CALDWELL CITY OF
AN ORDINANCE OF THE CITY OF CALDWELL, IDAHO, ANNEXING A PORTION OF PROPERTY
WITHIN THE CORPORATE CITY LIMITS INTO THE CALDWELL MUNICIPAL IRRIGATION
DISTRICT OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, AND CHANGING THE
BOUNDARIES THEREOF; DIRECTING THE CITY ENGINEER TO ALTER THE BOUNDARY MAP
ACCORDINGLY; DECLARING THE INTENT OF THE CITY TO POOL WATER RIGHTS AND APPLY
A UNIFORM METHOD OF ALLOCATING ASSESSMENTS AND CHARGES; AND PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL,IDAHO:
Section 1: That the City of Caldwell,an Idaho municipal corporation is authorized by Idaho Code Chapter 18,Title
50 to establish a city irrigation district in the whole or any part of the City and by ordinance establish the exterior
boundaries of said district which boundaries may, from time to time, be contracted, extended or enlarged by
ordinance.
Section 2: That the following described real property,and all thereof,be,and the same is,hereby annexed and made
a part of the Caldwell Municipal Irrigation District of the City of Caldwell, Idaho. That the real property is hereby
annexed as legally described on the final plats listed below, along with their respective instrument numbers, all
recorded in Canyon County,Idaho.
Voyage Crossing Subdivision No.1 (Inst.No.2016-004947)
Section 3: That the City Engineer of said city is hereby directed to record this Ordinance,to forward a copy of said
Ordinance to Pioneer Irrigation District, and to adjust the boundaries and map of the Caldwell Municipal Irrigation
District in accordance with this Ordinance.
Section 4: That said City declares its intent to pool water rights incident to the above described property for delivery
purposes, that said City has adopted a uniform method of allocating assessments and charges against all lands for
which water rights are thus pooled,and that said City directs the City Engineer to furnish Pioneer Irrigation District
with a certified list or map showing all lands for which water rights have been pooled,all in accordance with Idaho
Code 50-1805A.
Section 5: That the owners of record of parcels within the aforementioned subdivisions remain responsible for fees
and assessments owing Pioneer Irrigation District for the 2016 irrigation season,including prior years.
Section 6: That this Ordinance shall be effective upon its passage,approval and publication according to law,or July
5th,2016 whichever is later.

Requested Action: Waive Three Reading Rule.
Approve irrigation annexation ordinance.
Approve Summary for publication
Attached is a request by the owner of the above mentioned parcel to annex into the
Caldwell Municipal Irrigation District.Also attached is a proposed ordinance to
accomplish the same. This annexation comprises 39 buildable lot and 4 common lots.

Re: Accept Dedication of Sewer,Water,Storm Drain,and Street Light improvements in Voyage Crossing
Subdivision No.!
In accordance with the requirement that sewer,water,and street light improvements,along with certain storm drain
conveyance facilities in the right-of-way in the Voyage Crossing Subdivision No.1,be public facilities,the
developer has requested the dedication of these facilities to the City of Caldwell.Attached to this memorandum are
the following documents:
a. Letter from Hayden Homes requesting the dedication of sewer,water,storm drain and street light
facilities in the Voyage Crossing Subdivision No.1
b. Engineer's certificate from T-O Engineers affirming that the facilities were constructed according
to approved plans;
c. Letter from the City of Caldwell to the State Division of Environmental Quality indicating City's
approval of proposed improvement plans;
Also attached to this memorandum is a proposed resolution of City Council accepting the dedication of the
following facilities to the City:

of facilities and approved the resolution as submitted.

RE: Voyage Crossing Construction Completion
Dear Steve,
Construction for the above referencedproject appears to be substantially complete. The City of Caldwell
conducted observations and did not require the Engineer of Record to observe all parts of the construction.
T-O Engineers has partially observed the civil construction and hereby states that the public improvements,
as it pertains to Caldwell,appear to meet the general requirements of the plans and specifications. Observed
deviations from the plans are depicted in the submitted record drawings. All survey points depicted on the
final plat are in place. T-O Engineers has provided periodic observations of the construction and maintained
a log of the observations which has been submitted to the City.
The contractor hired Idaho Testing to test the compaction of all water, sewer,and pressure irrigation
trenches. All West Testing&Engineering was hired by the contractor to test the density of the roadway
subgrade, subbase,base course, and asphalt. The City.of Caldwell provided bacteria results indicating the
absence of E.coli and total coliform. Caldwell was provided all testing results and has relayed to T-O
Engineers that they have indicated suitable work.
The pressure irrigation pump station was completed per Steve Potts requests. Additionally,T-O was not
involved in the erosion and sediment controls for the project.
A representative from the City was on-site during portions of the construction and observed all Caldwell
infrastructure.

REVIEW AND APPROVAL CHECKLIST
About this form
• This checklist is optional to use and is guidance from DEQ to qualified licensed professional
engineers(QLPE).This checklist describes the required elements of a QLPE project transmittal letter
and is intended to assist DEQ in the tracking of drinking water and wastewater projects,as well as
assist the QLPE in reviewing and approving certain types of Plans and Specifications.
• This checklist should be filled out by the qualified licensed professional engineer(QLPE)when the
QLPE is reviewing and approving a project for construction under Idaho Code § 39-118(2)(d).If the
project requires DEQ approval prior to construction,the QLPE shall direct the Design Engineer to
submit the plans and specifications through the normal DEQ review process.
• This checklist may be used in place of a transmittal letter from the QLPE.
• This and other design checklists are available at any DEQ regional office or online at
http://www.deq.state.id.us/water/assist business/engineers/checklists.cfm.
• The other checklists include additional information about submitting a package of plans and
specifications for DEQ review.

III. PLAN & SPECIFICATION APPROVAL

extension(s), or both.No mechanical systems such as drinking water sources,treatment
facilities,booster stations, storage facilities, or wastewater systems such as lift stations
or treatment works are included with this project. **
D) This extension project will connect to:
1)Existing drinking water and/or wastewater mains owned by the Approving Authority.
OR
2) A future main(s)not existing at the time of approval. The future main(s)will be ❑
owned by the Approving Authority. In such cases, sanitary restrictions will remain in
force.
** Portions of a project that require DEQ approval must be approved by DEQ prior to the QLPE
approval of the drinking water or wastewater extensions.Alternatively,the drinking water and/or
wastewater extensions may be submitted to DEQ for approval of the entire project.

IV. SANITARY RESTRICTIONS
If the project includes drinking water and wastewater main extensions that will be.reviewed and
approved separately,the two Approving Agencies must coordinate the review and approval as it
pertains to the lifting of sanitary restrictions.

V. NOTE ON RULES AND STANDARDS
This checklist addresses the majority of common items from the Idaho Rules for
Public Drinking Water Systems (IDAPA 58.01.08),the Wastewater Rules(IDAPA
58.01.16,for QLPE approval of projects. However,this checklist is not all-inclusive,
and users are expected to fully understand the rules and standards,apply them
where necessary,and request interpretations from DEQ if there are any questions.
DEQ regional offices may have additional written information that will assist in the
design/approval process.

All responses indicated on the checklist above are accurately reflected in the attached Plans and
Specifications.
