coincides with
construction).

Sewer&Water
1. Per City Code, all structures on site must be separately connected to the City water and sewer
main lines with service lines and meters. Any/All plumbing/utility plans must be reviewed and
approved by the City prior to installation.
2. Water and sewer fees will be assessed per the adopted water and sewer fee schedules
depending on the new proposed use.
Storm Water
1. Depending on how the site develops and in accordance with the adopted City of Caldwell
Storm Water Manual, storm water improvements may be required.
Irrigation
2. Irrigation water for any and all landscaping shall be obtained from applicable Irrigation
District sources. City municipal water may be used only if the criteria specified in the
Landscape Ordinance Section 10-07-12 are met.
General
1. Prior to commencement of construction in any dedicated right-of-way, or construction of any
improvement intended for dedication to the City or connected to a City facility, the City
Engineering staff is to be notified. This preferably will take place in a pre-construction
conference scheduled by the engineer of record in which all appropriate personnel and
utilities Appropriate City personnel are to be notified in advance of all required inspections.
2. Appropriately licensed public works contractors shall perform all construction within public
rig ht-of-way.
3. All traffic control for the project shall meet the requirements of the Manual on Uniform Traffic
Control Devices (M.U.T.C.D.) and the City Engineer. The contractor shall provide a traffic
control plan to the City Engineer for review and secure an appropriate right-of-way permit
prior to any construction within the right-of-way.

The Idaho Transportation Department(ITD)has reviewed the referenced special use application for
Mr. Bail Inc. located at 921 Cleveland Boulevard northeast of I-84B (Cleveland Boulevard). ITD has
the following comments:
1. ITD has no objection to a Bail Bonds establishment operating at this location.
2. The application is not requesting a new access to I-84B (Cleveland Blvd.) and none is
approved with this application. Any change to the current access will warrant updating
to current IDAPA 39.03.42 rules. Current IDAPA 39.03.42 rules on an Urban
Statewide Route at 35 mph or less upstream from a public road intersection is 790 feet
and between accesses other than public roads is 250 feet. The minimum width for a
commercial (one-way) access is 15 feet and for a commercial (two-way) access is 25
feet. ITD has concerns for safety and mobility on I-84B (Cleveland Boulevard) as the
current access does not meet these requirements.
3. Applicant must apply for and receive an approved Right-of-Way use permit prior to
doing any work or activity within the highway Right-of-Way. Please have the
applicant contact Tyson McCoy at 334-8335 for more information.
4. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State
highway system.
5. IDAPA 39.03.60 rules govern advertising along the State highway system. Applicant
can contact Dion Burch at 334-8355 for more information.
