PLAN: A plan of the proposed site for the special use shall be at- tached showing the location of all buildings, parking and loading area, traffic access and traffic circulation, open spaces, landscaping, refuse and service areas, utilities , signs and yards. A legal description of the land involved in the special use must accompany the plan. NARRATIVE: A narrative statement describing the use and an evalua- tion of the effects of the use on such elements as noise , glare, odor, fumes and vibration on adjoining property; a discussion of the general compatibility with adjacent and other properties in the district ; and the relationship of the proposed use to the Comprehensive Plan. COMMISSION EVALUATION: The Commission shall review the particular facts and circumstances of each proposed special use in terms of the following standards and shall find adequate evidence showing that such use at the proposed location: 1. Will, in fact, constitute a special use as established on the Official Schedule of District Regulations for the zoning district involved; 2. Will be harmonious with and in accordance with the general objectives or with any specific objective of the Comprehensive Plan and/or the Zoning Ordinance . 3. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential charac- ter of the same area; 4. Will not be hazardous or disturbing to existing or future neighboring uses; Special Use Permit -2- 5. Will be served adequately by essential public facilities and services such as highways , streets , police and fire protection, drainage structure , refuse disposal , water and sewer and schools; or that the persons or agencies responsible for the establishment of the proposed use shall be able to provide adequately any such services; 6 . Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; 7. Will not involve uses , activities , processes , materials , equipment and conditions of operation that will be detri- mental to any persons , property or the general welfare by reason of excessive production of traffic , noise, smoke, fumes, glare or odors; 8. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public thoroughfares; and 9 . Will not result in the destruction, loss or damage of a natural , scenic or historic feature of major impor- tance. o_F..IcL PL. 12� e/46'1/ Signature of Applicant This application together with the Plan and the Narrative shall be submitted to the Administrator on or before 5 : 00 p.m. on the Monday preceding the regularly scheduled Planning and Zoning Commission meeting on the third Thursday of each month. Any application not in the Administrator' s office by the above time will be scheduled and considered at the following month' s meeting. The Administrator reserves the right to not officially accept this application until total review is accomplished and all required information is submitted. PLANNING-ZONING COMMISSION HEARING DATE: ! - ACTION TAKEN: If approved, I intend to use my home residence (existing structure only) as a child day care center. Normal hours of op- eration will be 7 a.m. to 6 p.m. Monday through Friday, for fifty weeks of the year. A maximum of six children per day between the ages of one month and three years will be cared for by one adult, namely, my- self. Children will be transported to and from the facility in pri- vate vehicles by their parents or guardian. Due to staggered ar- rival and departure times, no :interference with existing traffic is anticipated. The facility is located within the city limits of Caldwell, and is presently provided with police and fire protection; city water, sewer and refuse pickup. Containers for refuse are located in an enclosure on the alley behind the building. Tight fitting lids and a retaining bar are provided to protect against unwanted spillage. Outdoor activities will take place when weather permits and will be confined to a fenced back yard directly behind the building. It is my opinion that the intended use of the property, as stated above, will not create a hazard or become a nuisance, _in any manner, either to neighbors, or to the general public. The apperance of the property or of the general area will not be affected in a detrimental way, and the intended use is not con- trary to the general objective of the Comprehensive Zoning Plan. Therefore, I respectfully request that this application for special use be approved. Kathern Sanborn 1520 Arthur Street Caldwell , Idaho 83605 Dear Kathern: As you are aware , your special use permit for day care in your home was granted by the Planning and Zoning Commission at their regular meeting Thursday , January 17 , 1985 , subject to conditions of number of children and business hours . I have discussed with the Mayor the $50 fee which the Commission agreed to lower from the usual $100 special use permit fee for this one-time-only situation , and he has determined that the fee is reasonable. This letter is to let you know that the $50 is payable at any time now and I will issue the special use permit upon receipt of the fee. I would lixe to compliment you and the other ladies for your pro- fessional attitude and the effort put into your presentations . The Commission would be interested in your comments and participa- tion in their discussions regarding possible ordinance amendments to bring day care up to date in the zoning code . This topic will be on the agenda in the next few months .
