The purpose of this agreement is to allow for the subject property to blend the two developments together rather than have a strip of land that is fenced off and become a maintenance problem for both properties. Mallard Development agrees that the subject property is owned by and is a part of the Leisure Village IX Assoc. development. Further,Mallard agrees that there is no intention for change of ownership in any manner as a result of the proposed landscaping and maintenance agreement. The following are the terms of the proposed agreement: 1. Mallard Development will install the irrigation system and sod to landscape the subject property to make it blend with both developments; 2. Mallard Development agrees to maintain the subject property in good condition for the life of this agreement; 3. Mallard Development agrees to not plant trees or install anything of a permanent nature without the written approval of Leisure Village IX Assoc. or their designee; 4. This agreement will end when and if either Leisure Village IX Assoc. incorporates the subject property into their development by relocating the existing fence; or, Mallard Development and Leisure Village execute an agreement of sale of said property. In the event of Leisure Village IX Assoc. taking control of the property, it is understood that the irrigation system will be disconnected and all existing landscaping will become the property and responsibility of Leisure Village IX Assoc. In fact,the City has issued building permits for all three four-plexes and we are awaiting a couple of final details prior to beginning construction. From the very beginning,even before we closed on the property, I worked closely with the various City Departments(who were very professional and helpful)to make sure our project met the City's guidelines for multi-family development. Specifically,I met with Ed in the Community Development Office to ensure our project could be built within the guidelines of the City's Comprehensive Plan and received approval;I met with the Engineering Department to discuss the culdesac that we must complete to City standards on Locust where it intersects the irrigation canal and we compromised on an acceptable design; I met with the Water and Sewer Departments to make sure there is adequate infrastructure to handle the additional load of our project and received approval;and I met at length with the Fire Department to design an emergency vehicle access into the project that met their approval,which I also received. All of the above agencies have signed off on our building permits in March of this year. In the meantime, I have been finalizing our financing,which is all private,and taking care of the details such as easements for the culdesac and the water and sewer lines prior to beginning construction. I have finally completed all of the details of our financing and am in the final stages of the easements for the culdesac and are within a week of beginning construction. On Wednesday,the 28th of May,I received a call from your Community Development Department telling me that our Permits were issued in error and I need to appear before the Planning and Zoning Commission to get additional approvals which may take up to an additional 30 days. I then met with Linda James and Robert Vasquez and they explained the details and we have reached an agreement that will allow our project to proceed while we appear before the P&Z in June. However, since I have tried from the early stages to do this project properly to meet all City requirements and recieved all approvals to meet permit requirements,I object to having to pay the $150 fee that is a result of the City providing erroneous information. Therefore,the purpose of this letter is to respectfully request a waiver from the City of the$150 fee for the Special Use Permit and Variance Applications that I now must submit to comply with the City's regulations. Project Description- Mallard Development has been issued building permits by the City of Caldwell to construct three four- plexes on a lot that is zoned R-3 and is located on Locust Street in the City of Caldwell. The project has been designed to fill the market niche of larger rental units than are currently readily available in the Caldwell market as all 12 units will be 3 bedroom,two bath apartments with approximately 1200 sq.ft. of living space. Mallard Development has arranged for private financing which means the units will not be government subsidized in any way. In addition,Mallard Development is building the project as a long term investment and plans to utilize quality materials and sub-contractors in order to have a quality product once construction is finished. The expected rental rates will be in the $675 to$700 per month range. Mallard Development has worked closely with the City's staff to make sure that the infrastructure is in place to support the project and that the project meets the City's Comprehensive Plan for density allowed in an R-3 zone. We have discussed the project with the City Forester to comply to the City's recommendations on trees and shrubs for landscaping and we are working with the Irrigation District to construct a new take out point in the canal for watering purposes. The common areas of the project will be landscaped and at the same time be used for storm drainage which has been reviewed and approved by the City's Engineering Department. We have a signed agreement with the owner of Leisure Village IX that allows Mallard to landscape and maintain a 35'wide piece of their property on our lot's east boundary which will allow for additional buffer between our development and our nearest neighbor. Public Benefit- This project will benefit the public in several ways. First,the subject property is currently a weed patch and is configured in a manner that makes it difficult to develop and meet all City requirements. Our project will complete the development on the north side of Locust and improve the appearance of the neighborhood significantly. Second,there is a real shortage of non-subsidized rentals for individuals and/or families looking for quality three bedroom,two bath living units. This project is designed to address that need directly. Third,as part of the project,Mallard is required to complete the culdesac on Locust where it dead-ends into the irrigation canal. With this improvement,access for emergency vehicles,as well as private traffic, will be greatly improved. Finally,it is our opinion that a market rate development will be a good community neighbor with the subsidized apartment complexes that currently exist on Locust and will provide the City of Caldwell additional housing options for its citizens. Adverse Effects- Since the project is being constructed in an area zoned R-3 and it meets the minimum requirements of the City's Comprehensive Plan and it has been approved by all applicable City and State agencies,there will be no adverse effect on the public interest. Box 426 Caldwell, ID 83606-0426 Dear Board Members, Mallard Development is proposing to construct three four-plexes on Locust Street in Caldwell immediately adjacent to your irrigation canal where it intersects Locust on the northwest side. As part of the City approval process, I am attempting to address the pressurized irrigation portion of the project. This letter serves as our request for a new take-out structure on your irrigation canal at its intersection with Locust Street in Caldwell. Attached for your review is a reduced copy of the site plan prepared by Earl and Associates. I met with Mr. Dave Lacer and he informed me that the current take-out structure for our piece of property is one street to the south of Locust and serves at least four existing apartment complexes. He wasn't sure how we would be able to tie into the system. I then met with Mr. Freeman and discussed the possibility of building our own take-out structure on our own property to simplify matters rather than getting all of the other developments involved. Mallard Development proposes to design and construct, at our expense, a new irrigation box at a location to be approved by the District for the purposes of providing pressurized irrigation for our proposed project. I have contacted Earl and Associates(the engineers for our development)and they have agreed to provide the additional engineering for the irrigation structure. And finally, we propose to work closely with the District to construct something of a temporary nature until the water is turned off in the fall at which time we would construct the permanent structure. As part of that development,we need to provide a source of irrigation water from the canal that also serves the church. On several occasions, I have met with Mr.Portenier and Mr.Dave Lacey,the Ditch Rider for the irrigation company. Given the limited options,we have agreed that the best source for water would be for Mallard Development to tap into the existing overflow box that is located approximately 3 feet from our property line on church property. I have provided the engineering drawing to Mr.Portenier for his review and approval. The purpose of this letter is to relieve the church of any responsibility for damage that may be caused to the irrigation box during the process of drilling a hole for our main line. Although none is expected, should any damage occur,Mallard Development will be responsible for any repairs that may be required to return the box to its current condition. I also have provided a copy of our liability insurance coverage to the Church office in Boise to further protect the church in case of any accident or problem. This letter will also serve as notice that the Irrigation Co. agrees that this is the best option for providing service to the Mallard Development project and they have reviewed the plans and approve of the work to be completed.
