RE: SUP for KIDS FIRST, LLC
Dear Chairman and Commission Members:
I am unable to attend the public hearing on the Special Use Permit for a child care
center and variance from off-street park requirements for Kids First, LLC because of
a prior business commitment. Therefore, I would ask that the Chairman read this
letter into the record as my testimony on the above referenced applications.
I am the owner of Lot 8, Block 1 of Badiola Industrial Park Subdivision, aka 314
Badiola St., and operate my business at this location.
Through this letter I wish to state my objection to the above referenced applications
for the following reasons:
1. Variance request of one off-street parking space per each eight children:
• Lot 6, Block 1 of Badiola Industrial Park is 0.899 acres in size and can more
than adequately handle the necessary park space requirements. Furthermore
the configuration of this lot does not preclude the design of a facility which
would provide for the required number of parking spaces.
2. Child Care Center
• Badiola Industrial Park is located in an M-1 Light Industrial. According to the
City's Zoning Ordinance and Comprehensive Plan Light Industrial Areas are
to create, preserve and enhance areas containing manufacturing and other
related establishments. _ crt

• Although there is no "drive by traffic" as stated in the applicant's narrative,
there is a concentration of heavy/large vehicle traffic. Within this subdivision
we have a truck terminal yard and construction yard. These 18-wheelers and
heavy construction vehicles do not travel at low rates of speed as the applicant
has stated. Rather they are moving rapidly for their size and weight. From my
office window each day I see these vehicle turn the corner from Chicago St.
onto Badiola St. doing speeds of 20-25 miles per hour. These trucks are not
able to stop quickly and certainly would not be able to stop for a child in the
street or for a car that crosses its path.
• Located at the northwest corner of Chicago St. and Badiola St. is the Caldwell
Veterinary Hospital. The drive way for this facility is located approximately
20 feet from Chicago St. During the construction of the veterinary hospital, I
brought to the City Engineer's attention that the placement of the driveway
and its close proximity to the intersection. Mr. Law acknowledged that the
driveway was in fact located to close to the intersection; however, the permit
had been approved and he would not require that a change be made. Each day
from my office my staff and I notice a number of near accidents. People either
back out of the veterinary hospital driveway; waiting to enter on to Chicago St.
from the wrong traffic lane; or, enter the driveway at an angle from Chicago
and are not making the corner turn.
On several occasions I have discussed this situation with Mr. John Badiola,
owner of the truck terminal yard and construction yard previously referred to
in this letter. Mr. Badiola has expressed to me his concern that because of the
location of the veterinary hospital's driveway and the speed at which his truck
drivers travel that it is inevitable a serious accident will take place at this
intersection. To add a child care facility to this existing situation would only
increase the potential for serious injury or death.
• Also, of concern is the impact that the existing business and future industrial
business will have on the child care facility and how those issues will be
addressed. My question to the Commission is: What happens when the facility
complains of to much noise, to many heavy trucks, and of the everyday
operation of light industrial uses that are not compatible with a child care
facility? What assurance can or will the Commission give that our business
operations will not be adversely affected by the child care facility?
• The applicant in his narrative did not address how children would be taken to
schools. The closest elementary to this location is Van Buren and there are not

sidewalks within Badiola Industrial Park and the number and location of
sidewalks between this subdivision and the school are very limited and mostly
non-existent.
Please understand that I do not oppose child care facilities, I just believe that this is
an inappropriate locations for one. I understand that the Zoning Ordinance allows
for child care facilities in an M-1 zone with a special use permit and if this proposal
were to provide an on site facility for an existing business I would not object.
