HomeMy WebLinkAboutORD 3057 BILL NO. 31 ORDINANCE NO.3057 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 1, ARTICLE 11, SECTION 06-11-09, OF THE CALDWELL CITY CODE, REQUIRING THAT TAXIMETERS BE INSPECTED ANNUALLY; PROVIDING FOR AN EFFECTIVE DATE OF JANUARY 1, 2017; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF,IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 6, Article 11, Section 06-11-09, of the Caldwell City Code, pertaining to the inspection of taxicabs and commercial transportation vehicles, be amended as - follows: 06-11-09: VEHICLE AND TAXIMETER INSPECTION: (A) No vehicle shall be used as a taxicab or a commercial transportation vehicle until that vehicle has been inspected in accordance with the following requirements, and found to be in acceptable condition. Any use by a licensed taxicab business or commercial transportation business of a vehicle as a taxicab or commercial transportation vehicle prior to its having been inspected and approved in accordance with these requirements shall constitute grounds for revocation of the license of said taxicab business or commercial transportation business. It shall be unlawful to substitute equipment or parts subsequent to inspectionunless such substituted equipment or parts are in equal or better condition than the equipment or parts being substituted or replaced. Evidence that a taxicab or commercial transportation vehicle has been inspected and remains currently approved for use as a medical transportation vehicle through the Idaho medicaid program shall satisfy the inspection requirements of this section. (B) Unless a vehicle will not be operated as a taxicab, its taximeter must be inspected annually. As part of any application or renewal application for a Taxicab Business or Commercial Transportation Business License, the applicant shall submit satisfactory proof of having completed a "Meter Operation Certification" for each of its vehicles containing taximeters, evidencing that no more than three (3) months prior to submission of said application, each such PAGE-1 taximeter has been calibrated, inspected, tested and sealed by a person trained and certified to perform such actions. Section 2. This ordinance shall be in full force and effect from and after January 1, 2017. Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 3rd day of October, 2016. Section 1: Amends Chapter 6,Article 11, Section 06-11-09, by that each applicant for a Taxicab Business or Commercial Transportation Business License submit satisfactory proof of having completed a "Meter Operation Certification" for each of its vehicles containing taximeters, performed no more than three (3) months prior to submission of said application, by a person trained and certified to perform such actions. Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after January 1,2017; provides for severability; repeals conflicting ordinances, resolutions,and orders. Ordinance No. 3057 provides an effective date,which shall be on the 1st day of January, 2017. Ordinance No. 3057 was passed by the Council and approved by the Mayor on the 3rd day of October,2016.
