NEW BUSINESS
4/2-6106 (PUBLIC HEARING ON REQUEST FOR ANNEXATION OF
APPROXIMATELY 5 ACRES INTO THE CITY AS A R-1 ZONE SUBMITTED

Mayor Nancolas stated that this was the time and place set to hear this matter
which was to consider an application for annexation of approximately 5 acres as
R-1 zone submitted by Dion Zimmerman.Only one person,Mr.Zimmerman,was
signed to speak and would only speak if there were any questions. The Mayor
opened the Public Hearing and asked the Community Development Director to
present the background information on this item.
Linda James, the Community Development Director, was sworn in by the City
Clerk and stated that she would like to submit Exhibit CC-1000 which was a copy
of the Assessor's map identifying the site and surrounding zoning. She pointed
out the area under discussion,Palrang Subdivision,West Valley,and the area that
the Council directed her to move toward annexation. On March 11, 1998, notice
was published in the Idaho Press Tribune and on March 6, 1998, notice was
mailed to all property owners within 300 feet of the project site and to all political
subdivisions providing services to the City of Caldwell On March 19, 1998,
notice was posted on the site.
A letter to all of the residents in the area north of Palrang Subdivision was sent to
them last week. It was a courtesy letter indicating that the City would be moving
forward to annexation and explained the process.
This matter was heard by the Planning and Zoning Commission on March 26,
1998, at which time they did vote to recommend to the City Council to approve
the request. She also noted for the record that only one person signed to speak
and that was the applicant speaking in favor. There has been no opposition to this

annexation request. The intent for this site was to construct a Church of Jesus
Christ of Latter-Day Saint's Church. Under 7.6 in the Staff Report, it states that
the Special Use Permit shall become null and void if construction plans have not
been submitted to the Community Development Department by March 1, 1999
and if construction has not commenced by September 1, 1999.
There was a short discussion on this request. Mr. Zimmerman indicated that he
did not care to speak to the matter unless the City Council had any questions.
Mayor Nancolas listed the evidence as follows: I, Sign up Sheets; II, Site Map,
III,Staff Report.
MOVED by Earl, SECONDED by Houchins to accept the evidence as noted by
the Mayor.
Roll call vote. Those voting yes; Earl, Ozuna, Langan, Wells, Houchins, and
Evans. Those voting no: none. Absent and not voting: none.

After several more questions to the City Engineer, it was MOVED by Evans,
SECONDED by Houchins to close the Public Hearing.
Roll call vote. Those voting yes: Evans, Earl, Ozuna, Langan, Wells, and
Houchins. Those voting no: none. Absent and not voting: none.

The Mayor officially closed the Public Hearing and asked that the City Council
present the Findings of Fact.
Councilwoman Earl presented the following Facts:
• The property was in the Area of Impact and was contiguous to the City of
Caldwell and therefore,eligible for annexation.
• Section 67-6522 of Idaho State Code states that the Council has the authority
to do these concurrently and that the Council was aware that there was a
companion Conditional Use Permit that was going with the annexation;
• Annexation was for R-1 and was in compliance with the Comprehensive Plan.
Councilman Evans stated further Findings:
• The Public Hearing was properly noticed in the paper and has met the
requirements set forth in Idaho Code,Chapter 65 of the Local Planning Act.
Councilwoman Earl noted that this was not a Finding of Fact, but rather a
Conclusion of Law.
Councilman Evans agreed and proceeded as follows:
• The Facts as stated in the Staff Report be included as a Finding of Fact.
MOVED by Langan,SECONDED by Evans that the Findings of Fact be accepted
as presented.
Roll call vote. Those voting yes: Langan, Wells, Houchins, Evans, Earl, and

Mayor Nancolas asked that the Council present Conclusions of Law at this time.
Councilwoman Earl presented the following Conclusions:
• The City Council has the legal authority through Idaho Code to hear this
matter and make a decision;

and to zone it R-1.
Councilman Evans added:
• This Public Hearing was properly noticed.
Councilman Langan:
• They met all of the applicable ordinances and laws of the State of Idaho.

presented.

Mayor Nancolas informed Council that the next order of business was to consider
Bill No. 12 to annex the property requested by Dion Zimmerman. He also noted
that the Community Development Director informed them that there was no
urgency in passing this Bill. He would, therefore, suggest that this be the first
reading of Bill No. 12. The title of the Bill was presented by the Mayor as
follows:

the City of Caldwell.

the co munity; spent Thursday at an all day Initiative meeting where good
corn- ents were presented; have had two town hall meetings on co ructing a

The said property consists of approximately 5.0 acres, more or less, is located on the east side of
South Montana Avenue, south of Ustick Road, to the southeast of South Palrang Subdivision and
described as follows:
A part of the Northwest Quarter of the Southwest Quarter of the Northeast Quarter of Section 3,
Township 3 North, Range 3 West of the Boise Meridian, Canyon County, Idaho. Being more
particularly described as follows: Beginning at the center quarter corner of Section 3, Township
3 North, Range 3 West of the Boise Meridian, Canyon County, Idaho; thence North 0° 24' 50"
West 946.52 feet along the quarter line to a point, the REAL POINT OF BEGINNING; thence
continuing North 0° 24' 50" West 380.00 feet along the Quarter line to a point; thence North 89°
01' 37" East 574.00 feet to a point; thence South 0° 24' 50" East 379.84 feet to a point; thence
South 89° 00' 40" West 574.00 feet to a point; the REAL POINT OF BEGINNING.
Section 2. That the above-described real property be, and the same is hereby annexed and made
a part of the City of Caldwell, Canyon County, Idaho.
Section 3. That the real property herein by this ordinance annexed to the City of Caldwell herein
above described shall be zoned and a part of the R-1 zoning district and the official zoning map
is hereby amended accordingly.

Section 4. That the City Engineer and the Community Development Director are hereby
directed to alter all use and area maps as well as the official zoning maps, and all official maps
depicting the boundaries of the City of Caldwell in accordance with this ordinance.
Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby
repealed, rescinded and annulled.
Section 6. This ordinance shall be in full force and in effect from and after its passage, approval
and publication, according to law.
Section 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of
this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman
manner plainly and clearly designating the boundaries of the City of Caldwell, including the land
herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the
Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of
this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho
Code §63-2219.
