January 18 , 1979
The meeting was called to order at 7 : 30 p .m. in the Council Chambers
by Chairman Don Tolley. Present were Starr Farish, Jim Oates , John
Hull , Bob Nicholes and Mel Lewis . Jerry Weston, new Commission mem-
ber , was introduced . Also attending were City Council members Alta
Williams , Marilyn Bauman and Ken Hopper.
Starr Farish and John Hull moved and seconded to dispense with the
reading of the December 21 , 1978, minutes and approve them as written .
Motion carried.
Since not enough members were present to conduct a reorganization
79-1-1 of the Board, it was moved and seconded by Starr Farish and Jim Oates
to postpone reorganizing until more could attend. Motion carried.
Don Tolley opened the public hearing on a special use permit requested
by George Randall to move a residence onto property in the C-3 Commer-
cial Zone near Blaine , 2nd and 3rd to be joined onto an existing
house . Hearing no testimony, Tolley closed the public hearing. A
motion was made and seconded by Bob Nicholes and Starr Parish to
79-1-2 grant the special use permit as requested. Motion passed.
The final plat of Allen Estates was then submitted for consideration.
Mel Lewis pointed out that the sewer design prepared anticipates that
the sewer is above rock and, if the City is going to put in the sewer,
ea) rock removal will not be included in the $750. 00 per lot connection
charge . Street and drainage designs have been filed with the Engineer-
ing Department and approved. Following the Engineer' s comments , John
79-1-3 Hull moved and Starr Farish seconded the motion to recommend the ap-
proval of the final plat of Allen Estates to the City Council subject
to the rock removal specification and to all of the stipulations
attached to the preliminary plat . After a vote , the motion carried .
Ron Blakley of Blakley Engineers appeared before the Commission with
a revised preliminary of a plat of Carol Subdivision. He noted that
subsequent communication with the adjacent property owner to the east
had resulted in that owner' s participation in the plat . Carol Avenue
is now located where it should be without an offset and with the stan-
dard 56 ' right-of-way . The extension of Carol Avenue to Elm Street
is only 50 feet so a variance will be required for that section.
The rest of the adjacent property is now included around the short
cul-de-sac and to the east . Mr. Blakley also requested the vacation
of 6 feet of a 16-foot sewer easement on Lot 9 , Block 1 . Following
79-1-4 a discussion , John Hull moved that the approval of the preliminary
plat of Carol Subdivision be recommended to the City Council with
the conditions as outlined in the City Engineer' s report. These
conditions are : 1. The half-street policy for imrpovements will
apply to Logan. 2 . Curb , gutter and sidewalk are required on Carol
Avenue in the 50-foot section. 3. The irrigation plans will be ap-
proved by Pioneer Subdivision. 4 . All improvement and utility
designs , certifications and field work are to be the responsibility
eIN of the developer ' s engineer and must be approved by the City. 5 . A
map of utility locations shall be furnished to the City after the
location meeting. 6 . A variance will be granted for a 50-foot right-
of-way for extension of Carol Avenue out to Elm Street. The motion
was seconded by Starr Farish and, after a vote , carried.

7971-5 Jim Oates and John Hull then moved and seconded to forward a recom-
mendation to the City Council for the vacation of a part of the sewer
easement on Lot 9 , Block 1 of proposed Carol Subdivision. Motion
passed.
Reviewed next was the final plat of Industrial Site No . 4 , which lies
along the Interstate for a half mile near the Franklin Road interchange .
The plat was approved for septic tanks provided 100% of the required
area for the drainfield was set aside for enough area for two drain-
fields and also with the provision that no impervious material such
as asphalt or concrete would be placed over the drainfield area.
Documents which have not yet been received are an avigation easement
and association documents for maintenance of the drainage ditch along
the southwesterly side . Ron Blakley informed the Commission that the
papers have been prepared and are being reviewed by the attorney .
79-1-6 Subject to receipt of the required documents , it was moved and seconded
by Jim Oates and Jerry Weston to recommend the approval of Industrial
Site No . 4 to the City Council. Motion carried. Bob Nicholes abstained
because of a conflict of interest .
The Chair recognized Mr. Judd Lanham, owner of the mobile home park
at 3009 S . Indiana Avenue ( formerly Nick ' s Mobile Manor) , who stated
that he would like to expand the park onto property which he owns
directly to the north . Mr. Lewis prefaced the discussion by pointing
out that the zoning for the area is R-2 Residential and , therefore ,
the park now exists as a non-conforming use . In order to change the
zone to accommodate expansion of the park , the Comprehensive Plan
would have to be changed and this would be not sooner than 6 months
from the time the City Council acts on proposed changes which are
now pending. The City would be interested in obtaining right-of-way
for Alder Street from Indiana to connect with the part that is extended
west from South Georgia. The Commission has previously discussed ac-
cepting a narrow 40-foot right-of-way through the tract with an offset
at the east end of about 20 feet . According to Mr. Lanham, he is
willing to sewer the area into which the park would be expanded and
eventually to sewer the existing mobile homes. He is not , however,
giving any consideration at this time to Alder Street , and he also
indicated the other property owners involved would not give any right-
of-way. It would be his intention to provide access to the area by
means of a private lane . An alternative open to Mr. Lanham for util-
izing the property would be for medium density multiple-unit dwellings ,
and he stated he had given some thought to four 3-plexes. He did want
to know if he deeded a 40-foot right-of-way to the City , would the 40
feet be excluded from the area he has to build on. After further
discussion, Mr. Lanham said he would examine the alternatives and
get together with Mr. Lewis on placement of dwelling units on the
property .

the Board .
