NOTICE IS HEREBY GIVEN that the Caldwell Planning and Zoning Commission will conduct a public
hearing in City Hall Council Chambers, 621 Cleveland Boulevard, on September 24, 1998, at 7:00 p.m.,to
hear the following:
To hear concurrently Case Nos. ZON-01-98 and SUB-25P-98 (West Valley Estates, Phases 6, 7, and 8), a
request by West Valley Development, LLC, to rezone approximately 57.32 acres from R-S and R-S2(Semi-
Rural Residential)to R-1 (Single-Family Residential), and preliminary subdivision plat approval to develop
220 residential and 6 common-area lots on the aforementioned acreage. The site is located south of West
Valley Estates Subdivision, Phase 5 and lies along the northern boundary of Homedale Road approximately
one-eighth mile east of South 10th Avenue.
Case No. SUP-45-98, a request by Karla Bull to operate a Child Care Centeyn an existing build!located in a
C-2 zone. The building is located at the southwest corner of the intersection of Elgin and 9th Street and is more
commonly known as 522 N. 9th Street.
Case No. SUP-46-98, a request by Thomas R.Ensley&Associates,representing the Canyon County Board
of Commissioners, to construct a two-story 25,626 foot addition on the north side of the existing Juvenile
Detention Center located in a C-2 zone. The addition will house a total of 104 beds and will include a meeting
room and space for 22 additional County offices. The Juvenile Detention Center is located at the northwest
corner of the intersection of 13th Avenue and Albany Street.
Case No. SUP-47-98, a request by Treasure Valley Christian Center, Inc., to locate a church and conduct
church services in an existing building located in a C-2 zone. The building is located at the northwest corner
of 7th Avenue and Arthur and is more commonly known as 214 South 7th Avenue.
Case No. SUP-48-98, a request by Carolyn Devlin to use an existing building and grounds located within an
R-1 zone for the purpose of providing a setting for business meetings, social gatherings, weddings and
receptions; and to place a manufactured home on the site for use as security guard living quarters. The site
consists of approximately 5 acres and is more commonly known as 701 N.Indiana Avenue.

I COURSE OF PROCEEDINGS
1.1 The Caldwell Community Development Department issued a notice of Public Hearing on
application SUP-47-98 to be held on September 24, 1998. Public notice requirements set forth in
Idaho Code, Chapter 65, Local Planning Act, were met. On September 9, 1998, notice was
published in the Idaho Press Tribune; on September 4, 1998, notice was mailed to all property
owners within 300 feet of the project site; and on September 17, 1998, notice was posted on the
site.
1.2 Files and exhibits relative to this application are available for review in the Community
Development Department and will be available for review at the hearing.
II GENERAL FACTS
2.1 APPLICANT(S): Treasure Valley Christian Center,Inc.,P.O. Box 1122, Caldwell,ID.
2.2 OWNER(S): Tim St George,P.O. Box 1122, Caldwell,ID.
2.3 REQUEST: To use an existing building located in a C-2 zone as a church.
2.3.1 The Applicant's narrative (Attachment A) notes that they have had church services in the
Caldwell area for over 16 years and would like to relocate to the building located at 213 South 7th
Street,which was most recently used as Jack's Sporting Goods. The building is currently vacant;
their intent is to remodel the building and maintain both the building and parking lot.
2.4 LOCATION: The existing building is located at the northwest corner of the intersection of 7th
Avenue and Arthur and is more commonly known as 214 South 7th Avenue.
2.4.1 The building and parking lot is also located(see Attachment B,copy of location map) almost in
the center of the area designated as the Business Improvement District (BID). In 1995, the City
Council signed a petition of intent,which basically offered support and approval for the Townsite
Committee to pursue the formation of a BID. A District is formed when 51% of the business
owners within the designated area petition for Council approval. At this time,the Committee has
49%of the required signatures. The District,once approved, can assess property/business owners
a small percentage of the current assessed value of the property. The funds from this assessment
can be used for parking facilities; physical improvements or decoration of public spaces;
promotion of public events; the purchasing and operation of public transportation to promote
retail trade activities; and general promotion of retail trade activities.
2.4.2 The City Council recently contracted for the services of a local architect to provide pictorial
renderings of an area within close proximity to the proposed church request; the renderings are
intended to provide a focal point that would tie the downtown businesses together and that would
emphasize the historic depot.
2.5 NATURAL RESOURCES AND HAZARDOUS AREAS: The property is not within the near
vicinity of the Boise River or Indian Creek.
2.6 LAND USE: The site is zoned C-2. Churches are allowed in a C-2 zone by special use permit.
2.7 COMPREHENSIVE PLAN DESIGNATION: Commercial.
2.7.1 The Comprehensive Plan map identifies commercial sites but does not differentiate between
Neighborhood,Community, Service, or Interchange commercial.
2.8 AREA OF CITY IMPACT: The project site is not within the Area of City Impact.
2.9 PUBLIC FACILITIES:
2.9.1 Schools—Notice of the request was sent to Caldwell and Vallivue School Districts on September
4, 1998.
2.9.2 Fire Protection — If approved, the Applicant will be required to obtain a "change in use of
building" permit. The Fire Marshal, as a part of this permitting process, will review the request
and the building will have to meet fire codes before a permit is issued.
2.9.3 Water/Sewer—The building is connected to the City's public water/sewer systems.
2.9.4 Stormwater— There are no plans to add onto the building; the proposed parking area for use by
the members is already in use as a parking lot.
2.12 TRANSPORTATION: The parking lot(with 42 parking spaces)is behind the building and can be
accessed from both Arthur and 7th Streets.
2.12.1 Section 10-02-05, Subsection 3, of the Zoning Ordinance notes that 0.25 parking spaces for each
seat in a Church are to be provided. Forty-two parking spaces would accommodate a
membership of 168 persons.
2.13 PARKS, RECREATION AND OPEN SPACE: Parks, recreation and open spaces are not
proposed.
2.14 HISTORIC AREAS: This site is within the City's Area of Historic Significance.
2.15 HOUSING: The existing building is in a C-2 zone; housing can be permitted by special use
permit. The subject building is single-story and there is no proposal to provide dwelling quarters.
2.16 COMMUNITY DESIGN: There is no open space or landscaping at this site.

9.2 The specific terms and conditions placed on the Special Use Permit shall run with the land and
remain valid upon a change of ownership, or until such time that the Permit may be revoked,
become invalid, or replaced with another approved use. The Special Use Permit is not
transferable from the approved site to another site.
9.3 The Applicant, or future assigns having an interest in the subject property, shall fully comply with
all conditions placed upon this Special Use Permit.
9.4 No changes in the conditions and terms of this Special Use Permit, as approved, shall be
undertaken by the Applicant, or future assigns having an interest in the subject property, until the
Community Development Director has reviewed the proposed changes and approval for
amendment has been granted through the public hearing process.
9.5 Any violation of the terms and conditions of this Special Use Permit by the Applicant, or future
assigns having an interest in the subject property, will be deemed a misdemeanor and subject to
the provisions set forth in Idaho Code, 18-113. Each day's continued violation will be deemed a
separate offense.
9.6 The use of the building shall not be commenced until the Applicant has obtained all permits
required by the City to use the building as a church.

Dear Ladies and Gentlemen:
This letter is in regard to our application for a special use permit. The name of our
church is Treasure Valley Christian Center, Inc, doing business as Oasis Worship Center. We have
been having church services in the Caldwell area for over sixteen years. We would now like to change
our location and conduct our services in the building located on 214 South 7th Street, which was
formerly Model Market, Taylor Music and Jack's Sporting Goods.
We believe granting us a special use permit will benefit the public immensely and have
a positive influence on the downtown Caldwell area, including all the surrounding businesses. We
would be moving into a building which is presently vacant and has not been well maintained. We
would remodel and maintain the building and parking lot so they would like nice once again and be
well kept. We believe having a church in that area would greatly enhance the area for value and
worth. We would bring more traffic to the downtown area which would also bring benefits to the
surrounding businesses. We would not be in competition with any of the merchants due to the fact
that we are a church. The people in the community will have another choice for a place of worship
in the downtown area.
We believe having a church in this location of our city would not have any detrimental
affect on anyone or any business, and we would not adversely affect the public interest in any way.
In conclusion, we believe that we will have a positive affect on the community and
bring a heightened awareness to the people of Caldwell. Thank you for granting us a special use
permit.
