HomeMy WebLinkAbout1979-07-19 P & Z MINUTES PLANNING AND ZONING COMMISSION MINUTES July 19 , 1979 The meeting was called to order at 7 : 30 p.m. in the Council Cham- bers by Chairman John Pilote. Present were Ralph Nyblad, Starr Farish, John Hull, Bud Grant and Bob Nicholes . Also attending were City Council members Ken Hopper and Alta Williams. Bob Carpenter arrived later and was counted present. Starr Farish moved to dispense with the reading of the June 21 minutes and approved them as written. John Hull seconded the motion. Motion carried. Opened first was the public hearing for a special use permit requested by Bill Gilbert to operate an auto salvage pool on his recently annexed property in the vicinity of Chicago, Linden and I-80N. Darwin Feller, 321 N. Georgia, was recognized and stated that he has property at the corner of Linden and Chicago and was concerned about how the proposed use would affect his plans for the property. He might have some objections depending upon the nature of the operation. Jack Harris indicated that he had an interest in property close to Mr. Gilbert ' s but had dis- cussed the business with Mr. Gilbert and felt that it would be an asset to the area. At this point Mr. Gilbert explained that he would not be operating a salvage yard where vehicles are dis- mantled but would in a sense be recycling wrecked automobiles on a monthly basis by accepting bids on them. Feller said he es had misunderstood the intended use and requested that he and Mr. Gilbert meet to discuss the details. The gentlemen were excused from the Council Chambers. Action on this issue was postponed pending their return. Opened next was a public hearing for a special use permit to move a house onto property at 3rd and Arthur in a C-3 Commercial zone and attach it to an existing residence for a duplex or two- occupant dwelling. The permit was requested on behalf of George Randall . Two variances will be needed as a condition of granting the special use permit. Only one parking space can be provided instead of two as required and the square footage of the corner lot is less than 7 , 500 square feet. Ray Loosli informed the Com- mission that the house is being equipped for rent to a handicapped person so parking will not be needed. After a discussion, Bob 79-7-1 Nicholes and Bud Grant moved and seconded to grant the special use permit with the two variances . Motion carried. The public hearing on a request for a variance to locate a sign 6 feet inside the property line rather than 10 feet as specified in the ordinance was called to order. Altha Bish has applied for the variance as the sign identifying her professional office at 802 Fillmore would be obstructed by an offset in the structure of the building and by a roof overhang on the Kimball Avenue side . Hearing no testimony from the audience , Pilote closed the public "N-7-2 hearing. A motion was made and seconded by John Hull and Bud Grant to grant the variance. Motion carried. -1- r -2- Scheduled next on the agenda was the public hearing on rezoning Lots 1-4 , Block 1 and Lots 1-5 , Block 2 of 0. T. Sanders Subdi- es vision from R-1 to R-3. The Comprehensive Plan has recently been change from Low Density Residential to High Density Residen- tial to provide for this rezoning. John Pilote read a letter from the Department of Health and Welfare which was a directive to the staff restricting parking to certain areas to abet the traffic situation to and from the office from Kimball Avenue. Since there were no objections to the rezoning voiced, Pilote 79-7-3 closed the public hearing. It was moved and seconded by Starr Farish and John Hull to recommend this zone change to the City Council . Motion carried. At this time Darwin Feller and Bill Gilbert returned and Mr. Feller stated he wished to withdraw his objections to the auto 79-7-4 salvage pool proposed. A motion was made and seconded by Starr Farish and Bud Grant to approve the special use permit for Mr. Gilbert. Motion carried. Public hearing for consideration of an R-3 zoning for Lots 1-12 , Block 28 of Dorman' s Addition on Cleveland between 12th and 13th Avenues was held. Letters requesting that the half block remain commercial and signed by J. C . Weaver Company and Weldon Wight , property owners in the half block, were read. Testimony favoring an R-3 zoning was presented by Steve Marshall , 1515 Everett; Vernon Smith, 1213 Cleveland Boulevard; John Carr, 1416 Cleveland; Jess Pedersen, 1308 Cleveland; Don Winbigler, 1323 Cleveland; Joe Ferney, 1406 Arthur; and Stella Dwinell. Wally Frank of 13th and Cleveland, property owner in the half block, stated he was opposed to the zone change and would like his property to remain 79-7-5 commercial . Following a discussion, Starr Farish moved that, inas- much as the Commission has sent a recommendation back to the Council at their request to amend the Comprehensive Plan to designate the half block in question as High Density Residential and the Council has approved this change , a recommendation be sent to the City Council to rezone the above-described property from C-2 to R-3 in compliance with the Comprehensive Plan that is now in existence and to satisfy the greatest number of people . John Hull seconded the motion. A discussion followed, after which John Hull called for the question. Result of the voting was 2 in favor, 1 opposed and 2 abstained. Motion carried. Everett Purcell was not present to discuss a variance for a second building permit on property at West Oak and Parker. Jackie Dooms appeared before the Commission seeking a special use permit for a home for the elderly at 1808 Cleveland Boulevard. She has 7 residents at her present house and would like to pur- chase the Cleveland residence and increase her boarders to 9 . She indicated her occupants do not receive medical care or psy- chiatric counseling but have their own outside activities and live in a rooming-house situation. When asked about fire exits , she said these would have to be provided. Parking requirements "'9-7-6 can be met. John Hull moved that a public hearing be set for August 16 for consideration of the special use permit request. The motion was seconded by Bud Grant and, after a vote , passed. -3- An application for a variance has been submitted by Jim Schelhorn " . to divide Lots 11-15 , Block 76 of Mountain View Subdivision No. 2 at the corner of Walnut and Iowa into two lots or separate proper- ties. The site is owned by his mother who lives in an existing residence and rents another house on the property. She wishes to divide her land and sell the rental to another owner. A fence separates the two houses dividing the frontage into 77 . 82 feet for the inside lot and 52 . 19 feet for the corner lot. The lots are 140 . 29 feet deep. Square footage for the corner lot would be approximately 7321 sq. ft. and therefore a variance would be re- 79-7-7 quired for a substandard corner lot . John Hull moved that a public hearing be set for August 16. The motion was seconded by Bob Carpenter. Motion carried . Discussed next was a proposed planned unit development on South Montana Avenue south of the high school. James Gipson explained the project to the Commission and pointed out that the number of units had been reduced from 55 to 49 by removing the upper story from the units on Montana and on the south side of the project thereby graduating the higher density to the interior. Planned are nine 1-bedroom units, thirty-one 2-bedroom units and nine 3-bedroom units and there will also be units for handicapped persons . The only point of access will be from Montana Avenue with a drive that goes back through the project . Landscaping will retain the trees along the south and west and there are plans to buffer the north from the high school and the south from whatever residential development might occur there in the future . Sewer will have to be brought in from about two blocks away and may be made available for others. Reaction of the Commission to the project was generally favorable and a public 79-7-8 hearing was set for August 16 . A motion establishing the hearing date for a special use permit was made and seconded by Bud Grant and Ralph Nyblad. Motion carried . Caldwell Realty has applied for a variance to construct a resi- dence on Lots 23 and 24 , Block 117 of Strahorn Addition at 5th and Everett. The residence will extend 10 feet into the rear setback. The building site is 50 feet by 120 feet and existed as a lot of record when the ordinance was passed in 1977 . There is an established setback of 14 feet on 5th and 30 feet on Everett and the builder desires to face the residence on 5th. 79-7-9 A public hearing was set for August 16 as moved and seconded by Bob Carpenter and John Hull . Motion carried. No one was present to discuss the rezoning of the Pop-A-Top Tavern. organization The Senior Citizen Center/is contemplating an expansion on the rear of the existing building for storage. The addition would be built to the alley line on alignment with the Employment Agency which is adjacent . A variance is needed for no rear setback 79-7-10 to extend the structure 13 feet to the alley line. It was moved and seconded by Bob Nicholes and John Hull to set a public hearing on August 16 .
