Public notice requirements set forth in Idaho Code, Chapter 65, Local Planning Act, have been met. On July 21, 1999 notice was published in the Idaho Press Tribune; on July 16, 1999 notice was mailed to all property owners within 300 feet of the project site; and on July 29, 1999 notice was posted on the site. 1.2 Files and exhibits relative to this application are available for review in the Community Development Department and will be available for review at the hearing. H GENERAL FACTS 2.1 APPLICANT (S): Johnson Brothers Hospitality/Best Western Caldwell Inn and Suites, 908 Specht Avenue, Caldwell, ID 83605 2.2 OWNER (S): Larry Johnson, Clifford Johnson, Dick Berry, P.O. Box 1327, Mountain Home, ID 83647 2.3 REQUEST: Approval of a special use permit to rent office space within the Best Western Caldwell Inn and Suites and parking lot spaces to Enterprise Car Rental. The Applicant noted that the car rental office would be open from 9:00 a.m. to 5:00 p.m., Monday through Friday, and that a minimum of two parking lot spaces located on the west side of the Inn would be reserved for rental cars. 2.3.1 Zoning Ordinance No. 1451, Section 10-02-01 sets forth the requirement that only one of the uses, as set forth in Table 1, Land Use Schedule, shall be permitted on a lot or parcel unless otherwise permitted by special use permit. 2.4 LOCATION: Best Western Caldwell Inn and Suites, 908 Specht Avenue. 2.5 LAND USE: The site is zoned C-3 (Service Commercial). 2.6 COMPREHENSIVE PLAN DESIGNATION: Commercial. 2.7 PUBLIC FACILITIES: 2.7.1 Schools —Notice of the request was sent to Caldwell and Vallivue School Districts on July 16, 1999. VI CONCLUSIONS OF LAW 6.1 The Commission has the authority to hear this case and to approve or deny; public notice requirements were met, and the hearing was conducted within the guidelines of Idaho Code and City ordinances. VII ORDER OF DECISION 7.1 Based upon the Findings of Fact and Conclusions of Law the Planning and Zoning Commission orders that Case No. SUP-63-99, a request by Johnson Brothers Hospitality to rent office space within the Inn and parking lot spaces to Enterprise Car Rental is (approved/denied) with the following conditions (if approved): 7.2 The specific terms and conditions placed on the Special Use Permit shall run with the land and remain valid upon a change of ownership, or until such time that the Permit may be revoked, become invalid, or replaced with another approved use. The Special Use Permit is not transferable from the approved site to another site. 7.3 The Applicant, or future assigns having an interest in the subject property, shall fully comply with all conditions placed upon this Special Use Permit. 7.4 No changes in the conditions and terms of this Special Use Permit, as approved, shall be undertaken by the Applicant, or future assigns having an interest in the subject property, until the Community Development Director has reviewed the proposed changes and approval for amendment has been granted through the public hearing process. 7.5 Any violation of the terms and conditions of this Special Use Permit by the Applicant, or future assigns having an interest in the subject property, will be deemed a misdemeanor and subject to the provisions set forth in Idaho Code, 18-113. Each day's continued violation will be deemed a separate offense. 7.6 Prior to the use commencing, a change in use permit shall be obtained from the Community Development Department. The building permit has been processed,approved and is ready to be picked up. Our office staff has informed me that they have contacted you on several occasions to let you know that it is ready.I believe that the building has been put to the use that you applied for without procuring your required permit.I can give you until Friday April 24,2000 to come to my office to procure your required permit, and schedule the required inspection. If I do not hear from you before or on Friday,April 28,2000 I will turn this matter over to our city attorney and recommend legal action. I will remind you that any person violating any provisions of Caldwell City Code shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed three hundred dollars($300.00)or by imprisonment not to exceed thirty(30)days or by both such fine and imprisonment.Each separate day or portion thereof during which any violation of this code occurs or continues shall be deemed to constitute a separate offense.In addition to or in place of other penalties provided, I failure to obtain a permit when required shall cause that permit to be quadrupled.If you have any questions you can call me at 455-3024.
