HomeMy WebLinkAbout1979-02-15 P & Z MINUTES PLANNING AND ZONING COMMISSION MINUTES February 15, 1979 The meeting was called to order at 7 : 30 p.m. in the Council Chambers by Chairman John Pilote . Present were Betty Ann Lodge , Ralph Nyblad, Starr Farish, Bob Carpenter, Bob Nicholes, Tom Ensley, Bud Grant and John Hull. Also attending were Council Members Alta Williams and Ken Hopper. Before proceeding with the regular business of the meeting, John Pilote made a statement regarding a request by Mrs . Audrey Birnbaum and Mrs. Gen Pedersen concerning an issue that was placed on the agenda. The item deals with the Comprehensive Plan and zoning of the half block located on Cleveland between 12th and 13th. After serious considera- tion, Pilote said , he wrote a letter to them stating as this matter is now pending before the City Council , it would be inappropriate to place it on the Commission' s agenda for discussion at this time . He further commented that the Commission is not attempting to keep from discussion something that is of interest to the citizens; however, the City Council has taken the recommendation by the Commission and has held a public hearing. The public hearing; portion is over and a decision now rests with the Council . Pilote informed the members that they have the right to appeal the ruling by the Chairman to exclude the item from the agenda. Starr Farish indicated he would like to appeal the decision and moved that the item be brought up for consid- eration. Betty Ann Lodge seconded the motion. Much discussion ensued, during which several members declared they would be very willing to emN reconsider the issue if it were referred back to the Commission by the City Council. The question: "Should the decision of the Chair 79-2-1 be sustained?" was then brought to a vote. Six were in favor and ' opposed. Motion carried. The report on a request for a special use permit to store chemicals in a building at 14th and Denver and for a setback variance was deferred until the March meeting. Mr. Leon Search was not present to discuss his request for a variance to create a substandard corner lot at College and Cherry. A request to annex approximately 11 acres near Interstate 80N, Chicago and Linden has been submitted to the City and referred to the Planning and Zoning Commission for a zoning recommendation. The property is designated as industrial on the Plan and is adjacent to M-1 Light Industrial zones . The owner expressed his intentions to use the property for a small truck terminal , the development of commercial rentals and expansion of the sales area of the Idaho Salvage Pool operation. These uses would be compatible with M-1 zoning. It was 79-2-2 moved and seconded by Tom Ensley and Bud Grant to set a public hearing for March 15 for consideration of the proposal to zone the property M-1 Light Industrial upon annexation. Motion carried. Next on the agenda was a request from the County for a recommendation on the placement of a mobile home for classroom purposes at the Free Methodist Church. The church property is located at Spruce and Montana, just adjacent to the City limits . The mobile home is to be on a tem- porary basis until permanent facilities can be constructed. The County does allow this type of arrangement on a temporary basis , inspects the f � 4 units annually, and requires the permits to be renewed on an annual 79_2-3 basis. It was moved and seconded by John Hull and Bud Grant to approve the request for the mobile home and to forward a recommenda- /' tion to the County. Motion carried. Considered next was a request by Jack Stites to obtain variances for setback and for issuance of a second building permit in less than a year to install a mobile home on his property on East Chicago. There are an existing residence , a mobile home, and the foundation for another house already on the property. Mr. Stites informed the Commission that the additional mobile home will house family members as do the other dwelling units . Placement of the mobile home would be such that it would not face on a right-of-way and access would be from a private lane. A variance is required to set the unit back a greater distance 79-2-4 than specified by ordinance. After some discussion, Bob Carpenter moved that a public hearing date be set on March 15 for the setback variance . The motion was seconded by Tom Ensley and, after a vote , carried. A recommendation to the Council on the building permit will also be considered at that time. A public hearing was also set on March 15 to consider an R-1 Residential zoning prior to annexation of 10 acres east of Feller 79-2-5 Manor owned by Bob and Helen Feller. A motion establishing the hearing date was made and seconded by Tom Ensley and Betty Ann Lodge. Motion carried. Pilote announced a community workshop sponsored by the University of Idaho on "Coping with the Impact of Growth" to be held on Feb- ruary 21 at the County Courthouse.
