The Engineering Department has reviewed the proposed Planned Unit Development for 711 E.
Cleveland. The Department has received a complaint from a neighbor regarding customers of
711 E. Cleveland using private parking lots adjacent to this address. This complaint is
forwarded, without comment, for the information of Planning and Zoning.

RE: Cases for Public Hearing
The following cases are scheduled to be heard before the Planning and Zoning Commission on June 15, 1999:
Case No. SUP-58-99, a request by Sundowner,Inc., for approval of a special use permit to construct one,
four-plex dwelling structure on each of 15 respective lots in Madison Estates Subdivision, which is located
in an R-2 zone. The subject site is bordered by E. Madison Street,Nogales Court,N. 151 Avenue and N. 3rd
Avenue.
Case No. SUP-59-99,a request by John Starr for approval of a Planned Unit Development to use an existing
structure known as the old IOOF building for multi-uses consistent with C-2(Community Commercial)zone
uses. The building is more commonly known as 711 East Cleveland.
To hear concurrently Case Nos.ANN-20-99 and SUB-36P/F-99,a request by Crestline Development to annex
approximately 5 acres into the City as a C-1 (Neighborhood Commercial)zone,and to approve the preliminary
plat of Southpark Business Center, which consists of 4 lots. Included in the request is approval of a
development agreement as it relates to development of the commercial lots. If approved,the 5 acres will be
included in the next available update of the Comprehensive Plan Map. The site is located at the southeast
corner of the intersection of Homedale Road and South Montana Avenue, and is legally described as a part
of the NW 1/4 NE 1/4, Section 10,Township 3 North,Range 3 W.B.M.
Case No.OA-22-99,a request by the Planning and Zoning Commission to amend Zoning Ordinance No. 1451
by repealing Article 5,Mobile Home Park Standards and Procedures,and to adopt Article 5,Manufactured
Home Developments, Design and Construction Standards. The proposed Article sets forth the following
Sections: Purpose and Intent, Permitted by Special Use, Permitted Uses, Required Improvements, General
Requirements,Preapplication Conference,Application Requirements,Placement Standards,Deed(s)Required,
Significance of Approval, As-Built Approvals, Planned Unit Development. The request also includes
amending Section 10-02-02,Table 1,Land Use Schedule,by deleting"Mobile Home Parks as a special use
in R2,R3, C3 and Ml zones"and by adding"Manufactured Home Development as a special use in R1,R2
and R3 zones."
Case No. OA-24-99,a request by the Planning and Zoning Commission to amend Subdivision Ordinance No.
1758 by amending Article 1, Section 11-01-04,Defmitions,by adding a defmition for"Manufactured Home
Development"; and amending the definition of "Subdivision" by adding certain language to exclude a
Manufactured Home Development from being considered a subdivision; and by deleting Subsection 2 of
Article 1, Section 11-02-002, Compliance with Idaho Code Required.
Southpark Business Park is being heard as a short plat;a copy of the plat is attached for your review. Could
you offer me your response by June 9, 1999? Thank you in advance for your input.

SUBJECT: 711 E. Cleveland SUP-59-99
If the above referenced project is approved the following
requirements will need to be met for minimum levels of Fire
Protection:
1 . Premises Identification. All numbers or addresses shall be
6" high and placed on the front of the building in such a manner
to be clearly visible from the street to which it is addressed off
of . The numbers shall contrast with their background and be
placed above the front door. UFC 901 . 4 . 4 This shall be separate
from any Corporate Sign and shall be posted on the Cleveland side
of the building.
2 . Portable Fire Extinguishers shall be installed in occupancies
and locations as set forth in this code and as required by the
Chief . UFC 1002 . 1 Fire Extinguishers shall be of the 2A 10BC
size and have the top of the extinguisher hung 3 ' to 5 ' off the
floor. A fire extinguisher shall be at all points within facility
within a maximum travel of 75' . All fire extinguishers on the
premises shall be serviced and have a service tag dated within
the last year.
3 . Emergency Power Equipment . Equipment providing emergency
power for exit illumination and exit signs shall be maintained in
an operable condition. UFC 1211 . 2 Please provide one candle foot
of illumination at the floor level in all areas leading to an
exit .
4 . Exit Sign Illumination. Signs shall be internally or
externally illuminated by the two electric lamps or shall be of an
approved self-luminous type . UFC 1212 . 4 They shall be provided
above all required exits .

5 . Provide a rated corridor to provide a means of exiting
through the kitchen.

Here we go again . . .
I received a phone call from Sgt. Wright at CPD late Friday afternoon regarding a "new" duo ii r
Caldwell. The club was reported to be at the Cleveland Events Center on the north corner of
Cleveland at Kimball. The Cleveland Events Center is located in the old IOOF lodge building that has
three floors to it. The KO Club is located in the sub-grade floor(basement). CFD files indicate an
address of 316 S. Kimball but don't contain any other information, other than a very old floor plan. The
building has been used for weekend social events and private parties, primarily"quinceneras". I have
not had any beer and wine inspection requests for the place and have never inspected it before. I
have not received any complaints on this facility before or else an inspection would have been
conducted.
I briefly stopped by there on my way home Friday night and observed a sign over the Cleveland Blvd.
side door (apparently the main entrance)stating: KO Club—Perez Enterprises. The door was open
and I observed tables set up just inside the door-along with several extension cords. I went inside
and finally located an older Hispanic gentleman named Gabriel Perez. Mr. Perez spoke broken
English but as best as I could determine using my broken Spanish: they have opened the club to the
public, they serve alcoholic beverages, they have live bands, and they don't have any permits.
Apparently Mr. Perez's son, Johnny, runs the club but he was not there. I did not observe any
evidence of alcoholic beverage containers, signage or indications they serve liquor on the premises
(this was around 5:10 PM and no one else was there).
By my estimation the club occupies an area about 50'x 80' (4,000 SF). It is generally an open room
with some limited kitchen facilities in the rear and a small stage. I observed numerous fire and building
code violations mainly as they relate to this being an assembly occupancy. Restrooms are accessed
by going upstairs into another portion of the building. The facility is not fire sprinkled (but probably
would not be required to be since it is under 5,000 SF). There appears to be inadequate exiting, no
illuminated exit lights, no emergency lighting, no visible fire extinguishers, no posted occupant load, no
fire alarm system, illegal use of extension cords, other possible electrical code violations, etc.
Obviously this place needs a fire and building code inspections, especially with the serious exiting
problems and "home-made electrical work" I noted. However, do they need a SUP to operate a club
open to the public? They must need a B&W license if they are serving alcohol. Do we want to meet
collectively on this to develop a uniform strategy to get this place into compliance? What can we do in
the interim? Your comments and insight are appreciated. Thanks. Doug
