September 3 , 1980
The meeting was called to order at 12 : 00 noon in the City Hall
Council Chambers by Chairman John Pilote to reconvene the August
21 meeting . Present were Starr Farish, Ralph Nyblad , Betty Ann
Lodge , Bud Grant , John Hull , Bob Carpenter , Tom Ensley , Boyd
Henry and Mel Lewis .
The first order of business was ratification of actions taken at
the August 21 meeting in the absence of a quorum . These were to
set public hearings as follows :
A Comprehensive Plan change for possible future rezoning
on Ithaca and Hannibal Streets .
A special use permit to exceed the square footage on a
bulletin sign to be located on property at Chicago , Linden
and I-84 .
A special use permit to construct a residence in the C-3
zone on Lake Avenue .
A variance to encroach into the rear setback on Lot 18 ,
Block 3 of Sylvan Manor .
80-8-1 It was moved and seconded by John Hull and Betty Ann Lodge to ratify
these actions . Motion carried unanimously.
A public hearing was held August 21 on Comprehensive Plan considera-
tions and a proposed zoning of M-1 Light Industrial prior to annexa-
" N tion of part of the Harris property near Caldwell Industrial Airport .
No testimony was received at that time . Mr . Lewis pointed out that
a determination has to be made that the Plan as now defined includes
this area due to the flexibility of Plan lines . The area being con-
sidered is approximately 3 acres and is adjacent on the northeast
to the Harris property which was recently annexed . The Commission
would have to interpret that this piece falls within the industrial
area since the Plan lines are indefinite . Mr . Lewis indicated that
the property may or may not be in the impact area, but in discussing
it with George Ottens it was Ottens ' feeling there was nothing to
prevent the City from annexing outside the impact area . The staff
report is as follows :
Present use of the land itself and adjacent lands is agri-
cultural . Sewer is not available . City water is a mile away
at the airport . It is attached to the annexed area to the
south and the use would be an extension of the area presently
in the City limits and access is through the adjacent tract .
The City doesn 't anticipate programming public funds for its
development at this time . The property is part of lands al-
ready annexed and its intended use is to be a part of the
development of that .area . Since it is delineated by a canal
on the north and west sides , topographically it should be a
part of the land to the south and , therefore , should be dev-
eloped with it . On this premise it should be annexed .
After a discussion , it was moved and seconded by John Hull and Bob
Carpenter that a Plan change would not be required as Plan lines
do not specifically define this area and the intended use of the
land would be the same as that of the adjacent property to the
