Testimony—
Linda James presented the staff report and in response to a question stated that the near neighborhood does not
consist of a mix of site built and manufactured homes (as noted in Section 2.6 of the report) was incorrect and
should be deleted.
Milt Minor, Applicant testified in favor and stated the following: the type of manufactured home he is considering
buying is between the years 1979 and 1990;he purchased a 1979 14 foot by 66 foot manufactured home for Lot A;
he will need to purchase a smaller unit for Lot B, perhaps a smaller, shorter double wide home; he has an
agreement with Kit Manufacturing to provide the lots and homes for rent to employees of Kit; he intends to fmd
several lots in the City on which he can place these homes; and he will meet City's setback requirements;he is not
certain how much of Lot B would be taken if he were to give the 40-foot half right-of-way along Paynter.
Public Testimony Closed—Chairman Blacker closed public testimony.
Comprehensive Plan Analysis - Motion: Commissioner Beebe. Second: Commissioner Archuleta. The request
is in compliance with the following Comprehensive Plan Components: Residential- Policies 3 and 10; Urban
Storm Runoff-Policy 1. Passed: Unanimous roll call vote.
Findings of Fact—Motion: Commissioner Beebe. Second: Commissioner Archuleta. Accept the general facts as
outlined in the staff report as findings of fact and include the following as facts: the near neighborhood does not
consist of a mix of site built and manufactured homes as the neighborhood consists of site built homes; a 1979
14'x66' manufactured home has been purchased for Lot A; the City Engineer is requiring a 40' half right-of-way
along Paynter Avenue and is requiring that curb/gutter and sidewalk improvements are installed at the time of
issuing a building permit. Passed: Unanimous roll call vote.
Conclusions of Law — Motion: Commissioner Beebe. Second: Commissioner Archuleta. The Commission has
the authority to hear this case and to approve or deny; public notice requirements were met, and the hearing was
conducted within the guidelines of Idaho Code and City ordinances. Passed: Unanimous roll call vote.
Order of Decision—Motion: Commissioner Beebe. Second: Commissioner Archuleta. Approve Case No. SUP-
67-99 with the standard conditions of approval outlined in the staff report. Passed: Unanimous roll call vote.
Public Hearing Closed —Chairman Blacker closed the public hearing and noted anyone wishing to appeal their
decision should see the Director of Community Development.

C. Case No. SUP-66-99, a request by Rano and Sarah Sullivan for approval of a special use permit to
construct a townhouse(two family dwelling) on a parcel of land located within an R-1 zone.
Testimony—
Linda James presented the staff report.
Rano Sullivan, Applicant, spoke in favor and stated the following: he has met with Gene Enebo, Engineering
Department, and Mr. Enebo believes that by extending the sewer on down Tinnin Lane that they could hook onto
gravity flow; Tinnin Lane will be extended to provide access to the townhouse; they will make the lot as large as
necessary in order to meet the minimum lot size requirements; and he asked who has to pay for the installation of
the fire hydrant required by the City.
