Work Session
October 7 , 1977
Prior to the work session on the zoning ordinance, a business
meeting was held. Present were Chairman Don Tolley , Earl Priest ,
LaMar Bollinger, John Pilate , Ralph Nyblad , Tom Ensley , Bob Car-
penter, Mel Lewis , John Hull , Bud Grant , Chuck Banks , Al McCluskey
and Arlo Nelson. Also attending was Mayor Pasley .
A special use permit request by Dr. Reed Blaisdell to construct
a professional office at Elm and Hazel was discussed. The property
is presently zoned "B" Residential but will be in the R-3 district
under the new ordinance . Monday , November 7 , was set as the date
for a public hearing on this request.
Don Tolley said that Item No . 2 on the agenda, a special use per-
mit for a professional building to be constructed at 10th and Elm
which was requested by Drs . Bauscher , Nelsen and Vail , would be
postponed until the end of the meeting after a decision was made
regarding zoning boundaries .
The placement of a mobile home in the impact area south of the
City was reconsidered as Mrs . Cooper had entered an appeal through
the Mayor ' s office upon the advice of the County Planning and Zon-
ing Administrator. It was the decision of the Commission at their
regular meeting on September 15 to deny the request to put the
mobile home on the Charles Rogers property southeast of the Jeffer-
son Junior High School as it would he in an R-1 zone if annexed
and would not be in an area designated for mobile homes on indiv-
idual lots . The City Engineer informed Commission members that
a similar request would be on the agenda for the October 20 meet-
ing to place a mobile home in the impact area in the same vicinity .
He has , therefore , also placed on the agenda for discussion the
topic of a policy for placement of mobile homes in the impact area .
Arlo suggested that the Commission do the zoning for the entire
impact area according to the new classifications and use that as
a policy . He also pointed out that the County ' s zoning ordinance
is not yet adopted and there is presently no provision to prevent
mobile homes in the County zoninrr . After a discussion regarding
Mrs . Cooper' s reauest , it was felt that the final decision should
rest with the County Planning and Zoning commission since the City ' s
action was merely a recommendation. Thi City Engineer was asked to
begin working on a policy which would define the City' s position.
Bud Grant appeared before the Commission seeking a zoning recommenda-
tion to the County for property he owns approximately 1/44 mile from
the City limits . Accordincr to the City T'nrineer , both the County
and City Comprehensive Plans show this area as commercial , and he
1-10-1 recommended a C-3 Service Commercial zoninrr . Bob Carpenter moved
that a letter be written to the County P Z office recommending
that Mr. Grant ' s pronerty he zoned Banks seconded the
eN motion which , upon vote , carried . Bud Grant abstained from voting .

The Planning and Zoning Commission then went into a work session on
the zoning ordinance . Further discussion was held on duplexes in
the single family R-1 zone as to whether they should be allowed at
all , by special use permit , and/or be restricted to corner lots .
A vote was taken of members present and it was agreed to poll the
remaining Commission members before a final decision was made .
Mel Lewis read the written testimony that had been received during
the seven-day time period . One was a letter from Louis Asker , Jr. ,
requesting a neighborhood commercial zoning for his property at
Fifth and Illinois Avenues . ilarilyn :human submitted testimony
rerrarding; parking require_ vents and Mr. Oary Hall of Cosgrir'f Signs
presented a statement or proposed amendment to the sign section of
the ordinance . The written testimony is on file in the City Engin-
eer' s office .
After an evaluation of the testimony , Mel Lewis conducted a detailed
examination of the zoning bounda 'i.es as they relate to individual
properties . The Commission was in agreement in all areas but re-
quested one change between Flm and Ash Streets at Fairview Avenue .
-10-2 With this accomplished . John Hull moved and Tom Enslev seconded
the motion to send the proposed zoning ordinance to the City Coun-
cil with the recommendation that the Council set a public hearing
and adopt the proposed ordinance and map for the City of Caldwell .
Motion carried. Don Tolley directed that a letter be written to
Arlo Nelson to be signed by all of the Commission members express-
API ing their thanks and anoreciation for his help in creating and
finalizing the proposed zoning ordinance .
At this time John Pilote assumed the Chair and reconvened the public
hearing; of December 16 , 1976 , on the special use permit requested
by Drs . Bauscher, Nelsen and Vail for a professional office on the
southwest corner of Elm Street and Tenth Avenue . Don Tolley removed
the motion from the table and this was seconded by Bud Grant . The
Vice Chairman called for any additional testimony . Mel Lewis re-
viewed the legal proceedings for the advertisement and notification
of the public hearing as they were handled at that time by the appli-
cant submitting a list of property owners within 300 feet and the
Building Office mailing the notices . Hearing no further testimony ,
John Pilote closed the public hearing . The following discussion by
the Commission resulted in the agreement that the boundaries for
the hospital zone had been established , thus fulfilling the require-
7-10-3 ment of tabling the request . Bob Carpenter moved that the special
use permit be granted for the professional office . The motion was
seconded by Bud Grant and , upon vote , carried . Tom Enslev abstained .
