HomeMy WebLinkAbout1980/08/21 P&Z MINUTES PLANJING AND ZONING COMMISSION MINUTES August 21 , 1°d0 The meeting was called to order at 7 : 30 p . m . in the City Hall Council Chambers by Chairman John Pilote . Present were Starr Far- ish , Bob Carpenter , John Hull , and Tom Ensley . Also attending were Mel Lewis and Alta Williams . John Hull and Tom Ensley moved and seconded to dispense with the reading of the July minutes and ap- prove them as written . Motion carried . Since there was not a quorum present , the Commission was unable to take action on anything requiring a vote . The public hearings were held to take testimony with the understanding that; no deci- sion would be made until a later meeting when a quorum could be assembled . Pilote indicated he would try to call a meeting in the next 7 to 10 days . The first public hearing was over Comprehensive Plan considerations • and a proposed zoning of M-1 light industrial for a part of the Harris farm which was inadvertently omitted from the annexation proceedings on property near the Caldwell Industrial Airport which were recently completed . This land lies in the Northwest Quarter of Section 31 east of the Caldwell Ilighiine Canal . The considera- tion would be to add it to the M-1 zone as is the rest of the prop- erty owned by the same owner . Pilote opened the hearing to take testimony . There was no discussion from the audience so the hearing was closed . emN The next public hearing was for a special use permit for a community service center to be constructed adjacent to and on the Seventh Day Adventist Church property at Linden and Indiana . Art King was recog- nized and said the building was to be used as a welfare center to distribute clothing and goods to the needy in the community . He further stated there would be a multi-purpose area for stop smoking clinics , health cooking clinics , etc . Mr . King said the church did have one request and that was to be permitted to put in a septic tank as opposed to attaching to the sewer which was some distance away . The church is on the sewer . He did want the Commission to understand that they did not want this issue to be a condition of their getting the permit . As there was no further testimony from the audience , the public hearing was closed . The last public hearing was on a request by John Tegge for a variance to construct an 1 , 380 square foot garage on the back of the lot at the corner of 3rd and Everett which would extend to the property line on the 3rd Avenue side . The building would be about 20 feet back from the curb and on the alley line . Mr . Tegge explained he wanted the structure situated in this way to prevent a lot of maintenance and extra upkeep it' strips of ground were left . He pointed out that a C-3 Commercial zone was directly across the alley and his request would be permitted in that zone . There was no testimony from the ,-Naudience and the public hearing was closed . The Commission discussed a request from Cam Gepner to rezone his property at 016 Ithaca Street to C-3 Commercial . It was the opinion of those present that a Plan change would be required first for the entire block (which was next to the property owned by Lonnie Spath -2- and Jerry Sedlar that was recommended for a flan chance to frame and service commercial ) and will be forwarded to the City Council eigN after August 21 . It was decided to postpone forwarding the recom- mendation until a hearing could be held on Mr . Gepner ' s request . To be included in the Plan change consideration also is the south- westerly half of Block 32 of Golden Gate Addition and the property adjacent to Mr . Sedlar ' s . All of these properties border the fron- tage road which parallels the interstate . A public hearing was established for September 13 . The Commission also established a public hearing on September 13 for the following : A special use permit to exceed the square footage on a sign to be located on the Bill Gilbert property at Chicago , Linden and the Interstate . Applying for the permit was Pete Waller of Signs , Inc . , whose request was for a 12 ' by 40 ' double faced bulletin which will be situated on the northerly corner of the property . A special use permit requested by John Hjelter to construct a residence in the C-3 commercial zone on Lake Avenue behind the present Idaho Septic Tank Company . He has purchased the building to be used for his precision tool and die shop and wishes to live on the property . A variance will be required for a setback greater than the maximum of 55 feet . A variance requested by Florence T'rudell to construct a resi- ndence on Lot 13 , Block 3 of Sylvan Manor which will extend 3 feet into the 20-foot rear setback . On the agenda but not considered by the Commission were the prelim- inary plat of Treasure Valley Townhouses , Southdale Apartments ' request to renew their special use permit with some alterations , and a plat of Block 74 and 75 of the Canyon Hill Cemetery . Briefly discussed was the division of the existing duplex at 2516 College Avenue which is being requested by Gary Mitchell . Mr . Lewis reported the staff investigated the situation and found that both entrances of the duplex do not face a right-of-way . Access to the rear living unit is from the alley and it appears to be isolated from access off of College . The Commission was asked to look at the property to see if separating ownerships might create problems . Another discussion item was a request by ShaRee Skinner of Treasure Valley Gymnastics Academy for an interpretation of gymnastics school as it is not listed as such in the Land Use Table in the zoning code . She has found a location in the M-1 zone on Arthur Street adjacent to Quality Wholesale and would like the Commission to consider the proposed use in that zone . She was asked to furnish a plot plan and to appear at the next meeting of the Commission for further discussion . The State is still looking for input on the Land Use Planning Act ,00-441 amendments . A copy of proposed amendments was mailed to Commission members for their comments . Mr . Lewis said anyone who wishes could submit suggestions to his office or directly to the State and he will reply to them in the near future .
