ORDINANCE NO.3055
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL CHANGING THE SUFFIX OF
THAT RIGHT-OF-WAY KNOWN AS "MONTPELIER" FROM "WAY" TO "STREET"; PROVIDING
FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES,RESOLUTIONS,ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and City Council of the City of Caldwell,Canyon County,State of Idaho:
Section 1: That pursuant to the authority set forth in Idaho Code § 50-318 and in the Caldwell City Code at§
05-07-08(2), and upon the request of the Caldwell Mapping Department, that certain right-of-way platted as
"Montpelier Way" in Delaware Park Subdivision No. 2, Unit No. 2 at The Colonies, recorded in Canyon
County, Idaho as Instrument No. 2014005153 in Book 43 of Plats at Page 43, shall be changed to "Montpelier
Street"in order to comply with the preferences set forth in Caldwell City Code§05-07-04(3).
Section 2: The one property owner affected by this action has consented to this change being effective
immediately;therefore the effective date of this change shall be immediate upon passage of this ordinance.
Section 3: This ordinance is hereby declared to be severable. If any portion of this ordinance is declared
invalid by a court of competent jurisdiction,the remaining provisions shall continue in full force and effect and shall
be read to carry out the purposes of the ordinance before the declaration of partial invalidity.
Section 4: All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed, rescinded
and annulled.

RE: Change the Official Street Name Suffix for Montpelier from Way to Street
Date: May 11, 2016
Requested Action: Approve the attached ordinance
The right-of-way known as "MONTPELIER" as shown on the official plat for Delaware Park
Subdivision No. 2, Unit No. 2 at The Colonies has the suffix of"WAY". However, according to
Section 05-07-04(3) of the Caldwell City Code, a "WAY" is a street suffix designated for a
"street generally meandering in a north-south direction", while a "STREET" is defined as an
"east-west street generally running in a straight line". Since "MONTPELIER" is a straight line
east-west street in this phase and generally east-west in the adjacent phase currently being
constructed, the street suffix should be officially changed to the suffix of"STREET".
This action would require one address change. The owner has been notified and the owner has
consented to having the change become effective immediately, instead of waiting the 90 days
allowed in City Code.
Staff recommends approval of the attached Ordinance and requests that the change be effective
immediately.
