Special EMERGENCY Meeting
MINUTES
CALDWELL CITY COUNCIL
January 9,2017
6:55 p.m.
Mayor Nancolas called the meeting to order noting that this Special (Emergency) City Council Meeting was
called to ratify an Emergency Resolution for safety purposes.
Roll was called by the City Clerk. Present: Hopper,Callsen,Pollard, Stadick,Allgood,and Ozuna.
(RATIFY AN EMERGENCY RESOLUTION OF THE CALDWELL CITY COUNCIL DECLARING
AN EMERGENCY PURSUANT TO IDAHO CODE 67-2808(1) AND 74-204(2); AUTHORIZING THE
IMMEDIATE EXPENDITURE OF PUBLIC FUNDS FOR EMERGENCY WORK TO SAFEGUARD
LIFE, HEALTH, AND PROPERTY; WAIVING COMPLIANCE WITH FORMAL BIDDING
PROCESSES;AND PROVIDING AN EFFECTIVE DATE AND DURATION)
The Mayor noted that the emergency declaration was issued on Sunday, January 8, due to the extreme weather
conditions and the need to address safety issues associated with the public right-of-ways.
Mark Hilty, City Attorney at 1303 12th Avenue Road, Nampa, explained the legal basis for the state of
emergency in regards to the avoidance or mitigation of damage or potential damage to property or injury to
persons. The legal precedence also allow for the declaration without the typical notice requirements for a
special meeting.
Mayor Nancolas addressed the severity of the transportation issues which has affected emergency and
community services such as the Meals on Wheels program. The Mayor's Office, the City Clerk's office,Public
Works, Street Department, and Canyon County dispatch have fielded numerous calls concerning the extreme
condition of the roadways.
Brent Orton, Public Works Director at 621 Cleveland Boulevard outlined Emergency Resolution No. 05-18
addressing the need to authorize immediate expenditure of public funds for emergency work necessary to
address the plowing of public right-of-ways. He explained that the approval of the Resolution allows for
additional contractors to assist City crews for snow removal. Such equipment has already been put in place.
Departmental staff from the WWTP has commenced working on cleaning out the catch basins to prevent
flooding. The State of Emergency also provides for the heat system in the Street Department shop to be
addressed allowing for the snow removal equipment to dry quickly.
Discussion was held about the need of information being distributed to the community making citizens aware of
the need for them to clear their driveway after snow plows move through residential areas. It was noted that
residents have been working together to assist each other in these efforts. It was suggested that statements be
posted on social media and possibly on the next water bill explaining the process.
