ADDITIONAL INFORMATION: The Planning and Zoning Director reserves the right to request additional information in specific circumstances in order to assist the Planning and Zoning Commission in reviewing the request. CCIM!MISSION EVALUATION: The Commission shall review the particular facts and Lireurnstances of each proposed special use in terms of the following standards and shall find adequate evidence showing that such use at the proposed location: 1. Will, in fact, constitute a special use as established on the Official Schedule of District Regulations for the zoning district involved; 2. Will be harmonious with and in accordance with the general objectives or with any specific objective of the Comprehensive Plan and/or the Zoning Ordinance. • 3. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; 4. Will not be hazardous or disturbing to existing or future neighboring uses; 5. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structure, refuse disposal, water and sewer and schools; or that the persons or agencies responsible for the establishment of the proposed use shag be able to provide adequately any such services; 6. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; 7. Will not involve uses, activities. processes. materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; 8. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public thoroughfares; and 9. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. Planning a Zoning Director CALDWELL,IDAHO 83605 TELEPHONE 455-3006 Ore To OO FAX 455-3003 Please note new phone no.455-3021 PLANNING AND ZONING COMMISSION ACTION REPORT Meeting of May 20, 1993 WHEREAS, the Planning and Zoning Commission on May 20, 1993 considered an application for a Special Use Permit to allow the development of a public park in the C-2 (Community Commercial) zoning district at the northeast corner of Kimball Avenue and Blaine Street. (City of Caldwell, Leadership Caldwell, applicant). WHEREAS, the Planning and Zoning Commission, after considering public testimony presented by interested persons and reviewing the particular facts and circumstances associated with the request, voted to approve the Special Use Permit application subject to the following terms and conditions: TERMS AND CONDITIONS: 1. That the Special Use Permit is granted for the development of a public park which is to be constructed generally in conformance with the concept Master Plan labeled Exhibit "A" in the record. 2. That, in the event the park facility is not completely constructed within two years after the approval of the Special Use Permit the permit shall be referred back to the Planning and Zoning Commission for further review and evaluation. FINDINGS OF FACT/CONCLUSIONS OF LAW: 1. An application for a Special Use Permit was properly filed for the project in accordance with the provisions of Section 6-4-4 of the Municipal Code. 2. The legal requirements were done in accordance with the procedure outlined in Section 6-4-4 (C) of the Municipal Code. Notice to the public was given on the Special Use Permit; property owners within 300 feet of the subject property were notified and a public hearing was held. 3. The proposed public park development was determined to be a special use in accordance with Section 6-6-3(C) of the Caldwell Zoning Ordinance. ACTION REPORT P.1 4. A public hearing was conducted by the Planning and Zoning Commission under the notice and hearing procedures outlined in Section 6-4-4 (C) of the Municipal Code. 5. The Agenda of the Planning and Zoning Commission was posted 48 hours in advance of the scheduled public hearing in accordance with Idaho Code. 6. Public testimony was given by the applicant. There was no opposing testimony. 7. The Planning and Zoning Commission, in reviewing the Special Use Permit, concluded that the proposal complies with the City's Comprehensive Plan in that: a. The Land Use Component and the Land Use Designation Map identifies Indian Creek as a greenway. b. The Natural Resource and Special Areas Component states as a policy that "the City will pursue opportunities to redevelop sections of Indian Creek by allowing for pathways, green areas and other pedestrian-oriented improvements. c. The Parks, Recreation and Open Space Component states as an objective that the City is "to utilize and take advantage of the Boise River, Indian Creek, and various irrigation canals to create parks, recreation areas and greenways". Also, this specific location is identified as a future park site on the Parks and Open Space Plan Map. 8. The Planning and Zoning Commission concluded that the proposed park will be compatible with the established development pattern of the area and will not adversely affect surrounding properties. The applicant is advised of the right to appeal the decision of the Planning and Zoning Commission. Written notice of such an appeal shall be filed in writing with the City Clerk within fifteen (15) days after the decision of the Commission in accordance with Section 1-26-5 of the Municipal Code. MOTION CARRIED The second public hearing concerned a Special Use Permit application to develop a public park at the northeast corner of Blaine and Kimball. Dennis reviewed the background to the request, reminding the Commission that the Park is a result of Idaho Transportation Department's project to stabilize Indian Creek and reconstruct Blaine Street along the frontage of the site. Marva Don Card,representing Leadership Caldwell, described the progress of the park, and the outstanding work to be done. In response to a question from Rita Earl, Ms. Card stated that the Transportation Department would be installing railings along the sidewalk and bridge shortly. Other features would be added as time permitted. In addition, the location of the waterwheel will likely move eastward because of stream hydrology limitations. Dennis reported that he had had discussion with Chief Sobba concerning security and that the Police Department would prefer as much visibility into the park as possible from Blaine, the alley and Arthur. Trees will be high canopy variety, and shrubs and low walls will not impede good visibility. The public hearing portion was then closed. MOVED by Wanda Anthony, SECONDED by Terry McConnell to approve the Special Use Permit subject to terms and conditions outlined in the Staff Report. An Amendment to the Motion was proposed by Rita Earl, SECONDED by Mary Higdem, stating that in the event the facility is not completely constructed within two years after the approval of the Special Use Permit the permit shall be referred back to the Planning and Zoning Commission for further review and evaluation. Public hearing set for May 20, 1993. PROPERTY CHARACTERISTICS: 1. The property is zoned C-2 (Community Commercial) 2. The Comprehensive Plan Land Use Designation is Commercial. 3. Surrounding land uses consist exclusively of a mixture of retail commercial-type uses. EVALUATION: A park is classified as a public/semi-public use and in accordance with Section 6-2-1, Table 1 of the Caldwell Zoning Ordinance, is a Special Use. In reviewing a special use, the 1 Commission may require higher standards of site development than listed specifically in the Zoning Ordinance in order to correlate the proposed use to other properties and uses. The availability of the subject property as a park site resulted from Idaho Transportation Department's project to stabilize Indian Creek and reconstruct Blaine Street along this frontage. The City recognized the potential of the location as a passive urban park site and through Leadership Caldwell contracted with Beck & Baird Landscape Architecture, Planning, Urban Design to prepare a Master Plan. Examination of the Master Plan reveals a site improvement concept specifically tailored to blend with surrounding buildings and the existing commercial development pattern of the area. Also, the proposed site design substantially exceeds all applicable City development standards and should be a positive enhancing addition to the downtown area of Caldwell. The proposal also complies with the City's Comprehensive Plan in the following areas: 1. The Land Use Component and the Land Use Designation Map identifies Indian Creek as a greenway. 2.
