Present were :Marr Parish, John Hull, Ralph 1yb lad , Bud Grant , Boyd Henry , and Mel Lewis . Mr. Lewis asked tnnt a notation be entered into the minutes regarding the Lee Gamble re:idence at 2310 Ellis . Mr. Gamble appeared before the Commission on August 13 , 1977 , seeking a variance on the side setba k for purposes of remodeling the residence . This was resclved without the variance being needed. At the time no maximum front setback was specified and since the house exceeds the 5(a-foot maximum now defined by ordinance , it was decided to permit the remodeling of the residence under the conditions of the former ordinance. The situation should be reviewed if any further plans are contemplated for the property . A motion to accept the decision of the Engineer in issuing a building permit was made and seconded by Starr Farish and John Hull . Motion carried. The City has requested a variance to divide City-owned property at ',Freeport and Kimball with dimensions of 125 feet by 120 feet into two lots for sale . The property could be divided evenly into 62 . 5 foot lots or into a corner lot of 75 feet and inside lot of 50 feet . Hither way , one lot would be substandard and would require a variance. 7 )-5-1'J John Hull moved that a public hearing be set for June 21 and a recommendation be made indicating that the Commission prefers the eNN 75-50 . Starr Parish seconded the motion which , after a vote , carne., . Discussion w: .; :101(1 on a special use permit requested by Judd Lanham to construct six-plexes in a part of Tract 0 of Mountain View Subdivision. The permit would be granted subject to the following: 1 . Forte-foot right of way for Alder. The border street policy would apply . 2 . A variance from the subdivision ordinance for no cul-de-sac . The street would dead end. 3. A variance for one parking space per unit (12 instead of lb required) . 4 . Platting for sale under condominium concept . 7)-5-11 A motion to set a public hearing for June 21 with the conditions as stated above was made and seconded by John Hull and Bud Grant . Motion. carried . Lorraine Johnson appeared before the Commission requesting a special use permit to divide the duplex at 1707, Washington and 1104 Logan for sale to individual owners . Ar or survey defining the pro- perty in two separate units will be required. Separate water meters and a recorded sewer maintenance agreement that stipulates the respon- sibilities of both owners are to be provided. Motion carried. lybldiscussion, a ad to estab- -1- -2- Tie vacation o;' 16th Avenue north of Male ,street has been requested by Mrs . kstei_le bottoms , 1601 Main , who wishes to construct a garage behind her house. The adjacent property owners , Ray and Esther Rock- eqN well , have agreed to the request for the vacation. The street is platted through Indian Creek and Mr. Lewis explained it is doubtful that a creek crussi.ng would ever be made there . He did point out that although there are no utilities in the right of way proposed to be vacated , the City would want to obtain a 20-foot utility , irrigation and storm sewer easement 10 feet on each side of the cen- terline . No building would be permitted on the easement . Bud Grant 79->-13 moved that a recommendation be sent to the City Council to proceed with the public hearing and approve the vacation with the 20-foot easement . The motion was seconded by Starr h'arish and passed. Val Feller and Job nogg were not present to discuss their requests . A public hearing was set for June 21 to rezone the Lasher property between the Interstate Highway and Indian Creek northwesterly from Ustick Road from M-1 Light Industrial to R-3T Residential . A motion 7)- 5-14 to set the hearing was made and seconded by dud Grant and John Hull . Motion carried. Mr. Lewis informed the Commission that he had discussed the right of way-setback situation for the retirement center with Gary Lasher and they have agreed that the buildings will be set back 28 feet . Mr. Lasher will give a 23-foot easement upon which no building can occur. Then if the right of way is needed at a later date and the adjacent property owner provides his half , the 28 feet will have emN been preserved. A 10-foot utility easement along the south half of the west side will also be given. Ralph Nyblad moved and Bud Grant seconded the motion to amend the action taken by the Commission on May 17 requiring dedication of a 28-foot right of way to the granting of a 28-foot easement on the north half of the west side of the develop- ment and a 10-foot utility easement on the south half of the west side.
