Call to Order –Chairperson Doty-Pomoransky called the meeting to order for the public hearing at 7:03 p.m. II. Roll Call – Members Present: Ed Doty-Pomoransky, Jeremy Feucht, Kenneth Scholz, Roger Page. Disclosures and Conflicts of Interest: Ed Doty-Pomoransky as a resident just outside the 300ft boundary of case SUP-04-14. Members Absent: Dana Vance. Staff Present: Jarom Wagoner (Senior Planner); April Cabello (Planning Technician); Robb MacDonald (Assistant City Engineer); Brian Billingsley (Planning and Zoning Director) Staff Absent: None Review of Proceedings – Chairperson Doty-Pomoransky announced the procedures for the public hearing. III. Old Business A. Approve minutes of December 10, 2013 regular meeting. MOTION: Commissioner Page SECOND: Commissioner Scholz Passed: Unanimous roll call vote. IV. New Business A. Elect Chairperson and Vice Chairperson for 2013. MOTION made by Commissioner Page to elect Commissioner Doty-Pomoransky as the Chairperson for 2014. SECOND: Commissioner Scholz PASSED: Unanimous roll call vote. MOTION made by Chairperson Doty-Pomoransky to elect Commissioner Page as the Vice- Chairperson for 2014. SECOND: Commissioner Scholz. PASSED: Unanimous roll call vote. 2 P&Z Minutes 4/8/2014 B. Case Number SUP-04-14 a request by Bradshaw Construction for a special-use permit to construct a single-family dwelling in the H-D (Hospital District) zone. The subject property is located at 122 Mead Street in Caldwell, Idaho. Testimony: 1) Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report as written and submitted an aerial photo of the site labeled Exhibit PZ- 1001. He further reported that the applicant is requesting a special use permit approval, which is required for a single-family residence to be built in the H-D (Hospital District) zone. The property is located at 122 Mead and is surrounded by residential uses and a medical complex. Mr. Wagoner further explained the subject property utilizes Mead Street, a local street, for ingress/egress to the property and the engineering department, fire marshal, building department, and police department were all sent a request for comment on March 6, 2014. The Engineering Department has stated that there should be right-of- way dedication required with this application, as well as a deferral agreement for sidewalk in the future. There are no landscaping requirements for this use. Mr. Wagoner stated the applicant will comply with the all applicable city codes, ordinances, policies, and standards and is to dedicate 28 feet of right-of-way measured from the centerline of Mead Street, abutting the site. The applicant is required to enter into a deferral agreement with the City of Caldwell for the future construction of sidewalk on Mead Street, abutting the site. Commissioner Scholz expressed his concern and dislike about the deferred sidewalk. Commissioner Feucht confirmed this is the Hospital District zone and wondered if it was subject to different noise ordinance. Mr. Wagoner responded that the noise ordinance is enforced by the Police Department and is not aware of any additional requirements due to the Hospital District. Robb MacDonald, 621 Cleveland Blvd., Caldwell, ID 83605, Assistant City Engineer testified that at this time there is no plan for the city to put in sidewalk in any of this area, the city always has the option to approach the property owners and ask if they would like to participate in an LID. Mr. MacDonald further stated that the typical sidewalk is not designed or to be used as a bike route because it is not wide enough to have two way bike traffic, sidewalk is used primarily for pedestrians. Brian Billingsley, 621 Cleveland Blvd., Caldwell, ID 83605, Planning Director testified that he created the Hospital District and worked with West Valley Medical Center in 2007. Together they decided the boundaries, allowed uses and special uses in this district. Most of the area around the hospital had been zoned High Density Residential and if you wanted to build a medical office it would require a special use permit. Medical Building is now an allowed use and a house is a special use permit. The Hospital Officials are supportive of homes being built on the outskirts of the Hospital District; the concern is Logan, 10th Avenue, Kimball and Elm Street. Mr. Billingsley stated based on his past discussions with Hospital Staff he would not have a problem with this special use being approved and recommends approval. Sallie Bradshaw, 717 E. Willow Street, Caldwell, ID 83605, applicant testified in favor of the application and submitted exhibit PZ-1002 a proposed site plan for a single family 1,400 square foot home. Ms. Bradshaw explained she purchased the property in 2006. At that time this area was zoned High Density Residential and needed a special use permit to build the medical buildings but now that has been changed and now has to apply for a special use permit to build the home and is asking for approval. Commissioner Scholz asked the applicant how she felt about putting in a sidewalk. 3 P&Z Minutes 4/8/2014 Ms. Bradshaw responded that those that are representing our city at this time have the real outlook and the fact that why are we putting a sidewalk on just a very small spot when everything else isn’t and becomes a hazard. Ms. Bradshaw stated that she was fine with putting in a sidewalk if the commission requires it but then it also works well for the LID. Mr. Wagoner clarified and confirmed with the commission that on the deferral agreement it gives the Engineering Department the authority to go in at any time, when it’s appropriate and require the sidewalk be constructed. Chairman Doty-Pomoransky stated there was no one other than the applicant, signed up in favor, neutral or in opposition of the application. Public Testimony was closed. Conclusions of Law for Case Number SUP-04-14 – MOTION: Commissioner Feucht SECOND: Commissioner Page Passed: Unanimous roll call vote. Order of Decision on Case Number SUP-04-14 – MOTION: Commissioner Page SECOND: Commissioner Feucht. The Commission voted unanimously to Approval C. Case Number OA-01-14 a request by the Caldwell Planning & Zoning Department to amend the current Caldwell Zoning Map and Official Comprehensive Plan Map. Testimony: 1) Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report and submitted the proposed official zone map for 2014 and the proposed official comprehensive plan map for 2014 as Exhibit PZ-1001, PowerPoint presentation. Recommendation on Case Number OA-01-14 – MOTION: Commissioner Page SECOND: Commissioner Feucht. The Commission voted unanimously to Recommend Approval V. Planning Issues – A.
