HomeMy WebLinkAbout1978-10-19 P & Z MINUTES PLANNING AND ZONING COMMISSION MINUTES October 19 , 1978 The meeting was called to order at 7 : 30 p .m. in the Council Chambers by Chairman Don Tolley . Present were Starr Farish, Jim Oates , Bob Carpenter, John Hull , Betty Ann Lodge, Al McCluskey and Mel Lewis . The minutes of the September 21 meeting were read and approved as written. Don Tolley opened the public hearing section of the meeting and announced to the audience that any decisions made by the Planning and Zoning Commission can be appealed to the City Council . First on the agenda was a variance requested by Dr . Herman Sakimoto and Dr. Hal Mickelson to extend a joint professional office building 10 feet into the 20-foot rear yard. The building will be located on Kimball Avenue near Arlington between the Memorial Park Baptist Church and the Idaho Migrant Council Clinic . A letter was read by Mel Lewis from Lee and Virginia Hayes of 1306 Arlington Avenue, adjacent property owners , who stated they made no protest to the granting of the variance . As there was no further testimony , a 78-10-1 motion was made and seconded by John Hull and Jim Oates to grant the variance. Motion carried. Opened next was a public hearing for consideration of a special use permit to allow separation of ownerships of an existing triplex emN at 1916 S. Montana Avenue for sale as individual units . The units will be called El Mon Townhouses and are subjected to platting, filing of association documents governing common areas and interests , and meeting the building codes . The Chair recognized Tony Neumeister who presented a petition with signatures of 12 property owners op- posing the special use permit . Reasons cited were that a precedent would be set for more townhouse development and more traffic would be created on Montana. Speaking in favor of the project were Tom Cole of Alpha Engineers and Boyd Harris . During the subsequent discussion it was pointed out that since no additional units were being considered, traffic would probably remain the same . The number of occupants also was not likely to vary a great deal and, therefore, the Commission felt the proposed division of ownership 78-10-2 would not be a problem to the neighborhood. John Hull moved that the special use permit be granted and the motion was seconded by Bob Carpenter. Motion carried. Starr Farish abstained since he lives in the area. Public hearing for variances to move a house 50 ' x 27 ' onto a lot 75 ' x 60 ' ( 4 ,700 sq. ft . ) which will extend 15 feet into the rear setback was opened. The property is the northeasterly half of Lots 9 , 10 and 11 , Block 10 of Golden Gate Addition and is in the vicinity of 2nd and Elgin. No testimony was offered from the au- 78-10-3 dience on the request . Starr Farish moved that since there was no objection, the variance for lot size and the variance for the eiNi setback be granted. Motion was seconded by Jim Oates and, after a vote , passed . -1- -2- Held next was a public hearing for a special use permit to construct duplexes on six corner lots in Third Parkside Addition. Application was filed by Boyd Harris and Park West Corporation. Mr. Lewis stated that this is an R-1 Residential Zone and the placement of the duplexes is such that they are separated by a minimum of 75 feet from the pro- perty lines . Following his comments , testimony was offered from the floor. Art Collins of 307 Woodlawn submitted a petition which he said represented 38 households , all objecting to the granting of the special use permit . He asked that it be entered into the record that the developer has moved ahead with construction before issuance of the special use permit by ordering excavation on one of the lots . He further inquired what action the Commission would take in this instance . There was some discussion on this question and Mr. Lewis remarked that on occasion the Building Department has allowed ex- cavating to be done before a building permit was obtained . This has been done with the full understanding that the developer was cognizant of the risks he was taking and that he might be required to fill the excavation back in. In no event was there to be concrete poured or foundations laid before the building permit was issued . Boyd Harris was recognized and outlined his development plans for the whole area , including proposed Park West Addition. According to Harris , it was not his intention to create a "slum" but to provide housing in a range young couples could afford. Al McCluskey pointed out that Mr. Harris is going to place residences on 40 lots in Third Parkside Addition and that the duplexes would add only 6 additional occupan- cies to the development . Other inquiries for discussion were then presented by Judy Collins , Evelyn Martin, Margaret Gilmore and Charles Holton, and Mel Lewis read a letter from Mark and Connie Binyon of 1114 Woodlawn protesting construction of the duplexes . 78-10-4 After further debate, it was moved and seconded by Bob Carpenter and Betty Ann Lodge to grant the special use permit for the 6 du- plexes . Motion carried. Public hearing was opened for a special use permit requested by Hazel Park Associates to construct a 40-unit senior citizen complex three stories high on Ellis Avenue between Elm and Hazel Streets . The special permit is to increase the density . As there were no 78-10-5 objections voiced, Starr Parish moved approval of the special use permit . Motion was seconded by John Hull and carried . The preliminary plat of Laurel Mobile Home Estates Subdivision lo- cated on the old airport property was presented by the City Engineer with the following report : The subdivision is between Laurel Street , Garber Street , Kit Avenue and Farmway Road, excluding an approximate 300-foot strip on the east and west sides . It is the intention to lease the sites but with the option that the sites could be sold at a later date to individual ownerships . The total /� width of Laurel Street as shown is 50 feet . The City has 1 designated Laurel as an arterial and it should be wider to accommodate the number of vehicles that will be using the street as access to and from proposed subdivisions to the north and south. The zoning of this area is an industrial • -3- park and a "T" overlay will be needed for the subdivision ^ to comply with zoning requirements . Some corner lot dimen- '# sions should be adjusted to 7, 500 square feet . A variance will be needed for some block lengths which exceed 660 feet . The entire area is being platted with development to occur in phases . Improvements required will be surfaced streets , concrete curb and gutter, sidewalks, underground utilities , sanitary sewer system, and underground storm sewer system, if required. The water main extension and border street policies would apply. No irrigation district will be involved . There is a recreation area planned to be developed in the first phase . Some type of landscaping and/or screening from the industrial area is suggested. The developer' s engineer will provide all engineering for design, field work, control of construction and inspection and will secure all permits and certifications required . There will be 212 lots in the subdivision. Discussion over the mobile home subdivision centered around Laurel Street . It seemed to be the feeling of the Commission that more right-of-way should be required to maintain the arterial status of Laurel in view of the increased traffic the proposed develop- ments will generate. Ways to accomplish this were reviewed with some thought given to narrowing all local access streets , if problems with cul-de-sac lots could be solved, or to shifting the subdivision north 24 feet making Garber Street a local access rather than industrial street. There is a narrow right-of-way at the east end of Laurel where it enters Paynter Avenue because of DeWil ' s business establishment and because of the drain ditch, which must be taken into consideration also . After considerable 78-10-6 discussion, John Hull moved that the Commission accept the prelim- inary plat subject to the Engineer ' s report and recommend its approval to the City Council providing Alpha Engineers and the developers can come up with a suitable solution for Laurel Street . The motion was seconded by Jim Oates and, after a vote , carried . The City Engineer will work with the developer ' s engineer in nego- tiating the right-of-way . A public hearing was set for November 16th on the zoning change . A request for a variance to create a 6,000 square foot corner lot by selling a standard sized lot from her property at 5th and Grant has been submitted by Mrs . Bloomfield of 722 S . 5th. Dean Abrahams , in behalf of Mrs . Bloomfield, explained that she was unable to care for the large lot and would like to sell half of the property . 78-10-7 John Hull made a motion to set a public hearing for the variance . The motion, which was seconded by Jim Oates , passed. Considered next were applications for a special use permit for chemical storage and a variance to construct an office building to the property line, both regarding property in vacated Block 62 of Foote Addition at 14th and Denver owned by Darwin Feller . Because of placement of doors in an adjacent building, Mr . Feller /'1N is requesting to be able to locate an office in front of the doors and at the property line in the M-1 Industrial Zone . The chemicals stored will evidently be packaged and are of the type presently stored at Wasatch Chemical on Main Street for agricultural uses . Jim Oates 4 -4- ' 8-10-8 moved and John Hull seconded to hold a public hearing on the variance and special use permit requests on November 16. Motion carried. Starr Farish asked that the Fire Chief be consulted on the chemical storage . Roger Cantlon appeared before the Commission for a special use permit to construct mini-warehouses at Blaine Street and Georgia Avenue behind Taco Time . He indicated the warehouses were contemplated for storage of recreational vehicles and would not involve heavy equip- 8-10-9 ment . John Hull stated he had looked at the site and would move that a public hearing for a special use permit be scheduled for November 16 . The motion was seconded by Jim Oates . Motion passed . A proposed mobile home park at 21st and Chicago which will require a special use permit in an M-1 Zone was discussed . According to Wally Frank, who is working on this project with Ralph Smeed, there are approximately 23 acres with provisions for 140 double wide mobile homes on 50 foot by 90 foot lots . This would be a den- sity of 6 . 2 mobile homes per acre . Sewer and water are available . Some type of screening will be provided because of the stockyards . At present only one access is planned, but the Fire Chief will be consulted on the advisability of two entrances . After a discussion, 8-10-10 Jim Oates moved that a public hearing be set for consideration of the special use permit . Motion was seconded by John Hull and carried. In further action the Commission: 1 . Set a public hearing on November 16 on the Airport Hazard Zoning Ordinance. 2 . Established November 16 as the public hearing date to add a provision to Section 6-3-1(D) 4 of -the Zoning Regulations : In the R-1 Residential Zone, the heighth of an outbuilding not used as a dwelling shall not exceed 15 feet except by special permit . 8-10-11 3. Approved the preliminary plat of El Mon Townhouses sub- ject to filing of association documents with the final plat in a motion made and seconded by Jim Oates and John Hull . Starr Farish requested that a condition be drawn up to be added to special use permits for professional offices requiring a design for the building which becomes a part of the record and which can- not be changed after the permit is approved.
