Detailed description of the Request. This is a request for the issuance of a Special Use Permit to allow Walker Law Offices, PLLC, and its successors, assigns and licensees to conduct light commercial activities at 617 South 6th Avenue, Caldwell, Idaho (hereinafter the "subject property"). It is anticipated that your applicant may seek a re-zone of the impacted area at a future date, although such a request is not anticipated within this fiscal year 2000. 1. The Requested Use: The immediate anticipated use would be the provision of professional legal services. Walker Law Offices, PLLC, is presently a solo practitioner law firm, located at 911 Main Street, Caldwell, Idaho. Walker Law Offices presently shares office space with Herbert W. Rettig, of Rettig & Rosenberry, attorneys. Mr. Rettig is nearing retirement, but may desire to continue to share office space at the subject property. This would result in two attorneys occupying the premises upon grant of this application, together with a support staff of one. Parking: Off-street parking is presently available for only two automobiles. However, the maximum occupancy load of the premises is consistent with a single family residential unit, and an option has been considered that would open up to four additional off-street parking spaces, by conversion of the side yard into a parking area. This latter option is not immediately desirable, because the owners have not decided to permanently change the subject property from a residential to a commercial unit, and the conversion of the side yard into parking would destroy the residential nature of the property. 3. Utilities: It is not anticipated that utility use or requirements will change significantly. Irrigation use should remain the same or decrease. Domestic water use should decrease, due to the termination of domestic activities such as laundry, etc. Power consumption is likely to increase, but this is primarily due to plans to install air conditioning on the subject property premises. Fire, police and medical transport issues should not change at all. 4. Location and harmonious uses in the area: The requested use is in a block (Block 126) presently zoned R3. However, the requested use is harmonious with many of the surrounding and existing uses. (a) The residence adjacent to the subject property on the south boundary is vacant, and has been vacant for an extended period. The former owner was Dave Fraley, who passed away approximately one year ago. Since then, his estate has sought without success to sell the property. The structure there is probably not habitable, and will likely be torn down eventually. In that event, the corner on which the house sits would be an ideal light commercial location. —3— June 12,2000 (b) An alley separates the property adjacent to the subject property immediately to the north. That property was recently converted to a residential care center use, and, if not technically then practically, represents a light commercial use. (c) One block to the north of the subject property is St. Mary's Catholic Church. In the immediate vicinity of St. Mary's are Flahifrs (including the crematorium), the old Sears Roebuck building, Wildman Sports, Shucks Auto Parts, Wells Fargo Bank, the Stinker Station/Handi Mart, Cuts & Curls, and of course, Caldwell City Hall and the Fire Station. About two city blocks to the north and west of the subject property is Anderson Lumber, with Albertson's just across Blaine from that. (d) To the east of the subject property, Pioneer Title Company of Caldwell recently built its new offices on the site of the old M&W Market, which was later Family Food & Fun. Pioneer Title's building is fronted by Kimball, a major commercial thoroughfare within Caldwell. Businesses on Kimball within four city blocks of the subject property include Western Bank, Dakans, Home Federal Bank, Orphan Annie's, the new offices of Gregg Lovan, and the Municipal Golf Course. (e) Less than a block to the east of the subject property, on the south side of Fillmore, is Frye& Vauk, Certified Public Accountants. (f) The subject property is located two blocks south of Cleveland Blvd., two blocks west of Kimball, and three blocks north of the city park, tennis courts and the public swimming pool. Just four or five blocks south and west of the subject property —4— June 12,2000 begins the light industrial sectors occupied by the likes of Crookham's, Tolsma Auto Body and other similar uses. B. How will the use benefit the public? The first aspect of the use is that it will serve to bring professional legal services into an historic area of Caldwell. Walker Law Offices initially was established as Robinson & Walker, PLLC, on July 1, 1996. This firm has been based in Caldwell since it was established. We are a general practice law firm, with some specialization in real estate matters, construction litigation and other civil matters. However, we also provide representation in family law (adoptions, guardianships, divorce, custody, etc.) and limited criminal defense. The subject property is located within the historic Strahorn Addition. The structure was originally built in 1915. Many of the original features of the structure have been maintained, although it has been updated. The neighborhood is charcaterized by older structures and mature trees. However, the fact of the recent development of low- cost new homes in the south Caldwell area have rendered this home nearly unmarketable. By conversion of such historic homes to compatible light commercial uses, Caldwell has the opportunity to preserve the historic flavor of the area at the same time that incubates new small businesses. Such an approach has been used successfully in many places around the country, including the north end of Boise, where numerous small and medium business thrive in harmony with the historic residential sections of town. —5— June 12,2000 A law office is especially suited to the area. The clientele are quiet and unobtrusive, and often desire anonymity. The use presents no moral nuisance, such as with alcohol or adult materials, loitering, and the like. Vehicle trips are minimal, and there are actually, in my opinion, reduced concerns with property crimes such as theft and vandalism. In fact, the existence of a business in this area that is open only during daytime hours may serve as a neighborhood "watchdog," ensuring that no criminal activity takes place in that area while residents are at work. The type and number of clients should be somewhat comparable to that experienced by the professional offices of Frye and Vauk, a mere block away. Finally, the Nampa - Caldwell area is under served by the legal profession. Local businesses often look to Boise for civil representation simply because there is a lack of attorneys qualified to handle the diverse business interests that continue to develop and expand here. C. Would the requested use adversely affect the public interest? The short answer is "No." There may be some understandable concerns of commercialization from residents in the immediate vicinity. However, the conditions of the neighborhood have radically changed, and continue to change as Caldwell grows. The Pioneer Title building is one of the most visible markers of that change. The few other houses that occupy Block 126 are surrounded by commercial activity. Many of those houses are, in fact, now leased by their owners, who no longer live there. Block 126 is occupied by the residential care center, two home-based occupations, and an apartment complex. Another house has been vacant for an extended period. Furthermore, a look at —6— June 12,2000 the Comprehensive Planning Map shows that this block consists of a "peninsula" of R3- zoned area jutting into areas otherwise zoned Cl. Any increased vehicle trips will occur during the daytime hours only, when either most residents are at work or the surrounding commercial establishments are open for business. No noxious noise or other pollution will be presented by the requested use. No additional burden will be placed on the infrastructure. In fact, that burden may be reduced.
